Celeste Frontis, deceased. To the Honorable ©. %. Smith, Clerk of the Superior Court, Iredell County, North Carolina: Your petitioner would respectiully show: Thet at the time oi her death Mrs. M. Celeste Frontis was seized in fee of certain real estate as set out anc described in tne originel petition in this cause; and alsé at the time of her death she was indebted to various persons in sums far in excess oi the value of her personal property; that said indebtedness consisted of about 21,200.00 in delinquent taxes levied against her real estate and about 5800.00 feneral expenses and other indebtedness; that it, therefore, became necessary for the administrator to sell the reel estate to pay this indebtedness; tuat, accordingly, on the 24th day ot Mareh, 1925, the seid S. Frontis, administrator as eforesaid, tnrough his attorney, Zeb V. Turlington, filed a petition in the Superior Court of Tredell Sounty for the purpose of selling the real estate of his intestate to pay debts and for division among the heirs-at-law; thet as shown by said proceedings all the heirs-at-lav were made parties and were duly served by summons} that 6. Frontis was appointed by the Court as commissioner to sell said lands and to make and execute a deed therefor; that pursuant to the order of sele the lot of land described in the petition was duly advertised anc sold; that at said sale J. A. Craven bec:me the last and highest bidaer for the sum of Three “housand ($45,000.00) Dollars; thet in making this bid, the said J, A. Craven was representing S. Frontis, ana that the bid so made by him was made for S. Frontis; that on the 3rd day of June, 1925, the court entered a4 decree confirming tie sale; that so far as the record discloses, no deed was ever executed; — that the said S. Frontis paid the purchase price for said lot and immediately, in the year 1925, went into possession of the described lot of land and has continuously since that time been in open and notorious possession, has received the rents and profits therefrom and has paid ol] taxes and assessments levied against ssid land; ae 9 al ° Ss =. ad OQ @ oO w -_ o $ z o l that the said S. Frontis, administrator as aforesaid, made his final settlement on March 7th, 1931, showing his receipts and disbursements for the debts due by his intestate and the distribution of the surplus to the heirs-at-law, parties to this proceeding; that on July 8th, 1940, S, Frontis made and executed a last will and testament in the second paragraph of wnich he devises the lot of land described in the orginal petition as follows: "What we call the grandma lot on West McLelland Ave. between W. M. Norman's home end Mrs. H. N. Howard's, I will to the four boys Shelley, Irving, Stephen and Borel, to dispose of, proceeds of which to be used in paying otf any debt I may then have. If no debt, they may divide the proceeds among themselves."; that said will was duly admitted to probate on February loth, 1941,and recorded in ill Book ll, at page 962, records of Iredell County, North Carolina. WHEREFORE, your petitioner prays tnat tne Court re-open the said proceedings for a final hearing and disposition of th matters and things herein set out; that tee Court appoint a commissioner to convey said lot or land to Shelley Yrontis, Irving Frontis, Stephen Frontis, and 30rel ¥rontis, and for such otier and furtier relief as may in the discregion of tne Court seem just and proper. Frontis by J. A. Craven who, as snown by the record therein, was the last and highest bidder for the sum oF /3,000.00, and that the said S. Frontis paid the purchase price for the land set out and described in the original proceeding; that since the time of said sale in the year 1925, the said S. Frontis has been continuously in open ana notorious possession thereof, has received the rents and profits therefrom, and has paid taxes and assessments levied against tnis lot of land, all of which tiie Court iinds as a fact: It is, therefore, ordered and adjudged upon motion of Starr and Starr, Attorneys for tne petitioners in this supple- mentary proveeding that the original proceeding be re-opened for the causes therein set out; that A. M. Turner be, ana he is hereby, appointea a commissioner to make, execute end deliver a deed for said lot of lend to Shelley srontis, Irving Frontis, Sterhen Yrontis, and Borel Frontis, who, under the terms of the will of S.
