That W, C, Freet, late of Iredell County is dead, having died intestate on the ____day of July 1909; that the plaintiff, his widow, was duly qualified and apyvointed as administratrix of said intestate on the _day of July 1909, and as such has entered upon the administration of said astate, 2. That on or about the 22nd day of March 1909, the said in- testats sold and contracted in writing to convey to the defendant the lands hereinafter described, at the price of $1275.00, $10.00 of same being paid down in cash, and receipted for by the intestate at the date of said sale, and the residue to be due and payable on the 15th day of November 1909, which contract and receipt are in writing, signed by the parties to be charged, duly registered in the office of the Register of Deeds of Irecell County, in Book of Deeds No, £0 paged sri and are hereto attached, marked Exhibits A, and B, and made a part of this complaint, said lands bving de- scribed as follows, viz:- Lying and being in Iredell County, said State, adjoining the lands of John Goodin, E, L. Slosn, Mrs, Manda Jordan and R, E, King and others, bounding as follows:- Beginning at a maple E, L, Sloan's corner; thencs North 5 West 66 poles to a cherry in John Goodin's line; thence North 71 West 30 voles to a stones; thence South 45 West 26 polas to a stone, Mrs. Jordan's correr ; thence North 70 West 85 poles to a stone John Goodin's corner; thence South 31 poles to post oak Goodin's corner; tence North 71 West 103 poles to a whits oak; thence South 36 poles to a white oak; thence South 41 East 79 poles to a dogwood; thence South 19 East 34 poles to a stone; thence North 83 East 40 poles to a stone; thence South 8 West 26 voles to a stones thence North 80 East 10 poles to a stone; thsnce North 2 Fast 31 poles to a stones; thence North 62 Fast 34 poles to the beginning, containing 140 1/2 acres, more or less, See deed from Eugene Morrison and others to W, M. C, Freet, deceased, in the sun of Twolve Tundred, Sixty-Pive & no/100 Dollars ($1265.00), together with intergst on said from the 15th day of November 1909, until paid, balance due on said contract, Wherefore, the plaintiff demands judgment for the sum of $1265.00, with interest thereon from the 15th day of November 1909, until paid, and that said jJudgmant be declared a lien upon said land: and that the court appoint soms competant verson a com missioner of this court to collect the said purchase money, and upon the payment thereof, to executs and deliver a deed for said land to the purchaser as provided by law, and for such other and further relief as may be just and rig PAKS eo , sel for the Plaintiff, Mrs, Fannie C.
