That Bula Mae White is a minor 14 years of age, and appears in this action by her next friend, D. L. Raymer, Jr., and that she is the owner of an one-seventh interest in the following described tract of land lying and being in Statesville Outside Township, Iredell County, North Carolina, and more particular- ly described as follows: Being all of Lots No. 8, 10, and 11 of Block 11, of the Bloomfield Addition to Statesville, and as mapped and platted on record in the Kegister of Deeds office in Iredell County, in Book 31, page 592. 2.That C. G. Fortner and his wife, Ona Fortner, are the owners of six- sevenths interest in the said land, having purchased the 6/7 interest from the other heirs at law of T. L. Fortner, and paying them $100.00 each for their interest, less one-seventh of the cost of this action which they have agreed that they shall beer in the sale of this land. 3. That an actual partition of the land itself cannot be made as it consists entirely of one house and lot, and two vacant lots, and therefore is not subject to a division into seven equal parts. 4, That a sale of the said lands would be more advantageous to all of the tenants in comion, and as heretofore stated, C. L. Raymer, Jr., is the owner of one-seventh undivided interest in the lands described in the petition; And 4t further appearing to the Court that the land cannot be divided among the tenants in comnon due to the property consisting of one house and lot, and two vacant lots, and the great number of the interests therein; And it further appearing to the Court that C. G. Fortner and wife, Ona Fortner, have agreed to purchase the interest of Eula Mae iihite, minor, for the sum of $100.00; And it further appearing to the Court that this is the reasonable worth of the one-seventh undivided interest owned by Eula Mae White, minor, and in support of this fact there is offered with this petition an affidavit from three disinterested and reputable ffeeholders of Iredell County; And it further appearing to the Court that the tenants in common of the said lands described therein have agreed each to bear one-seventh interest of the cost of this action.
