SRSA SRE REESE The plaintiff complaining ef the defendant alleges : First: That the plaintiff and the defendant were married on or about the 28th of February, 1903, in said Coun- ty and State and since that time have been, and now are husband and wife. Second: That on or about the /§“day of *<7—-@~ 1909, the defendant disregarding the solemnity of the mar- riage vow, wilfully and without cause deserted and abandoned the plaintiff and has since then and still continues so to wilfully and without cause desert and abandon the said plain- tiff and to live separate and apart from him, without suff- icient cause or reason. Third: That after the defendant wilfully and with- out cause deserted the plaintiff, as above stated, the defendant left the City of Statesville in company with one Joe Moore and thereafter lived in adultry with the said Joe Moore or another person unknown to the plaintiff. Fourth: That since the defendant has abandoned the plaintiff she has given birth to a child begotten by one Joe Moore or others unknown to the plaintiff. Fifth: That the plaintiff has not received the def- endant in conjugal embraces since she abandoned hin. Krider, i a The plaintiff complains and says: --First-- That she and the defendant intermarried on the 6th day of August ,1896 in Rowan County, State of North Carolina; that there was born to herself and the defendant as her husband, 4 child now about six years old in the possession and under the control of the plaintiff. --Second-- That on the 10th day of pebruary, 1901, the defendant, W. BE. Tnat on </ day of December, Ja.shbae tn Cabarrus County, in the State of North Curolina, the plaintiff and defefdant intermarried and ever since have been and now are husband and wife. Second. “hat the plaintiff is and has been a resident of the State of North Carolina for the period of two years immediately preceed- ing the commencement of this action. Third. That on the 16th day of October, 1904, about “years after their marriage, the defendant, Mary Lytle, abandoned the plaintirr and has ever since lived separate and apart from him and that since that date the plaintiff and defendant have not lived together, and have not cohabited as husband and wife, That since the date of the abandonment of the plaintiff by the said defendant, Mary Lytle, she committed adultery with other men, and is now living in adultery with other men, Fourth. That said acXts of adultery were committed without the consent, connivance or procurement of the plaintiff, and that the plaintiff has not lived with or voluntarily cohabited with the defendant since the 16th day of December, 1904, the date off the abandonment of the plaintirr by said defednant, and since the discovery by the plaintirr of the said aces of adultery by the defednant.
