C. | PETITION Fox, Ex parte. { To C. G. Smith, Clerk of Superior Court of Iredell County, North Carolina: The undersigned would respectfully show to the court that Mrs. H. Cc. Fox died leaving a last will and testament and that C. C. Holcomb was named as Executor of said will and that the said C. C. Holcomb has qualified and has been issued Letters Testamentary by this court. The said decedent left the following personal property which should be sald and your petitioner would respectfully show that he could receive more for the same at private sale than at public auction; said property being described as follows: Living Room Suite Bedroom Suites Refrigerator Kitchen furniture and utensils cook stove Oil Stoves, heating Front porch furniture and yard furniture Back porch furniture Secretary Vacuum cleaner Sewing machine Washing machine Table model radio Lumber Tool box and tools Canned fruit Bed Linens and covers 1 Wardrobe and any other items of personal property tha may be discovered lated. Wherefore, your petitioner respectfully asks that an order be made directing and permitting your petitioner to sell the said personal pro- perty at private sale for cash. The au- tomobilesshown in the inventory filed, with the exception of the three which have been sold, and the automobile tools, are in the hands of the Executrix, and under the Will are to go to Mrs. Bertha Johnson Fox. The following notes, mortgages and deeds of trust remain in the hands of the Executrix: 1. Note of C. M. Wooten and others, upon which this Executrix has not collected anything. 2. Note of Lee Frank Myers and wife secured by mortgage in Book 93, page 179. The Executrix has collected on this note the sum of $325.00, $200.00 of which is principal and the balance interest. There is now due on this note the sum of $1800.00, with interest thereon from 25 September, 1940. 3. Note of J. W. Rhodes and wife secured by mortgage in Book 93, page 9. The Executrix has collected $30.00 interest on this note. There is now due the sum of $500.00 with interest from August, 1939. 4. Note of F. J. Note of F.J.Jones and wife, secured by a Deed of Trust in Book 112, page 479, Iredell County Registry. The aforesaid notes have all been transferred, assigned and delivered to Mrs. Bertha Johnson Fox, Legatee under the will of N.W.Fox. All other personal property of every kind has been delivered to Mrs, Bertha Johnson Fox, Legatee under the will of N.W.Fox. A compromise settimement was made of the Deed of Trust from T.Carl Brown and others, and the Executrix accepted $525.00 as shown in this report. Deed was made to Guy Fox and wife, for the tenant house and lot on August 26, 1941, and the note and Deed of Trust for the balance of the purchase price was made payable to Mrs. Bertha Johnson Fox, to whom the property was devised under the will of N.W.Fox. When the partial settlement was filed the fees of the Clerk of the Superior Court were figured as if it was-a final settlement, and the fees in this report are figured as a continuation. WHEREFORE, having fully administered the Estate of N.W.
