Laws and wife, each gave a Deed of Trust for personal prop- erty they purchased. These Deeds of Trust have been paid and cancelled. The specific items of personal property directed in the Will to be delivered have been delivered as set forth in the Will. All debts which were filed with the Administrator or of which he had any knowledge, have been paid in full. There is no inheritance tax due in the Estate, but an inheritance tax report has been filed. Some of the debts of Mrs. Margaret Frye, who was the wife of Avery Frye, have been paid in this Estate. This was all agreeable to the heirs as they did not want a proceeding brought in her estate to sell land for assets and the same parties received the property in each estate. The commissioners shall make and sign three lists of articles assigned, stating the value of each, the number of the family, and the deficiency to be paid by the personal representative. One of these lists shall be delivered to the widow, one to the personal representative, and one returned by the Justice, within 20 days after the assignment, to the Clerk of the Superior Court of the county, who shall file and record the same, and en- ter judgment against the personal representative, to be paid when the assets shall come into his hands, for any residue found in favor of the widow. In case there be no stock, crop or provisions on hand, the year’s support may be allotted by com- missioners from the personal property of the deceased and also any debt known to be due him, and said allotment shall vest the said property in the widow and her right to collect said debt. Fry, deceased, answering the petition filed in this proceeding by A. C. Fry, sdministratrix of J, H, Fry, deceased, allege:~ Firsti- That the defendants admit that A, C. Fry was appoint- od administratrix of J, H, Pry, deceased, sometime in the year 1906; put they deny that said administratrix at once entered upon the dis- charge of the duties imposed upon her by law, or that she has dis-— charged the same, Seecond:= That as to the allegations of the First paragraph of said petition, these defendants deny the same, Third:- That as to the sllegations contained in the seco peragraph of said petition these defendants do not deny that the sum of $806.00 has come into the hands of saic administratrix from the personal estate of said intestate; but these defendants do deny that said amount is all that did come or should have come into the hands of said administratrix; and these defendants allege that a much larger amount did come or. should have come into the hands of said administratrix as assets from the personal estate of said in- testate, That as to the allegations in said paragraph as to the application of said assets, these defendants have no knowledge or information sufficient to enable them to form & belief as to the truth thereof, and therefore deny the same, And they expressly deny that said assets after the disbursement of the $300.00 to the widow of intestate as shown by said settlement and commissions on the same, were applied to the payment of debts for which said estate is lepally liable, and demand proof, Third Fourth:—- That the allegations of the EmuKXK pararraph are admitted, Fifth:— @ allegations of the Fourth paragranvh are admitted, Sixth:- That the sllegations of the Fifth paragraph are not true and the same are denied, Further answering said petition these defendants allege:- (1) That the said A, C, Pry, administratrix as aforesaid has failed to file an inventory of the personal property of said in- testate as required by law; that that which purports to be an inven— tory by said administratrix filed in this court and of record, is irregular and incomplete and is not a true and complete inventory of the personal estate of said intestate; that there is considerable personal property which came or should have come into the hands of said administratrix, not contained in said inventory nor in any in- ventory filed by her.
