Fea That the Executor aforesaid has made a division of the stock held by said testatrix in the Hall Kale lfg., Co., among the heirs and children of the said testatrix, and has retained a sufficient amount of said stock and other effects of the estate to discharge all obligations against said estate, including the 500.00 legacy to Beulah Gaither aforesaid. af« That in compliance with the authority and power given P.b.Gaither, Executor to sell and convey to the purchaser the lands aforesaia, he has made every effort possible to sell the same, but has teen unable to find a purchaser who was willing to buy said lands at a price acceptable to said Executor, or the heirs at law who are interested in said lands. That by reason of the general Gevression of the country, resulting in depression of real estate values and especially farming lands, cof which the lands described aforesaid consist of, there is no market nor has there been any demand for the purchase of land or lands, consequently he has been unable to sell and disvose of the lands hereintvefore described as provided in the will of M.E.Gaitner aforesaid. aQu That the interest of the petitioners and the defendants in said lands are as follows, to-wits F.B.Gaither, 1/7 thereof.
