TO THE HOMORABLE SUPERIOR COURT OF IREDELL COUNTY: Kittie K.Gaither, Trustee for her children, to-wit: Thomas K. Gaither, Katherine &. Gaither, and Wilfred Turner Gaither, and in her own individual right, petitioning the Court, respectively shows: First: That Ernest G. Gaither died in Iredell County on June Sth, 1926 leaving o last will and testament, which wes duly probated and recorded in the Office of the Clerk of the Superior Ceurt for Iredell County, in Book g » page 303 e« The fifth clause of said will reads as follows- "To my beloved wife, Kittie Kirkpatrick Gaither, I Bequeath all my estate, real and personal, in trust for herself and our children by me." Second: That said testator, Ernest G. Gaither, died seised and possessed of the following lands, to-wit: Pirst Tract: Beginning at a stone, Pierce’ and J.A. Thirds That your petitioner, Kittie K. Gaither, wife of said testator, dissented from the will aforesaid and has a Dower interest by reason thereof, in the aforesaid land, and .qam she desires to hold her interest in said land by right of Dower, or the proceeeds thereof absolute, she being 40 years of age and her dower interest in said lands is .8067 in one third thereof; and that the remainder of said lands or the proceeds therecf belongs to her as trustee for her children under the will aforesaid. Fourths That the two farms first described above are situated in Concord Township, Iredell County, are only valuable for agricultural purposes, and in it’s phesent condition is not profitsbdle for said purposes. The smal) dwelling house/ situated thereon is in a dilapidated con€ition and is not fit for habitation. That the land itself has been tenanted for several years, much of it being in hills, gulleys and swamp meadows, and for this reason would require a considerable expenditure of money in order to rent it to the advantage of the owners aforesaid, and it is not of a profit: bearing character; and that it would de to their advantage to sell the same at a price commensurate with it’s value and reinvest the funds in interest bearing securities, which would yield far more revenue to the parties in interest than to continue the rental thereof. Piftths That the one-half interest in the lot in the City of Statesville produces no revenue, as it is a vacant lot and lies in a negro séttlement, and it would be advantageous to the parties in interest to sell the same and reinvest the funds in more préfitable securities. c Sixth: That a greater price could de obtained for the aforesaid lands by a private sale than by @ pudlic sale. Seventh: That the petitioners!) Phomas K. Gaither, Katherine B. Gaither and Wilfred Turner Gaither are infants under twenty- one years of age and appear in this action by their trustee Kittie K, Gaither, under the will of said E.G-Gaither, hereto- fore set forth. Gaither, Katherine EB. Gaither, and Wilfred Turner Gaither, and being heards AND IT APPEARING to the satisfaction of the Court that a sale of said lands would be more advantageous to the parties interested therein, than a renting of the same from year to year. That the rental is inadequate, that the same cannot be rented to an advantage by reason of the dilap- idated tenant house thereon, the marshy condition of the QO & > o g o n S © meadows, the impoverished condition of the soil, the wasteing of the hillsides and the rundown condition generally. That 97 6 1 the lot situated in the City of Statesville is in a negro settlement, and no fevenue is received therefrom, and that it is not likely to increase in value. That the monies arising from thecsale thereof securely invested, would yield a greater income, than the rental from said lands, or the anhanced value thereof by holding the same. THEREFORE If IS CONSIDERED ORDERED AND ADJUDGED, taat said lands be sold, subject to the confirmation of the Court, and that the funds arising therefrom due the trustee of said children be reinvested by said Trustee to their best advantage; AND If IS FURTHER considered and ordered that Kittie K. Fifth: That the interest of the petitioners in said land is a dower interest of Kittie K.Gaither, in one-third thereof, and a half interest each in the remainder to Thomas K. Gaither and Katherine E. Gaither. Siath: That the lot of land described aforesaid, is a vacant let in the City of Statesville, and that no revenue is derived therefrom, and is cheifly valuable, by reason of its location, which is subject to State, County, and Municipal taxation, and that the interest on the monies dervided from the sale thereof, will be more valuabbe by way of an income, to the petitioners, than any future increased value thereof. Seventh: That a greater price could de obtained, for the afore- said land by private sale than by public sale. Eighth: That Thomas K. Gaither and Katherine E. Gaither, are infant under twenty-one years of age, and appear in this action by their Trustee, Kittie K. Gaither, under the will od the said E. G. Gaither, heretofore set forth. That by reason of the sale of her home and having to move at least twice since she has qualified as Executrix of this estate and through packing and unpacking, all of her records of receipts and dis- bursements have been lost, misplaced or destroyed and she does not now have any records to make an itemized account to this Court. 2nd. That she has paid from the assets of the estate every account known to her as being due by the estate, or that was presented to her for payment and that there is nothing now due by the estate to any one, including Inheritance Taxes, except a legacy to L.
