The defendant answering,the complaint says: lst.That the alleyations as set forth in the first paragraph of the complaint are denied,and the facts in regard to the transaction will be set forth hereafter in this answer. 2nd.That as to the allegations of the second par- agraph of the complaint this defendant has no sufficient know- ledge or information to form a belief and he demands proof of the same and for tne reasons hereinafter set forth. 3rd‘,The defendant admits that ne nas not paid anyting on certain notes executed to SGoocn as nereafter ex- plained,but he denies that there is anything for which he is legally due the plaintiff or any one else on account of said notes and for the reasons hereinafter set forth. Yor a further defense the defendant by way of new matter alleses: Leu.That about the 4th day of December 1895 one W.J.Gooch obtained two notes from this defendant,each for the sum of $144.and procured the signature of this defendant to said notes by false representations and by fraud,and with- out consideration,and before the maturity of said notes,as this defendant is informed and believes the said Gooch left the town of Statesville where he was carrving on his,business 'and departed from the State of North Carolina and has remained out of the State,as this defendant is informed and believes, \ (2) to avoid arrest and punishment for his fraudulent practices upon this defendant and other citizens of Iredell County. 2nd.That the notes which the said Gooch procured from this defendant as afores id,were not witnessed by any one at their execution,and there were no persons present at their execution except tne said Sooch and this defendant;and if the said notes sued on have added to them the words set out in the complaint,“Ed Wheeler witness",as alleged in the first paragraph of the complaint,then the notes sued on are either not the notes signed by this defendant,or tne said notes have been changed since their execution without the know- ledge or consent of this defendant in this regard;and he pleads the alteration and change o?the notes sued on in bar of recovery and demands profert of the notes at the trial of the cause. ord.The defendant further alleges that a month or so after said Gooch nad departed from the State as aforesaid, that he obtained information that the plaintiff who is a mer- chant in Statesville,was claiming,to have become the purchaser of the said notes obtained from the defendant as aforesaid,and 'probably of other farmers notes in the County,and defendant had several interviews with plaintiff in regard thereto,and |plaintiff was informed by defendant tnat the notes obtained from him by said Gooch were fraudulent and the plaintiff ad- mitted to this defendant tnat said notes were fraudulent. tn.That subsequently to the interviews afore- 'gaid in which this defendant had been informed by plaintiff that he,the plaintiff,had become the purchaser of the said notes,to-wit about the lst of March 1897,the paintiff inform- ed this defendant,that he,the plaintiff,had sold the said ,notes to another person,but declinedto inform this defendant :who the said person was to whom he had sold the said notes: (3) tand this defendant avers that the said notes which he executed I to Aooch under the circumstances aforesaid,had become and were :long past due by the terms thereof before the lst of March 1897, jand if it is true that the plaintiff is now the holder and owner as he alleges (but as to the truth of waleh ‘ant has no sufficient knowledge or information upon which to ;form a belief and ne therefore demands proof)then tnis defend- ant alleges that the plaintiff is a purchaser of said notes with notice that the same were procured by fraud from tnis de- i fendant,and that the same were made without consideration; and if plaintiff now holds and is the owner of the said notes he holds tham subject to the same equities which this defendant has against W.J.Gooch the fraudulent payee thereof,as he is advised and believes.
