Fox died in Iredell County on the go day of Yuy- : 1925, having first made, published, and declared a last Will and Testament sufficient in law to pass both real and personal property; that the original Will was duly approved and probated by the Clerk of the Superior Court, and recorded in Will Book 9, Page 245; that his Executor has made his final settlement as provided by law. @-2= That under the terms and conditions of the last Will and Testament of the said A. L. Fox, subject to the settlement of his estate, his Widow, Mary Joanna Fox, is entitled to the use and enjoyment during her natural life, to the net rents and profits of the said lands, and that Nonnie May Fox, Ruth Elizabeth Fox, Andrew Lee Fox, \.arvaret Lou Fox, Florence Hope Fox, Clay Alexander Fox, David Lafayette Fox, and Mary Ella Fox, minors, who are repre- sented in this action by their General Guardian, i#.2. Fox, and recorded in Deed Book 60, at Page 337. whe That Mary Joanna Fox, being unable to make a living on this farm, has been compelled to place all the children, except the two youngest, in an Orphen's Home, and move to Statesville where she can obtain work, in order to provide for herself and the two small children now with her; that the land is valuable only for agricultural purposes, and has to be cultivated by tenants; that it requires considerable time to look after the renting, cultivating, and collecting of the rent, and that the annual rents upon the investment in the said lend are unsatisfactory, and that after paying the taxes of Thirty-six Dollars and Fifty Cents ($36.50) annually, and the expenses necessery for the upkeep of the said lends, they do not yield a reasonable sum on the investment; that the rents are much less than the money invested would bring if the land was sold and the money used in the erection of a modest home to cost about One Thousand Dollars ($1000.00) near the City for the use of the Widow of the deceased, and of the minor children now with her, and that the remainder of the money:be placed on interest for the benefit of the Widow during her life, and then to the children. Be That Robert Fann has agreed to purchase said land at a private sale, for the sum of Twenty-five Hundred <tugmey Dollars ($2560.00), payable in cash; that in the opinion of the petitioners, the price offered by Robert Fann is full and fair value of the said land, and is as much, or more as it would bring if sold at public auction, and as evidence as to the value of this land, three affidavits of disinterested parties are attached hereto, and asked to be taken as a part of this petition. -6- That Mary Joanna Fox and Ross Fox as General Guardians of Nonnie May Fox, Ruth Elizabeth Fox, Andrew Lee Fox, Margaret Lou Fox, Florence Hope Fox, Clay Alexander Fox, David Lafayette Fox, and Mary Elle Fox, minors, are of the opinion that it is to the best interest of the devisees of the late A. L. Fox that the land be sold to Robert Fann upon the terms and condi- tions above set forth, and that a Commissioner appointed by the Court be allowed to reinvest the money received from this sale, in a modest home to cost about One Thousand Dollars ($1000.00) and to place the remainder on interest for the benefit of the Widow during her life, and that the title to the house and lot, and the money pleced on interest be in the children sub- jected to a life estate in Mary Joanna Fox. WHEREFORE, Petitioners Pray: A - That the Court make an Order directing that the said land be sold at private sale to Robert Fann for the sum of Twenty-five Hundred “faseey Dollars ($2580.00) cash. JUDGMENT Ex Parte TO THE CLERK OF THE SUPERIOR COURT OF IREDELL COUNTY: This cause coming on to be heard, and being heard before His Honor, John L. Milholland, Clerk of the Superior Court of Iredell County, and it appearing to the Court that the late A. Ll. Fox was the owner of the tract of land set out in the Petition; that A. L. Fox is dead, having first made, published, and declered a last Will and Testament wherein he devised his land, subject to the settlement of his estate, the rents and profits of his entire estate, to his Widow, Mrs. Mary Joanna Fox,for life, and after her death, all of his real property to his children, to-wit: Nonnie May Fox, Ruth Elizabeth Fox, Andrew Lee Fox, Margeret Lou Fox, Florence Hope Fox, Clay Alexander fox, David Lafayette Fox, and Mary Elle Fox; and it further appearing that the interest of said petitioners in the land is as set out in the second paragreph of the Petition; and it further appearing to the Court that Robert Fann has offered to purchase the tract of land set out in the Petition at private sale at the price of Twenty-five Hundred ($25@0.00) payable in cash; and it further appearing that it is to the best interest of all the parties interested in the saié tract of land, including Nonnie May Fox, Ruth Elizabeth Fox, Andrew Lee Fox, Margeret Lou Fox, Florence Hope Fox, Clay Alexender Fox, David Lafayette Fox, and Mary Ella Fox, who are minor devisees of the late A. L. Fox, to sell the land upon the terms set forth above in order that the money derived from the sale of this land may be used in the erection of a modest home to cost about One Thousand Dollers ($1000.00) for the use of the Widow for her life, and that the remainder of the money be placed upon interest to enable the iiidow of the late A. L. Fox to more adequately care for the minor children now with her; and that the title to the house to be acquired, and the money to be placed on interest be in the children subjected to a life estate in Mary Joanna Fox. It is, therefore, considered, adjudged, and decreed that N. W. Fox be, and he is hereby appointed Commissioner to sell the tract of land described in the third paragraph of the Petition to Robert Fann at private sale for the sun of Twenty-five Hundred Twenty Dollers ($2560.00) cash, and the said Comuiissioner is hereby authorized and directed upon the compliance with the terms of the sale to execute and deliver to Robert Fann a@ Deed, conveying to him this tract of land in fee simple, and that the Commissioner will hold the purchase money received from the sale of this land, until further orders of the Court, and will report his proceedings to the Court as provided by law. W. Fox, sold and conveyed the lands described in the Petition to Robert Fann for the sum of Twenty-five Hundred Dollars ($2500.00), and that N. W. Fox, Commissioner, now holds the proceeds of this sale to be reinvested as set forth in the Petitio. of this case. -2- That Isadore Wallace has offered to sell to your petitioners the following tract of land, for the sum of Three Hundred Fifty Dollars ($350.00) s BEGINNING at an iron stake on the North side of Monroe St, corner of the Craig property, and running N. 5 degrees E. 125% feet to an iron stake; thence N. 85 degrees W. 50 feet to an iron stake; thence S. 5 degrees W. 1244 feet to an iron stake, Monroe Street; thence S. 86 k, 50 feet to the beginning. ge That in the opinion of your petitioners, the land described above is worth Three Hundred Fifty Dollars ($350.00) or more, and that it is a good purchase at this price, and as evidence of this, affidavits of three dis- interested parties are hereto attached and asked to be taken as a part of this Supplementary Petition. Thomas has offered to construct a five room house upon this lot, to be 26 x 28, with front and back porch, to be underpinned, includ- ing the porches, and that the house is to be wired for electric lights, to be equipped with meter, and to have proper water connections with the City water line, and is to have the necessary out buildings, for the sum of Eight Hundred Dollars ($800.00). Your petitioners consider this a good contract price, and that this is as good a house as can be built for this amount, and as evidence of this, three disinterested parties have signed affidavits, which are attached hereto, and are asked to be taken as a part of this Supplementary Petition. -5< That under the Petition filed with the Clerk in the above entitled matter, your petitioners had asked that they be allowed to reinvest about One Thousand Dollars ($1000.00) of this money in a modest home near the city, but it is the opinion of your petitioners that the above mentioned property, which will cost One Thousand One Hundred Fifty Dollars ($1150.00) complete, will be to the best interest of the petitioners, and they ask that the Court grant this increase in investment in this property. WHEREFORE, your petitioners pray: 1. That the Court mke an order allowing the petitioners to buy the land above described, and that the deed to this property be made from Isadore Wallace to Mary Joanna Fox for life, and then to Nonnie May Fox, Ruth Elizabeth Fox, Andrew Lee Fox, Margaret Lou Fox, Florence Hope Fox, Clay Alexander Fox, David Lafayette Fox, and Mary Ella Fox in fee in remainder. 2. Ex Parte TO THE HONORABLE CLERK OF THE SUPERIOR COURT OF IREDELL COUNTY: Your petitioners respectfully allege and show to the Court: -le That in accordance with the order of the Court in the petition, to which this is a supplementary part, the Commissioner, N. W. Fox, sold and conveyed the lands described in the petition to Robert Fann for the sum of Twenty-five Hundred Dollars ($2500.00). -2— That in accordance with the order of the Court in a Supplementary Petition, to the above mentioned petition, the Commissioner, N. W. Fox paid out of the funds held by him, Three Hundred Fifty Dollers ($350.00) to Isadore Wallace for the lot described in the Supplementary Petition. The Commissioner, N. W. Fox, also paid out of the funds held by him, Eight Hundred Dollars ($800.00) to H. P. Thomas for a house constructed by H. P. Thomas on the above mentioned lot. This house was inspected and approved of by the Clerk of the Court before the contract price wes paid. In pursuence to the order of the Court, the title to the house and lot is in the children named in the petition subject to a life estate in Mary Joanne Fox. The Commissioner also paid out of the funds held by him, One Hundred Four Dollars and Thirty-three Cents ($104.33) for taxes due on the original lands described in the petition. The remainder of the funds now held by the Commissioner amounts to Twelve Hundred Forty-five Dollars and Sixty-six Cents ($1245.66. ) =3- The Petitioners further allege and show the Court: That due to sickness of two of the children now with their mother, Mary Joanna Fox, it will be impossible for the mother to adequately care for these children and pay the hospital and medical expenses incurred out of her wages and the interest on the Twelve Hundred Forty-five Dollars and Sixty-six Cents ($1245.66. ) It is the desire of the Petitioners to partition this sum and pay to Mary Joanna Fox the present value of her life estate, in order that she may care for her present needs and those of her sick children, the intercst of the remaindermen to be paid to their general Guardian, W. R. Fox. WHEREFORE, your petitioners prey: 1. That the Court make an order, ordering N. W. Fox, Commissioner, to pay out of the funds now held by him, Seventy-five Dollars ($75.00) to Neil S. Sowers for Attorney fee, and then after paying the Court cost of this action, to distribute the rest of the funds as follows: a. ‘To Mary Joanna Fox, the present value of her life estate. b. ITEM TWO I WILL, devise, and bequeath to my beloved wife, LIZZIE CARTER FOX, absolutely and in fee simple, all of my property of every sort, kind, and description, both real and personal, tangible and intangible. ITEM THREE IF MY wife, LIZZIE CAREER FOX, should predecease me, then, I will, devise, and bequeath to my son, JAMES GARLAND FOX, absolutely and in fee simple, all of my property of every 7 ° f Q 8 oa o wo = 8 6 S 6 1 (2) sort, kind, and description, both real and personal, tangible and intangible. IN THE event my said wife should predecease me and my property should go to my son, JAMES GARLAND FOX, it will be necessary for the court to appoint a guardian to look after my son and manage his property as he in incapable of doing so himself. In this event, I would like to recommend to the court that my brotle r, JAMES ROBERT FOX, be appointed guardian for my son if he is able to carry out this assignment. If my said brother is unable to carry out this assignment, then I would like to recemmend that the court appoint my nephew, R. A. LOWERY, JR., to act as such guardian.
