The inheritance tax in this estate and in the estate of deceased brothers and sisters from whom Bertha Fleming had inherited has been paid. When Bertha Fleming died the land and some of the personal property was owned by her and her brother P. A. Fle.iing, each having a one-half interest. Deeds were obtained from P. A, Fleming and wife, and these deeds are recorded in Deed Book 183, page 451, and Deed Book 183, page 455, Iredell County Registry. The Deed of Trust to the First Building and Loan Association on the land sold to Mrs. Jettie W. Massey was paid and has been cancelled. The Executor advertised the real estate for public sale on Saturday, December 20, 1958, but it was such a bad, cold day, there was no one present, and he did not receive a bid; that thereafter the Executor advertised the real estate for sale on Saturday, May 30, 1959, and the last and highest bid was $3,000.00, and thereafter an increased bid was filed of $300.00, and the property was resold at the Courthouse door on July 6, 1959, and at that time the last and highest bid was $3,350.00; that the Executor did not feel that this was a fair price, and the beneficiaries under the will requested that the sale be not confirmed; that about October 1, 1959, after discussing the matter with the beneficiaries, the Executor placed the real estate with Holland Realty Company for sale, and Mr, Stamey Holland, Jr. now advises that he has several prospects for the property, and that he believes that as soon as spring opens up, that he will be able to dispose of it at a fair value, and will also be able to get the necessary fin- ancing which the interested parties need, and which is rather hard to get at this time, 4e That it is necessary that the estate be left open in order to close out and sell the real estate, and the beneficiaries under the will desire that this be done, and the Executor,therefore, requests that you grant an extension of time for filing final settlement for a period of six months from the date of aT [ e I s q “S U I W E ] J _ \O Nn | this report, with the understanding, however, that if the real estate is sold prior to that time, final settlement will be filed immediately. Miss Adelia Fleming, a half-sister of Miss Estelle Fleming, and who was bequeathed $1,000.00 in Item 2, died several years before Miss Estelle Fleming, and, therefore, this legacy lapsed. 4. Ralph H. Fleming and Mrs. Margaret F. Fleming is now dead, having died about December 29, 1962, a resident of Mecklenburg County, North Carolina. Fleming, and forty per cent of the property remaining has been paid to Mrs. Margaret F. Swann, WHEREFORE, having fully administered on the Estate of Miss Estelle Fleming, the undersigned Executor prays that this report be accepted as his final settlement, and that the same be examined, audited, approved and ordered recorded, and that he be discharged as by law provided.
