Sally Masamore, -VS- i COMPLAINT, William Masamore The plaintiff above waned soapuaiing of the defendant for cause of action,alleges and says ; First. That the plaintiff and defendant intermarried on or about the 22nd day of November,1901 in Alexarder Courty, North Carolina,and ever since have been and now are husband and wife . Second. That the plaintiff is now and has been for a period of more than two years next preceeding the commencement of this action a bona fide resident of the State of North Cerolina. Third . That from the time of their marriage ,defendant neglected,abused and cruelly treated plaintiff and continued so to do until the day 1906 when defendant abandored plaintiff and the children begotten of their marriage, left their home and took up his residence in Mecklenburg County, where,on or about the 25th day of July,1914 defendant,not then or row having been lawfully separated from plaintiff,in total disregard of the solemnity of the marriage vows then existing between them,urlawfully ard feloriubly ertered into a spurious marriage cortract with ore lirs. Nola Townsend of Mecklerburg County,said Bola Townsend being at that time a married woman with an urdivorced husband living; that defendant continued to live in the unlawful state of fornication and adultery with said Nola Townsend,under color of said spurkous marriage contract by him entered into with her,until the August Term of Mecklenburg Superior Court,when and where defendant was convicted of the crime of bigamy and sentenced to a term of imprisenment on the chain gang of Mecklerburg County. | Fourth. That. each and all of said acts of adultery were commited without the consent,connivance,privity or procurement WeIT]IM ‘o1oueseypy ‘SA Ayjeg. ‘oloureseyy of plaintiff and that Plaintiff has not voluntarily cohabited S16! with defendant: since the discovery by her of the commission by the defendant of the several acts of adultery herein complained of; and that the defendant has not contributed in any way to the support of plaintiff and her children since the ___ day 1906 when defendant abandoned them as above alleged. Pifth . That there were born of the marviane ef plaintiff and defendant three children,viz; Ethel and Bethel,twin girls now of the age of 12 years; one son,named Harold now seven years oad. WHEREFORE plaintiff prays judgement against defendant; First . That the bonds of matrimony now existing between the plaintiff and defendant be severed and that she be given an absolute divorce from the deferdant: Second. That she be awarded the custody of her three childrer,begotten of the marriage of the plairtiff and deferdant and for such other and further relief as may be just and proper.
