To the Superior Court of Iredell Vounty: The petitioners complain and allege: First: That they, together with the defendants are devisees under the will of Samuel Foster, and as such devisees are, with the exception of Wiley West, tenants in common and are in possession of the following described lands, lying and being in the County and State aforesaid, adjoining the lands of S- 7. Heath, Aris Gray and others, and bounded as follows, viz. Beginning at a stone, Humphrey Tomlinson's former corner, and running North 13° West 21 chains and 55 links with the bed of the branch to a Spanish oak; thence North 58° E. 20 chains and 90 links to a black oak, A. A. Anderson's corner; thence S. 50° E. 25 chains to a stone, A. A. Anderson's and Fannie Gray's corner; thence 5. 42° W. 17 chains and 50 links to a Spanish oak, Aris Gray's corner; thence E. 24 chains to a post oak, 0. Said tract of land being the identical tract of land conveyed by Milton Ellis and wife to Samuel Mec, Foster by deed dated the 22rd day of October, 1890. Second: That Samuel Foster is dead, having left a last will sand testament, which will is recorded in the office of the Clerk of the “uperior Court of Iredell County in Will Book 6, page 408, and is in words and figures as follows,to- wit: I, Samuel Foster of Iredell County, North Carolina, being of sound mind, declare this to be my last will and testament concerning the division and disposition of my property at my death. lst. I give and bequeath to my beloved wife, Catherine Foster, all of my real estate, consisting of one hundred acres of land, upon which I now reside (being all the land I now possess) with all appurtenances thereto be- longing, so long as she shall live. 2nd. At my wife's death I desire that Jennie Albea and heirs shall have thirty acres of the above land, including the dwelling house and out-buildings, in which I now reside. 3rd. It is my will and desire that after my wife's death that Zlizabeth Stroud and heirs shall have twenty acres of the above land. 4th. It is my will and desire that Sallie Heath shall have twenty-five acres of the above described land. 5th. It is my will and desire that Wiley West shall have during his life time only twenty-five acres of -2- jo n u i e s “1 9 } s 0 . 4 91 6 1 the above described lands, and at his death the said Wiley West the twenty-five acres given him to go back and be equally divided between Mrs. Jennie Albea, Elizabeth Stroud and Sallie death, or their heirs. Fourth: That the defendants,Dollie Stroud, Lora Stroud and Lala Stroud are minors without general or testa- mentary guardian. Fifth: That your petitioners desire to hold their Shares in said land as devised to them by the said Samel Foster in severalty. Wherefore, your petitioners pray: First: That the Court shall appoint some suitable and discreet person as guardian ad litem to appear and defend in this action, for and in the name and behalf of the minor defendants. ja n u e s “1 9 } s 0 . q S1 6 1 Second: That three commissioners be appointed to divide the land by proper metes and bounds, according to the directions set out in the above mentioned will of Samuel Foster, and to allot to eagh of your petitioners such share thereof as each is entitled to under said will, and to allot to the heirs of: Bettie Foster Stroud such share as they are entitled to under said will, said share being twenty acres of the above described land. Third: That the said commissioners be required to make renort of their proceedings under their hands and seals as soon as practicable into your Court, and that it be set out in said report that the twenty-five acres allotted to Wiley Vest are allotted to him under the terms of said will for and during the time of his natural life, and that upon the falling in of the life estate of sai’ Wiley West in said twenty-five acres, that then the remainder in said lands shall vest one-third in Jennie Albea or her heirs, one-third in Sallie Heath or her heirs andone-third in the heirs of Bettie Foster Stroud. To the Clerk of the Superior Court of Iredell County: By virtue of an order of the Superior Court of Iredell County made in the above entitled cause, we, the undersigned commissioners exposed to sale to the highest bidder at the Court House door of Iredell County on the 25th day of September, 1916, at twelve o'clock M., after due ad- vertisement, the lands mentioned and described in the Sup- plementary petition filed in this cause, When and where C.
