Said Guardian says that said bond is still in full force and effect. Said Guardian further says that on the 26 day of March, 1938 he fur- nished and filed with the Probate Court of Delaware County, Ohio, an additional bond in the amount of Five Hundred Dollars ($500.) with the American Surety New York, New York Company of , as surety thereon and that said bond has been approved by the Pro- bate Court and is now in full force and effect and that a copy of said bond is attached hereto marked, "Petitioner's Exhibit B", and made a part hereof. Further said Guardian represents to the Ylerk of said Court that the combined value of the estate of both of said minors is at this time Two Thou- sand Dollars ($2,000.), that the estate of said minor, Edward Sheets Frye, con- sists of one certificate evidencing one full paid common share, No. 49, in the Fidelity Federal Savings and Loan Association, Delaware, Ohio, and that the es- tate of John Richard Frye, who is one and the same person as Richard Frye, con- sists of one certificate evidencing one fvll paid common share, No. 50, in the Fidelity Federal Savings and Loan Association, that both of said shares are of the value of One Thousand Dollars (#1,000.) each. Said Guardian further says that as evidence of his appointment he attaches hereto and makes a part hereof certified copies of his letters of Guardianship, marked, "Petitioner's Exhibit C", Said Guardian and Petitioner further says that he now has in his poss- ession receipts of said Clerk of the Superior Court of Iredell County, eviden- cing that said Clerk has received One Hundred Ten Dollars and Ninety-Nine Cents ($110.99) from Joe M. Frye, commissioner, in the sale of lands of David Alexan- der Frye and that said Clerk is holding said moneys for the use and benefit of said minor, Edward Frye. Further that he holds a receipt of said Clerk eviden- cing that said Clerk has received One Hundred Eleven Dollars and No Cents ($111.) from Joe M, Frye, commissioner, as aforesaid, that he is holding the same for the use and benefit of Richard Frye, a minor, and that said money was received from the sale of lands formerly owed by David Alexander Frye. Further said Guardian says that said minors as heirs of J.E. Frye, who was entitled to a one-eighth interest in the proceeds of the sale of said prop- erty, are now entitled to receive the respective amounts for which said Clerk has receipted the commissioner in said cause for each of said minors and as evidenced that the bonds which he as said Guardian has furnished in said estate, are sufficient for said estate to entitle him to receive said moneys, he sub- mits herewith as a part of this petition a certificate of the Probate Court of Delaware County, Ohio, to that effect. Wherefore, said Guardian prays said Clerk of the Superior Court of Ire- dell County, North Carolina, for an order releasing said moneys now in his poss- ession for the use and benefit of said minors, Richard Rrye and fdward Frye, to him, the said Harry Sheets, Guardian of said minors and that funds may be re- leased to him as such Guardian.
