We also find, upon examination, that the number of the family of the said widow, under fifteen years of age, exclusive of herself, is...Qn@...CAiL14 There being a deficiency of the articles on hand to make up the year’s support, we assess such deficiency at Five. bundred.and. twenty...and.u0/10Q. Dollars, to be paid by the personal representative. This NOTE. The widow is entitled to $500 out of the crop, stock and provisions of the deceased, and $150 additional for each member of the family under fifteen years old, as her year’s support. The commissioners shall make and sign three liste of articles assigned, stating the value of each, the number of the family, and deficiency to be paid by the personal represent- ative. One of these lists shall be delivered to the widow, one to the personal representative, and one returned by the Jus- tice, within twenty days after the assignment, to the Clerk of the Superior Court of the county, who shall file and record the same, and enter judgment against the personal representative, to be paid when the assets shall come into his hands, for any residue found in favor of the widow. In case there be no stock, crop or provisions on hand, the year’s support may be allotted by commissioners from the personal property of the deceased and also any debt known to be due him, and said allotment shall vest the said property in the widow and her right to collect said debt. Gaither acquired in and to said land by reason of said deed, such interest being either a fee simple absolute interest by survivorship upon the death of said Willian / Gaither or a dower interest at such time, and in the letter case the interest of said William C. Gaither, junior, and Columbie G. Wilkins would of course be that of tenants in common or one-half undivided interests subject to the dower of said Elizabeth B. Gaither. 5e That petitioners have received an offer from L. G. Craver and wife Florence Bell Craver of Iredell County for the purchase of said land and premises for the sum of $600.00 which offer petitioners feel is fair and reasonable and have therefore accepted. Wherefore petitioners pray thet they be authorized to execute and deliver to said L. G. Craver and wife their deed conveying said lend and premises to seid L. G. Craver and wife upon the psyment by them to petitioners of said sum of $600.00, the portion of the proceeds of such sale, if any, belonging to said William C. Watt each a citizen, free holder and resident of Iredell County, North Carolina and each for himself after being duly sworn deposes and says: That he is well acquainted with the lands described in the petition for this cause and bounded and described as follows, to-wit: Beginning at a stake at the intersection of Tomlinson Avenue and York Street and running thence South 232 feet to a atake; thence east with an alley 240 feet to a stake; thence north 252 feet to a stake on Tomlinson Avenue; thence west with Tomlin- son Avenue 240 feet to the beginning; the aforedescribed boundary being Lots 25, 26, 27 and 28 of Block 3 of the J.A.F. Gaither is dead without leaving a last will and testament and that Elizabeth B. Gaither, Columbia Wilkins, William C. Gaither, junior, are the only heirs-at-law of wc? Gaither and that the interest of the parties are as follows: Elizabeth B. Gaither,a one-third interest for life, Columbia G. Wilkins a one-half interest, subject to the dower of Mrs. Elizabeth B. Gaither and W.C. Gaither, junior, a one-half interest, subject to the dower of Elizabeth B. Gaither. And it further appearing from the affidavit of J.A.F. Tom- linson, C.S. Albea and C.D. Watt that $600.00 is a fair and reasonable price for said lands described in petition. It further appearing to the court that L.G. Craver has made a bonified offer to purchase said lands in petition for the sum of $600.00 provided that same can be purchased at private sale, paying what he can get through the Home Building and Loan Asso- ciation as purchase price and the remainder be secured by a sec- ond mortgage on said property, and it further appearing from the opinion from the petition in this cause and from the affidavit of three disinterested citizens who know the value of said lands described in the petition and that the price is a fair and reason- able one for said lands. It is therefore ordered adjudged and decreed by the court that Elizabeth B. Gaither, General Guardian of W.C. Gaither, junior, join with the other heirs to make and execute a deed to the pur- purchasers , conveying said land to L.G. Craver and wife in fee simple upon the condition above set out and the court further orders and directs the petitioners to pay the cost of this action and the remainder go to the pétitioners as their interest may appear after payment of one-third of one-half of the judgments of Ramsey- Bowles vs W.C. Gaither and Alexander Brothers vs W.C. Gaither.
