Clegg, administrator of Henry Fullenwilder, respectfully showeth: That he was appointed administrator ofsaid intestate hy the Superior Court of Iredell County on the 28th day of August, 1903, and has entered upon the administration of said estate: Your netitioner further showeth: First: That from the hest information and knowledge which he has been able to obtain the Outstanding debts of said estate amount to about $30.00; Seconda: That there is no personal property belonging to the estate of said intestate; Third: That at the time of his death said intestate was seized in fee simple of the following lands, lying in Statesville Township, Iredell County, near the Taylorsville road, adjoining the lands ot acs. F. Ander- son and others; Peginning at a stake in a -<.<<4 F. That the petitioners are tenants in common and seized in fee simple and are in possession of a certain tract or lot of land lying and being in Statesville Township, Iredell Younty, North Carolina, and described as follows, to-wit: Beginning at the N. ©. corner of lot No. 39 on Allison Street thence with said street E. 140 feet to a stske; thence S. 200 feet to a stake; thence West 140 feet to a stake; thence N. 200 feet to the beginning, and known as Lot No. 34. For further information see Deed Book 19 page 76 as recorded in Register of Deeds office of Iredell County, North Carolina, also see Deed Book 26, page 240 as recorded in office of Kegister of Deeds of Iredell County, North Carolina. Fulp, deceased has no interest in the above described lands, but her children own one-sixth undivided interest in the above described lands as set out above; that the wives and husbands of the above named owners, who are married, are made parties to this action but do not own any interest in the above described lands. 5. That the petitioners desire to hold their interests in said lands in severalty, and that an actual division of the lands themselves cannot be made on account of the several divisions that would be necessary, but that a sale would be more advantageous to all parties than an actual division. 6. That Clayton Barker has signified his willingness and has offered to buy said lands at the price of $1200.00 in cash. 7. That the petitioners, and each of them, think that the price offered is a fair and reasonable offer for said lands and more than they would bring if offered at public sale, and think that it would be more advantageous and less expensive to the petitioners to sell said lands to said purchaser at private sale. 8. That the petitioners have inquired among other free-holders of the County as to the reasonable market value of said lands and find upon this investigation that the said offer is fair and reasonable and have secured affidavits from three disinterested free-holders as to the reasonable value of said land and hereto attach said affidavits marked "Exhibit A", and ask that it be taken as a part of this petition. Fulp, Beatrice Fulp Shook, Annie Fulp Gilleland, L. R. Fulp, Lucille Fulp Gilleland, Mrs. Louise Fulp Bleck, Margaret Fulp Echols, Miss Charlie Faye Fulp, Billie Fulp, minor and Fred Fulp, minor, are tenants in common of the property described in said petition, and are seized in fee simple and in possession of said land, and that the interests of said petitioners are as set out in the petition; that the property described in said petition consists of one house and lot, situated on Allison Street in the City of Statesville, Iredell County, North Carolina, and that it cannot be divided among the tenants in common, and that it would be more advantageous to all parties that the property be sold and that the proceeds derived from said sale, after paying the costs, taxes and Street Assessments, be paid to the petitioners as their interests appear. The Court further finds as a fact that the offer of Clayton Barker to purchase said land at the price of $1200.00 is a fair and reasonable market value of said property and at least as much, if not more, than said property would bring if offered at public sale. It is therefore, ordered, considered and adjudged that the tract of land described in the petition be sold for division among the tenants in common, to Clayton Barker for the sum of $1200.00, and that H. E. Lewis be and he is hereby appointed a commissioner for the purpose of making said sale, and the said commissioner is hereby authorized and fully empowered to sell said land and property to the said Clayton Barker at a private sale upon his complying with the terms of sale, and out of the proceeds of said sale, to pay off all liens, together with the costs of this proceeding, and to divide the balance remaining among the tenants in common, as their interests appear in this proceeding.
