I direct that my body shall be buried by the side of the grave of my husband, J. A. Gaither, in our family plat in Piney Grove Cemetery located in Turnersburg Township, Iredell County, North Carolina. 2. After the payment of my just debts, including my funeral expenses, I bequeath and devise as follows: I devise to my daughter, Glensa Gaither, my home place consisting of 13 acres, more or less, located in Turnersburg Township, Iredell County, near Clarksbury Church, to be hers during the term of her natural life and at her death, then to my children living at the time of her death, as tenants in common, the issues of any deceased child including the children of Glenza Gaither to take its parents share. My aforesaid children are: Arthur Gaither, Luther Gaither, David Gaither, Bertha Gaither Campbell, Glenza Gaither, Alton Gaither and Cleo Gaither Van Eaton. 3. I bequeath to my daghter, Glenza Gaither, the use and enjoyment during her life the household and kitchen furniture and utensils including silver, books, pictures, and all other personal property, of which I shall die possessed; and after her death, I bequeath the same to my children living at her death to be divided among them as nearly as may be equal shares. Gaither died without a Will, personal property in his | estate passed to the Widow, Elizabeth W. Gaither and the two sons, Charles L. | Gaither, Jr. and Ray Kennedy Gaither, with each of them being entitled to one- | third thereof. However, by a written instrument which is hereto attached and made a | part hereof, the two sons, Charles L. Gaither, Jr. and Ray Kennedy Gaither have transferred and conveyed all of their right, title, interest, and estate in all of the personal property in the Estate of Charles L. Gaither, to their mother, Elizabeth W. That all debts and claims which were filed with the Administratrix, or of which she had any knowledge, have been paid in full, except an unpaid balance of $10,927.55 on one of the Deeds of Trust which was outstanding to the \Federal Land Bank of Columbia; that this Deed of Trust is on the homeplace, which was owned as an Estate by the Intirety, and is now owned by the Widow, Elizabeth W. Gaither, in fee simple; that the land conveyed by this Deed of Trust is worth at least $27,000.00, and further, the said Elizabeth W. Gaither assumes payment ‘of this unpaid balance, so that there can possibly be no claim against the Estate of Charles L. Gaither. Gaither, since the date of his appointment, and he files the following as a report of said transactions up to this time; Advanced by C. E. The decedent left a house and lot in Statesville, N. C., which is probably worth between Five and Six Thousand Dollars. The other two heirs of Charles R. Gaither have made a quitclaim deed to C. EB. Gaither, Sr., and, therefore, C. E. Gaither, Sr. is the owner of the entire interest in said house and lot, subject to any outstanding debts and liabilities of the estate. For a good many years prior to his death, Charles R. Gaither was incompetent, and C. E. Gaither, Sr. was his guardian appointed by the Clerk of Superior Court of Mecklenburg County, North Carolina. Gaither, Sr., individually, has advanced the sum of Twelve Thousand Thirty-eight and 08/100 ($12,038.08) Dollars for the maintenance, assistance and support of his father, Charles R. Gaither, and that he has a claim of that amount against the estate in addition to the advancements that he has made to pay the funeral bill and other expenses since the death of Charles k. Gaither. There are two other claims for assistance to Charles RK. Gaither, and an attempt is being made to agree with these claimants in regard to the priority of said claimants and the claim of C. E. Gaither, Sr. in the amount of Twelve Thousand Thirty-eight and 08/100 ($12,038.08) Dollars. If an agreement is not reached as to the priority and the proper division to be made of any proceeds which may come from the sale of the house and lot, then an action will be com- menced to determine this priority. Gaither was declared incompetent by a jury in Mecklenburg County, North Carolina, on September 13, 1943, and a general guardian appointed or him, and such state of incompetency remained until his death, and his general guardian, C. &, Gaither, Sr., continued to act at all times, from September 13, 1943, until the death of Charles R. Gaither on March 28, 1955, After the death of Charles Rk, Gaither, a holographic will purporting to be written and signed by Charles R. Gaither was found bearing date of July 15, Since this will was dated almost two years after Charles R. Gaither had eclared incompetent, a petition, with said wil] attached, was filed with G. Smith, Clerk of Superior Court of Iredell County, setting forth the facts, and on April 27, 1955, C. G. Smith entered an Order finding that Charles R, Gaither died intestate, and finding that said paper writing had been executed i. Gaither had been declared incompetent, and that said paper writing could not be probated as the last will and testament of Charles R. Gaither, Thereupon, upon petition and application duly made, C. E. Gaither, Sr. was appointed Administrator of Charles R. Gaither, Intestate. During the life of Charles R. Gaither, C. E. Gaither, Sr, provided maintenance, support and other necessary things for him, and when he filed his Final Settlement as Guardian, he showed therein that the estate was owing to him in the sum of $12,038.08. 2. The only property left by Charles R. Gaither, his wife having predeceased him, was the house and lot on Maple Avenue, in the City of States- ville, N. C., and extending through to Feimster Street. © a B. = @ ae Q ee & mee ° n ~ Ss 6 l 3, That Charles R. Gaither left surviving him, as his only heirs, a son, C. E. Gaither, Sr., and the heirs of a deceased son, Halph G. Gaither, to- wit: Mrs. Florence B. Gaither, his widow, and Carolyn G. Blockston, a daughter, and Lois G. Scoville, a daughter. That C. E. Gaither, Sr. owned a one-half undivided interest in the above described real estate, and the heirs of Ralph G, Gaither, a one-half un- divided interest, all subject to the debts and claims in the estate. That the heirs of Ralph G. Gaither executed a deed conveying their one-half undivided interest in the aforesaid real estate to C. E. Gaither, Sr. That the Southern end of the lot, containing the house and fronting on Maple Avenue, was sold and conveyed to Allie Frank Hartness and wife, and C. E. Gaither still owns a lot off the Northern end of said lot fronting on Feimster Street, which is a vacant lot. i. That the proceeds of the sale from the property have been applied to the claim of C. E. Gaither, Sr., and the other debts and cost of administration in the estate, but there still remains unpaid on the claim of C. E. Gaither, Sr. $6,200.78; however, since C. E. Gaither, Sr. owns all of the property which was owned by Charles R. Gaither, and there is nothing further out of wiich he could receive payment, he does not make any claim for the balance due him, and makes charge for commissions as Administrator. 5, Notice to Creditors was duly published in the Statesville Record once 2 week for six consecutive weeks, commencing with the issue or May 14, 1955. That an inheritance tax report was filed with the North Carolina partment of Revenue, but there was no tax due. That all debts and claims which were filed with the Administrator, or of which he had any knowledge, have been paid in full, except the balance due C. E. Gaither, Sr. on his claim as hereinabove set forth. WHEREFORE, having fully administered on the Estate of Charles R. Gaither, the undersigned Administrator prays that this report be accepted as his final settlement, and that the same be examined, audited, and approved, and ordered re- corded, and that he be discharged as by law provided.
