Before the Clerk In the Matter of the Adminis- tration of the Estate of N, Sankey Gaither, Sr., deceased. TO C. G. SMITH, CLERK OF THE SUPERIOR COURT OF IREDELL COUNTY, NORTH CAROLINA: NOW COMES N, Sankey Gaither, Jr., Administrator of the Estate of N. Sankey Gaither, Sr., and after being duly sworn, shows to the Court: z That N, Sankey Gaither, Sr., died intestate in Iredell County, North Carolina on the 6th day of April, 1952, leaving as his only heirs at law the following: Mrs. N. Sankey Gaither, Sr., his widow, N,. Sankey Gaither, Jr., a son, Ferbey Glenn Gaither, a son, and Kathleen E, Gaither, a daughter; that all of the aforesaid heirs were over twenty-one years of age at the time of the death of N. Sankey Gaither, Sr. II That N, Sankey Gaither, Jr., was appointed Administrator of the Estate of N. Sankey Gaither, Sr., by the Clerk of the Superior Court of Iredell County on April 22, 1952, and immediately gave the bond required by law and entered up- on the discharge of his duties in the administration of the estate. III That at the time of his death and for a number of years prior thereto, N, Sankey Gaither, Sr., had been engaged in the buying and selling of fertilizers and allied products and in the construction and building of houses, and in the buying and selling of building supplies and materials and other merchandise of similar nature; that N, Sankey Gaither, Sr., conducted and operated the aforesaid business under the trade name of Harmony Milling Company; that at the time of the death of N, Sankey Gaither, Sr., there were a number of houses and buildings under construction, and there was in the business an inventory consisting of lumber, building materials, etc., amounting to $18,107.99; that accounts receivable and due the Harmony Milling Company at the time of the death of N, Sankey Gaither, Sr, amounted to $27,015.75; that notes receivable and due the Harmony Milling Company at the time of the death of N, Sankey Gaither, Sr., amounted to $4,128.12, IV That by agreement of all of the heirs of N. Sankey Gaither, Sr., the Administrator continued the business activities which had been carried on by Ne Sankey Gaither, Sr., and in so doing, completed the construction of the houses which were under contract and continued to engage in the buying and selling of fertilizers, the construction of houses and buildings, and the buying and selling of building materials, supplies and allied products, and the same were carried on and continued in the estate of N, Sankey Gaither, Sr., by and with the full and complete agreement and approval of all of the heirs. V That this report covers, includes and shows the sales and shows the receipts from the business activities and the collection made on notes and accounts receivable through December 31, 1953; that this report also covers, includes and shows under disbursements the payment for lumber, building materials, fertilizers, etc., purchased in the operation and conducting of the business after the death of N, Sankey Gaither, Sr., and the payment of the notes and accounts which were payable at the time of the death of N. Sankey Gaither, Sr., on April 6, 1952. VI That the following is a full, complete and correct statement of the transactions had by the Administrator in carrying on the business activities and in administering on the estate of N. Sankey Gaither, Sr., or the Harmony Milling Company which he operated, on April 6, 1952, have been paid in full and are included in the amount shown under Item 27 of disburse- ments. xX That all of the notes which were owing at the time of the death of N. Sankey Gaither, Sr., were paid by the Administrator and are shown under Item 28 of disbursements except a balance of $800.00 on the note to Key Albea, and since December 31, 1953, the heirs of N. Sankey Gaither, Sr., have assumed the payment of this balance and the liability of the estate in said matter has been fully discharged. XI That all of the bills, accounts and notes which were incurred by the Administrator or the estate in carrying on the business activities from April 6, 1952, until December 31, 1953, were paid in full by the Administrator except an account to Barger Millworks, in the sum of $584.08, and an account to Pleas= ants Hardware Company, in the sum of $1,241.55, and an account to Blanton & Moore, in the sum of $142.44, and these accounts have now been fully paid and discharged by the heirs of N, Sankey Gaither, Sr.; and a note to Virginia-Carolina Chemical Company, dated September 1, 1953, in the sum of $1,500.00, and this note has been by agreement with Virginia-Carolina Chemical Company, assumed by the heirs of N. Sankey Gaither, Sr., and the estate of N. Sankey Gaither, Sr., has been fully discharged from any liability thereon. XII That the Administrator filed an inheritance tax return with the North Carolina Department of Revenue, and all inheritance tax due by the estate has been paid. XIII That the Administrator also filed an estate tax return with the Treasury Department of the United States, but there was no estate tax due in this estate to the Treasury Department of the United States. XIV That the Administrator filed income tax returns with the North Caro=- lina Department of Revenue, and the Director of Internal Revenue for the years -9= 1951, 1952 and 1953; that the Administrator paid all income taxes due for the years 1951 and 1952 prior to December 31, 1953; that the income taxes for the year 1953 to the North Carolina Department of Revenue and the Director of In- ternal Revenue have been fully paid since December 31, 1953, by the heirs of N, Sankey Gaither, Sr., deceased, XV That on December 31, 1953, the Administrator ceased to operate the busi- ness of Harmony Milling Company which he had been carrying on and conducting in the estate, and since that time has had no income in the estate; that on December 31, 1953, the inventory consisted of lumber, building materials, supplies and fertilizers and was in the amount of $10,476.09; that at the close of the busi- ness on December 31, 1953, there were certain notes and accounts receivable and due and owing to the Harmony Milling Company, some of them being unpaid from those which were due and owing on April 6, 1952, and some of them being notes and accounts which had come into existence during the operation of the business by the Administrator between April 6, 1952 and December 31, 1953. XVI That as of the close of business on December 31, 1953 and the commencing of business on the day of January 1, 1954, the Administrator transferred, assigned and delivered unto the heirs of N, Sankey Gaither, Sr., to-wit: Mrs. N. Sankey Gaither, Sr., N. Sankey Gaither, Jr., Kathleen E, Gaither and Ferbey Glenn Gaither, the following personal property, to-wit: 1. Nine shares of stock in the Merchants and Farmers Bank of States- ville, North Carolina. 2. All of the notes and accounts receivable, including those which were in existence on April 6, 1952, and which had not been collected, and those which came into existence between April 6, 1952, and December 31, 1953. 3- All of the inventory of lumber, building materials, supplies, fertilizers and other merchandise as of the close of business on December 31, 1953. 4. All of the motor vehicles. 5. All of the machinery and plant equipment owned and used in carry- ing on the business, 6. All other personal property not hereinbefore set forth in this report as being distributed or turned over to the heirs. Srd. That the vetitioners, A. M. Gaither, J. B. Gaither, Alma Slam and Clyde Gaither, are tenants in common and in possession of all of said lands. 4th. That the said N. Spurgeon Gaither left surviving him as his heirs and beneficiaries under his last Will and Testament the following named, to-wit: his widow, Mrs. Maude S. Gaither, a daughter, lirs. Alma Elam, two sons, A. M. Gaither and J. B. Gaither and one grandson, Clyde Gaither, heir of a deceased son, & L. Gaither, 5th. That the personal proverty of the estate of N. Spurgeon Gaither is more than sufficient to pay all the debts and charges of administration of said estate without using any of the land, 6th. That after the death of the said NX. Spurgeon Gaither, his widow, Mrs, Maude S. Gaither, in apt time as provided by law, filed a dissent to his said lest Will and Testament herein- above referred to and thereby became seized of an estate of dower in all of the lands of the said N. Spurgeon Gaither hereinabove described, 7th, That under the terms of said will, it was orovided that all of the deceased's lands should be rented out for a period of twenty years and after the payment of all taxes, up-keep of the buildings, etc., the net return from the rental of said property should be annually divided between the wife, “ps, Maude Ss. Gaither, and the children, but no disposition was made of the fee simple thereafter anda no residuary clause was included in said will, under which the fee in said lands would pass. That by reason of the complications and ambiguities appearing in said will and by reason of the fact thet the vetitioners feel that the income from the rental of said proverty would amount to ver; little, if anything, in excess of the taxes, repairs, insurance and up-keep over a veriod of twenty years, it has been agreed that it is to the best interests of all parties owning an interest therein to divide taid lands, and it has been so agreed that the same shall be divided and 1/4 part thereof in value allotted to A.\.Gaither 1/4 thereof in value to J. Be Gaither 1/4 thereof in value to Mrs. Alma len 1/4 thereof in value to Clyde Gaither, in fee simple, to be immediately tested in said Clyde saither, vrovided and on condition, in the event he dies prior to his 2lst birthday, the share allotted to him Shall, on his death prior to 21 years of aze, divest and then revert to A, I, Gaither, J. B. Gaither and Alna Elam, or their heirs, ver stirpes. 9th. That it is to the best interests of the minor petitioner, Clyde Gaither, that the dower interest of irs, Maude S.
