Second--- That after the marriage aforesaid they lived to- gether until the treatment and conduct of the defendant in failing to provide for her and his inhuman treatment of her and the request by the defendant that she leave, caused the plaintiff to leave his house: That defendant seperated himself from this plaintiff at long intervals and as she is in- formed and beleives lived in adultery with one to this plaintiff unknown. Third--- That more than three years have elapsed since this plaintiff was compelad#, because of the tr atment and abandon- ment by the defendant to labor for herself, provide a living and take care of herself, and ever since said abandonment by the defendant, plaintiff has been compelled to live apart from the defendant. August term 1918. Sallie Johnson vs. COMPLAINT. Ralph Johnson. The plaintiff complains and alleges for her cause of action agais the defendant as follows; FIRST. That the plaintiff and defendant were inter- married in Iredell county,North Carolina on or about the 2ist. day of October 1903 and that they lived together as man and wife until about the year of 1508; that there was born to said marriage two chldren, viz; Margie Johnson who is 14 yeare of age and Nell Johnson who is 12 years of age and who are now residing and being cared for by this plaintiff. SECOND That some time during the year of 1908 the said Rapph Johnson abandoned thie plaintiff and their children without any cause or reason whatsoever on the part of this plaintiff and has not lived her, nor sup- ported his family since. That in the year (J—— » the plaintiff intermarried with the defendant Henry Kilpatrick according to law,and thence forward from that time until now the marriage relation has existed between the said parties. 2. That during the year 1908 the said Henry Milpatfrick did live in fornication and adultry with one Julia Adams, 5. That the said Lettie Kilpatrick has not lived with the said defendant nor cohabited with him since the said act of living in adultry as aforesaid was committed nor has the plaintiff in any ‘way condoned the offense, Wherefore the plaintiff makes application to the court for an order granting an absolute divorce from the said defendant and dissolving the bonds of ‘matrimony for the causes above set out and that the cost of this action be taxed by the clerk of this court, ~ .
