Free- land Freeland, answering the petition filed in this case, alleges :2n‘4 says: First:- In answer to the allegations contained in the first peregreph of the petition, the defendant denies that Abner Rebeccs Freeland is a tenent in common in the estate of Maurice P. Freeland; = 7 ay ‘ but admits thst L. E. Freeland, one of: the petitioners, is the widow of .bner Ww. Freeland, and that he died the 16 of March, 1901, ard that Maurice >. Freeland died intestate the 26 of November, 1905; the de- fendant also admits that Abner Rebecca Freeland is the only heir-sat- law of the said 4} ". Freeland sn@ “aurice >. Freeland, who were tenants in common and s of the land described in said petition. and rroceeding further to answer said paragraph, this de- fendant alleges thet Abner Rebecce Freelandis the sole owner of all of said land, being seized and possessed ss en heir-at-law of Abner a ’, and “aurice P. Freeliund of the entire interest in said land, subject 7” to the dehts of the said Maurice ©. Freeland for his one-hslf interest. Second:- In answer to the sllerations co ined in the second paragreph of the complaint, the defendant denies that Abner Nebecca Freeland is the owner of only one-half interest in said tract of land, but alleges, on the contrary, that she is the owner of the entire interest in said land, subject to the indebtedness of the estate of Maurice ©. Freeland, from whom she inherited = one-half interest of the same. Third: - In answer to parsgraph third, the defendant cimits the same. Fourth:- In answer to the fourth peragraph of the petition, the defendant denies the same. Sixth:- ln answer to the allegations contained in the sixth paregraph of the complaint, the defendant admits that M. E. Freeland ’ 7 is the widow of Abner . Freeland, and that Abner 7. Freeland died seized and possessed of one undivided one-half interest in said land. This defendant, proceeding further to answer said petition alleges and says, p wy £ 7 _ First:- That Abner ‘7. “reeland and “aurice P. Freeland, from whom the petitioner, Abner Rebecca Freeland, inherited the entire interest in seid land, were brothers and were tenants in common prior to their deeth, in the lands aforesaid, and occupied the same joint- ly, end that during their joint ownership, as this defendant is inforn- ed and believes, and so elleses, they executed a mortgagedeed on the lands aforesaid for the purpose of making improvements thereon, to wit: the erecting of a dwelling house, san@ other buildings, and that upon the dexth of Abner ". Freeland, the surviving brother, “aurice P. Free- land, peid off said indebtedness, end, as this defendant is informed and believes, executed «a mortgage to the defendant, *'. E. Flanigan, to secure 2a debt Gue to the said 1... E. Flanigan for moneys losned, and thst the money so borrowed the said -‘aurice >. Freelané used in the payment of the joint mortgage first mentioned en? improvements on the lands, sn@ that this money so expended in weking improvements on the lands, end especially that part whereon the dwelling house «nd outbuildings are now situated, which builfings ané improvements were erected thereon by the defendant's intestate, “aurice >. Freeland, and thet the mortgage aforesaid was given upon his undivided interest in said land, «nd this defendant asks that after division of said lends be made for the purpose of essigning to the widow dower i1 thet part of the lands owned by her late husband, Abner ”. thst the improved part thereof may be assigned to his estate ued without reference to the improvements placed thereon. Second:- This defendant further represents to the Court tliat he hes been duly appointed administrator of the estate of Maurice ?P. Freelané, an& hes texen upon himself the burden of administering said estate; that the amount of debts outstanding arainst the estate of Maurice P. Freeland is about 3450.00, including the mortgage sfore- said, costs of administration, and other expenses incident to the fi- nal settlement of said estate. Third:- That the value of the personal estate of said intes- ts 0 ¢ te was about %200.00, which was applied to the rsyment of prior liens upon certain personal property, snd other indebtedness agarinst said intestate. Fourth:- That et the time of his death he was seized and poss- essed of a one-half undivide? interest in the real estzte described in the plaintiff's petition, consisting of 108 1-2 acres, n? located as therein stated, «nd that the estimated value thereof to the best of defendant's ‘nowledge and information, is sbout 2400.00; thet the plaintiff in said petition, to wit: Abner Rebecca Freeland, is ny : his only heir-at-law, en? is a minor under 21 years of age, and appecrs in this action by her next friend and mother, M. E. Freeland. Wherefore, the defendant cubmits:- First: To a division of the lands sforesaid into two e ual parts, an? asks that thet part of said land embracing the improve- ments placed thereon by the defendant's intestate be assigned to his ite, without reference to said improvements. Second: This defendant, as far as he is concerned, will consent, ofter said division, to the plaintiff, U. FR. Freelend, the widow of Abner . Freeland, having her dower assigned in thet part of ~ i seid lands owned by her late husband. Flanigan, Mortgagee, one of the defendants in the above proceeding, says: First:- That she admits peregraph first of the petition, ex- cent the allegation of tenancy in common, which is denied. The said defendant slleres upon information an? belief that the pleintiff?, Ab- ner Rebecca Freeland is the sole ovner of the premises mentioned in said paregrach, subject to the debts and encumberances snd costs of edministretion of the estate of Maurice I. Freeland, decessed, through whom she clsims. Second:- That she denies the allegations contained in the second paragraph of the complaint, and says that she is informed and believes the said petitioner, Abner Rebecca Freeland, is sole seized of said premises, subject to the chsrges ani debts before alleged.
