The plaintiff complaining, alleges: -l- That on the fifty day of January, 1888, Hiram Fleming, late of the County of Iredell, and Harriet C. Fleming, his wife, became and were indebted to the plaintiff, in the sum of Sixty Dollars ($60.00), for which they made and executed their note, in words and figures as follows: to wit: "On or before the 15th day of October, 1888, we promise to pay to H. A. Smith “60.00 for value received. Int. from date at 8% until paid. Hiram Fleming, (Seal) January 5th, 1888. (Signed) her Harriet Fleming, xX (Seal) J. L. Bradley.” mark. -2- That the said Hiram Fleming and wife, Harriet Fleming, being anxious to secure the payment of said note and interest thereon at maturity made and executed to the plaintiff their mortgage deed upon the following described real estate in Coddle creek rownship, said County, bounded as follows, to wit: "Beginning at a stone J. W. EBrawley's Corner; thence South 214° West 22 poles to a stone; thence South 58° East 15 poles toa stone ; thence North 154° West 51 poles to a stone, G. W. Brawley's line; thence South 49° East 20 poles to a stone, Brawley"s corner; thence North 123° East 78 poles to a stone J. W.
