Caldwell & H. P. Grier, Trustees, H. Morris Teaf, Trustee, PETITION FOR SALE OF Mrs. M. G. Frazier and Eutrilla LAND FOR PARTITION, Frazier by her next friend, Mrs. Me G. Frazier, Ex Parte. To the Superior Court of Iredell County: The above petitioners complain and allege: First: That Eutrilla Frazier is a minor about four years of age, and appears in this action by her Mother, lirs. li. G. Frazier, who has been duly appointed her next friend, for the purpose of joining in this pro- ceeding. Second: That 7. W. Frazier died intestate in Iredell County on the day of March, 1914, and left him Surviving his widow, Mrs. M. G. Frazier, and W. A. Frazier, Lawrence Ray Frazier and Eutrilla Frazier, his only heirs at law. Third: That at the time of his death the said 7.1 ‘te Frazier was seized and possessed in fee Simple of the follow- ing described real estate, to-wit; First Tract: Adjoining J. 2. Sloop and others and being on the West side of North Center Street, in the City of Statesville, North Carolina, and beginnine at a point 9 feet South of the South East corner of the Henkel-Craie Live Stock Co. building and running Westwardly with the Southern edge or line of a 9 foot alley along the South side of said Henkel-Craig Live stock Co. building 120 feet to a stake; thence South 24 E, and parallel with Center Street 26-2/3 rn H @ N - o) 4 *m M se w o u L vi e l feet to a stake opposite a point 4 inches South of the North West corner of the brick building, owned and occupied by John E. Sloop on North Venter Street; thence North about 66 E. parallel with the Northern wall of J. E. Sloop’s said build- ing 120 feet to Center Street, at a point 4 inches South of the North East corner of John E. Sloop's said brick building, including four inches of said North wall of the said J. E. Sloop brick building, tosether with the right to cut into and adjoin said wall, but in a way as not to weaken, damage or injure said wall in any way; thence North 24 W. with Center St. 28-1/4 feet to the berinning, containing, 3,275 square feet more or less. Second Tract: A lot of land situated on the North Ve side of Alexander Street in the Vity of Statesville, MN. C between the lots formerly owned by Rev. A. 5. Billingsley and Thos. Je Cook, containing about 107 feet front on said street by 214 feet deep. For more particular description see deed from J. I. Varlton, ‘rustee to T. W. Frazier, recorded in Book 23, page 104 of the Records of Deeds of Iredell County. Third Tract: Adjoining the lands of Dr. 7. £. Anderson and B. i’. Long, and bounded as follows: Beginning at a stake in Dr. T. E. Anderson's line, now his corner, and runs South 67 W. 40 poles to B. +. Long's corner; thence South 20 E. with B. F. Long's line 110 feet to a stake; thence N. 67 E. 40 poles to Anderson's line; thence N. 23 W. 110 feet to the beginning, containing one and two-third acres more or less. Seedeed from 7. Lb. Miller and wife to Frazier, Book 26, page 222. Fourth Tract: Adjoining the lands of J. W. ae *‘ T e t z e i g a so ° s o n = vI 6 l Stephenson and others and bounded as follows: Beginning at a stake, J. W. “tephenson's corner on Alexander Street, in the City of Statesville and runs with Simonton's line North 24 W. 207 feet to a stake on Stimonton's line; thence N. 60 E. 103-1/2 feet to a stake, Simonton's corner; thence S. 24 We. 207 feet to a stake on Alexander Street; thence S. 66 W. with said street 103-1/2 feet to the beginning, containing 1/2 acre more or less. See deed from T. J. Cook and wife to T. W. Frazier, Book 28, page 200. Fifth Tract: Lots Nos. 10 and 11 in Block 3 as Same are plotted and planned on the map of Bloomfield, registered in the office of the Register of Deeds of Iredell County, said lots being more particularly described as follows: Beginning on the South corner of Caldwell and Alexander Streets; thence S. with Caldwell Street 150 feet; thence about East 179 feet; thence about North 122 feet to Alexander street; thence i. with Alexander Street 182 feet to the beginning. See ieed from N. 3. Mills and wife to 7. W. Frazier, Book 30, page 435. Fourth: That on the 29th day of April, 1914, Lawrence Ray srazier and wife, Alameda G. Frazier conveyed their interest in the above described lands to H. Morris Teaf, Trastee, in trust for the following purposes to-wit: "The net income arising from said property shall be paid by said trustee to the said Alameda G. Frazier during her natural life, and from and after her death, said income Shall be paid by said trustee to Thomas Wesley Frazier and William Agron l'razier, children of Lawrence Ray Frazier and Alameda G. Frazier, during their natural lives, Share and Share alike, and that at their death, the said property shall be conveyed by said trustee one-half to the heirs of Thomas rr H N be © 4 "m M se w o u L vi e l Wesley Frazier and one-half to the heirs of said William Aaron Frazier." Said conveyance further directing and em- powering said trustee to sell and dispose of the property therein conveyed and reinvest the funds upon the same trust and uses above provided. Reference is hereby made to said deed, recorded in Book 49, at page 542 in the Register of Deeds office of Iredell County. Fifth: That on the 18th @ay of April, 1914, W. A. Frazier and wife, Beulah Frazier conveyed their interest in the above described lands to L. C. Caldwell and H. P. Grier, Trustees, upon the following trust to-wit: "That the said L. Cc. Caldwell and H. Pp. Grier Shall sell ana convey the said interests in Said lands whenever in their Opinion a Satisfactory price therefor can be obtained, and shall convey to the purchaser thereof the fee simple title to said interest in said land, free and discharged from any and all claims of the said W. A. Frazier and Beulah Frazier, or either of them, in and to Said lands or interest therein, and from the proceeds derived from said Sale one-half thereof Shall be held by the said H. Pp, Grier and by him turned over to the said W. A. Frazier, after de- ducting his Compensation as representative of the said W. A F razier; the other half interest shall be turned over to the Said L. Cc. Caldwell, and after he has dedvcted his compensa- tion therefrom as representative of the said Beulah Frazier, two-thirds of the remainder shall be invested in the name and for the use of Margaret Bell Frazier and Jack Frazier, chil- dren of the said W. A. Frazier and Beulah Frazier, and the remainder paid over to the Said Beulah Frazier, "The interest or income to be derived from the a *m se w o u L ‘1 e t T z e i g vI 6 l funds invested for the said Margaret Bell and Jack Frazier, Shall be used by the said Beulah Frazier or other legal custodian or guardian of the said Margaret Bell and Jack Yrazier, for their care and maintenance until each shall arrive at the age of twenty-one years, when his or her respective share shall then be paid over to him or her. And in the case of the death of one of said children, before arriving at the age of twenty-one years, his or her share Shall go to the survivor upon the same trust as is herein- above specified as to the other portion of said fund." This deed is recorded in Book 49, page 558 in the office of the Register of Deeds of Iredell vounty, N.C. Sixth: That Mre. Me-G. trazier, wife of T. W. Frazier is entitled to dower in all the above described lands; that she joins in this proceeding and asks that said lands be sold free and discharged of her dower right therein, and asks that the present value of her dower be ascertained and paid to her from the proceeds of said Sale, in lieu of @ dower in said lands; that at the time of the death of her husband, the said Mrs. M. G. Frazier was thirty years of age, and that her expectancy under the mortuary tables of the laws of North Carolina was and is 35.3 years, Seventh: That subject to the dower interest of las. M. G- Hrazier aforesaid, the infant petitioner, Eutrilla Frazier is entitled to one-third undivided interest in said lends, and the petitioner H. Morris Teaf, Trustee as aforesaid, is entitled to one-third undivided interest therein, subject to the dower of the said lirs. M. G. Frazier, due and the said L. C. Caldwell and H. 2+ “rier, Trustees, as aforesaid, subject to the dower of Irs. M. W. Frazier and all parties interested in the real estate, has collected in rents from the real estate aforesaid, and now has on deposit in the Commercial National Sank, after de- ducting expenses for repairs, taxes and his charges as attorney in looking after said rents, the sum of $ That this sum is to be eaually divided between the said Rutrilla Frazier, H. Morris Teaf, Trustee aforesaid and Le. C. Caidwell & H. P. Grier, irs. lle Trustees aforesaid; the said G. Frazier not being entitled to any part of said rents, she having occupied the dwelling house since. the death of her said husband, Ninth: That the petitioners desire to hold their interest in said lands in severalty and to this end desire that the Same may be sold at public auction, on such terms as the Court may deem just and proper. This cause coming on to be heard on the petition, and being heard, the Court finds as a fact: That all the petitioners desire toe sale of the lands mentioned and de- scribed in the petition, free and discharged of the dower interest of lirs. NM. Ge razier, and that said M. G. Frazier receive the present value of her dower interest in said lands from the proceeds derived from the sale, in lieu of her dower therein. The Court further finds that the said Irs. Mie G. Frazier was thirty years of age at the death of her husband, and that her expectancy was 35.3 years, and that she is entitled to receive the present value of her dower in said lends from the proceeds of said sale, based on her age and expectancy, aS above set out, as fixed and defined by the laws of this State: It is therefore considered, adjudged and ordered that L. C. Valdwell and Dorman Thompson be, and they are hereby appointed commissioners to sell the lands mentioned and described in the petition, at the Court House door in Iredell County, to the highest bidders at public auction, after posting notice of said sale at the Court House door and three other vublic places in Iredell County for thirty days immediately preceding said sale, and alSo by publishing *m se w o u L ‘1 9 T Z e 4 G v i e l Said notice of said sale for four weeks in the Landmark and Statesville Sentinel, newspapers published in Iredell County, North Carolina, thet said lands be advertised and offered for sale on Monday, March 20th, 1916, at 12 o'clock Me. on the following terms to-wit: One-third cash, one-third in six months and one-third in twelve months, with interest on deferred payments. All bids to be secured by security satisfactory to the Court. Said commissioners shall report their proceedings to this Court within ten days from date of Sale.
