That on or about the fourth day of July, 1898 ,at Statesville, N.C.,the plaintiff and defendant were married and lived together as man and wife until the defendant abandoned the plaintiff in march, I908. That during the year of 1907,the defendant without any er ik reason whatever,and without any fault on the part of the plaintiff,began to neglect,mistreat and to most cruklly abuse the plaintiff,and so continued to neglect ,mistreat and cruelly abuse the plaintiff until during sail year of 1907,the said defend- and,totally disregarding the soleminity of the marriage vow will- fully and without cause took up with and lived in Fornication and adultry with one Emlie NZenderson,& colored woman who then lived in the City of Statesville,which relation continued to exhist,conss- antly and habatually for a peroid of about twelve months, until the the said defendant entirely desirted and abandonedthe plaintiff, leaving her without any means of support whatever and has ever since and still continues to so leave the defendant without any help or support whatever from him’ ,but at that time left the defendant in Statesville ,N.C.and fleed to the State of N.Y,and there took up with another woman bythe name of Ella Thomptson with whom the said defendant also committed fornication and adultry, by constantly, habatually living with and bedding with gaid Ella Thomptson as man and wife which conduéh and relation between said defendant and the said Ella Thomptson continued to exhist until their shameful,notorious and unlawful conduct was broken up by the ineerference of legal authority. Third: That the plaintiff has not received the defendant in cun- gugal embracess since her knowledge of his conduct and since he abandoned her as above stated. Fourth. That the plaintiff has been a boni fide resident of the State of North Carolina for more than two years next preceeding the commencement of this action. Pifth. That the plaintiff for severe] weeks importuned, and diligently and earnestly besought the defendant for & recenciliation, but a2 was in vain, and the defendant persisted in her refusal to recog- nize the plaintiff as her husband and to allow him te live with her in the home; that the plaintiff contimed his efforts to bring about a reconciliation, and during this time he lived in a house on the premises near to the matrimonial residence, but not under the same roof with the defendant; that he remined in this out- house alone for several weeks, 811 the time making an honest effort to get the defendant to live with him as bie wife; that finally, his condition became so intolerable and his life so burdensome, because of his wife's open and persistent repudiation of him, and her separation from and abandonment of him, and because of the in- convenience and discomfort of living slene in said outhouse on the premises, as aforesaid, that he went over to ancther place about a mile away from the matrimonial heme, but on the plaintiff's land, in the month of December 1899, where he has since lived with his son and his wife; that the defendant has been all the while and still is living in the matrimonial residence of the plaintiff and defendant, which is located on a tract of land containing about 200 acres, which is the property of the pleintiff; that the youngest children of the marriage live at said place with the defendant, and cultivate said farm; that the defendant has been and is now well provided for; that the refussl of the defend- ant to live with the plaintiff and te bed and cohabit with hin, and her repudiation of him as her husband before and at the time he went to live with his son in the month of Decgmber 1899, was wilful on her part, and without cause or provocation on the part of the plaintiff; that the defendant has thus wilfully and without cause abandoned the husband and lived separate and apart from him for two years, and more, to-wit: since December 1899, Third:~ That the plaintiff has been # poma fide resident of the State of North Carolina for five years next preceding the com mencement of this action, Pourth:~ That the issue of said marriage are ten children, as follows: Nancy Foster, wife of Wm. Vs Complhint. Mam&e Belk Young, defendant. The plaintif’ complains and says; First. Theat he and the defendant married about ten years ago and lived together as husband and wife for about four years, when the defendant separated herself from the plaintiff and has not since said time lived with him. Second. That since the separation and abandonment aforesaid the defen- dant has committed fornication and adultery with various persons Pranic Long - ; and especially with one Will Howard and another named Harrison. Third. That plaintiff has been a citizen and resident of Statesville North Carolina for many years; thet the facts herein alleged have existed and been known to the plaintiff for more than six - months prior to the filing of this complaint. Wherefore the plaintif< prays that the bonds of matrimony existing between himself and the defendant be dissolved and that he have such other and further releif as he may be entitled to. John Young being duly sworn says: That the facts set forth in the foregoing complaint as grounds fa divorce are true to the best of his knowledge and beleif and the complaint is not made out of levity or by collusion between himself anf the defendant and not for the mere purpose of being freed and separated from each other but in sincerity and truth for the causes mentioned in the complaint.
