Fifth: That the Company has been at great expense in operating ints business by store rent, clerk hire, taxes, insurance, interest on borrowed money and deferred obligations for purchase of merchandise, more than its capital and volume of business would justify: that during the life of its business existence and eareer it has not been successful, nor its business profitable, but on the contrary, its capital has diminished and its obligations increased; that its credit is so impaired that at present it is unable to borrow money from banks or other sources on its own credit to enable it to carry on ite business. Sixth: That the assets of the Company consist of a stock of merchandise, furnishings, groceries, and other articles of merchandise incident to its business, store accounts, office fixtures etc. of the norinal value of about Four Thousand two hundred Dollars, while its liabilities will aggregate approximately Three Thousand Dollars; that owing to ite present financial condition, its business operations will have to be suspended, as the iefendant Company is in imminent danger of insolvency, and to continue to operate its tusiness would be unjust to ite creditors, and entail further loss to its stockholders; that at this time its creditors are bringing suit and threatening to bring suit against the defendant Company for the collection of amounts due them, which the defendant Company is unable to pay, and that to do so would work a hardship and injustice to the rerainder of its creditors. Brown & Cleveland Manufacturing Company. This cause coming on to be heard at this term of the Court before His Honor B. F. Long Judge, and it appear- ing to the Court that the summons in this action was duly issued, and served on the defendants, and that the complaint was duly filed at January Term, 1916, and that the plaintiff's cause of action was founded on a contract for a sum certain, and the complaint duly verified, and the defendant, James W. Brown having failed to answer said complaint: It is therefore considered, ordered and adjudged that the plaintiff have judgment against the defendant James W- Brown by default for want of an answer. It is therefore considered, ordered and adjudged that W. D. Turner, Receiver of the Merchants & Farmers Bank of Cleveland, North Carolina, recover of the defendant, James W. Brown the sum of $2,538.75, with interest on $2,250. from the 22nd day of May, 1916, until paid, and cost of action.
