That on July 3, 1925 the s-id Lillian G. Aldridge died in- testate without ever having had issue born to her, and left surviving as her only heirs at law her two brothers, the petitioners W. G. & CT. Fisher and the following Nepvhews and nieces, to-wit: Ella Mitchell, Oscar L Mitchell, t—3-Pisher,C-f-Fieker, Blake Morrison, Mildred Evans, Joseph Mills, Lillian Mills, Ida Bell Mills, Eugene Milis, Elizabeth Mills, Mary Frank Mills, and Richard Mills; That, subject to the debts of the said J S Fisher deceased, and the dower rights of Mary J Fisher, widow of the said J S Fisher deceased, the said Lillian G Aldridge, at the time of her death, was seized in fee simple and entitled to the possession of an undivided one fifth (1/5) interest in the land above described; that said interest descended to the said heirs at law of the said Lillian G Aldridge subject to the debts of the seid Js Fisher, the dower right of the said Mary J Fisher widow of J S Fisher deceased, and the debts of the seid Lillian G Aldridge; that on the day of December 1925, C T Fisher was duly anvointed administrator of the ssid Lillian G Aldridge by the Clerk Suverior Court of Iredell County, North Carolina, and at once entered unon his duties as such administrator. 5. That a cart of the personal estate of the sid J S Misher wes assigned to the said Mary J Fisher, widow of J S Fisher deceased, on her year's allowance, and that the remainder thereof has been converted into cash by the said WG Fisher, Administrator; and thet practically all has been applied on the debts of the said J S$ Fisher, deceased; and that, after deducting the balance thereof still in the hands of the said WG Fisher, Administrator, the remainder due on outstanding debts against the estate of the said ¥ S Fisher, as near as can be ascertained at this time, "S f Jo y s i y y7 6 l by the vetitioner, 7 G Fisher, Administrator, is about $1000.00; and that it will be necessary to sell a vart of the real estate of the said J S. Ald- ridge, and that she left no versonel estate from which same can be vaid; and that, subject to the debts of the said J S Fisher, the dower right of Mary J. Fisher widow of J S Fisher, deceased, and the debts of Lillian G. Aldridge on an undivided one fifth interest in the lend hereinabove des- cribed , the interests of the vetitioners end defendants in said lands are as follows, to-wit: WG & CT Fisher sre each entitled to an undi- vided one fourth interest therein; Ella Mitchell, Oscar L Mitchell and Blake “forrison, who are children of SAO Matinee a deceased daughter of the said J S Fisher deceased who died »orior to the death of the said J § Fisher , are each entitled to an undivided 1/12 inte est (Mildred Evans) thereof; that/Joseph Mills, Lillian Milla Ida Bell Miils, Eugene Mills, Elizabeth Mills, Mary Frank Mills and Richard Mills, children of Neg pace Z NL, a deceased daughter of the said Js Fisher who died prior to his death, are each entitled to an undivided 1/32 interest thereof; That it is necessary to sell a partvof the seid lands to secure essets to pay the debts outstanding against the estate of the said J S Fisher, deceased, and Lillian G. Aldridge, deceased; and that the vetitioners desire to hold their respective interests in the remainder of said lands in severalty; that an actual vartition of said lands can not be made without injury to the partics interested therein owing to the small number of acres to which each would be en- titled by a division thereof; and that a sale of all the said lends for assets and partition would be to the interest of all varties interested thereon. 7. That Mary J Fisher widow of J S Fisher deceased, is entit- led to dower in the ‘ands herein described; that she is 72 years old and elects to have her dower interest in said l-nd ascertained under the Mortuary Tables of North Carolina, nd vaid to her in cash in lieu of dower, and for that purpose she joins in this proceeding. phle Meliriharr 8. Thatfiildred Evans, Ida Bell Mills, Eugene Mills, Elizabeth Mills, Mary Frank Mills, and Richard Mills are minors without any gen- eral or testamentary guardian. WHEREFORE, the petitioners pray: (1) That a guardian “wa to represent the minor defendants, to-wit: “1ldred Evans, Ida Bell Mills, Bugene Mills, Elizabeth Millis, Mary Frank Mills, and Richard Mills. (2) That an order be made directing that the land herein des- cribed be sold for assets to pay the debts outstanding against the estate of the said J § Fisher and costs of administration; and to vay tre debts outstanding against the estate of Lillian G. Aldridge and tre costs of administration unon her estate, provided the seme does not exceed 1/5 of the net vroceeds of said sale after deducting an amount sufficient to pay the debts outstanding against the estate of the seid J S Fisher, the costs of administration upon his estate, the dower in- terest of the said Mary J Fisher, and the costs of this proceeding; and that the remainder be distributed among the parties to this pvro- ceeding according to their respective interests. The deferred pay=- ments to draw interest from date of confirmation of sale; with the under- standing that all crops now on the land are to vass to the purchaser with the land, provided the said purchaser pays the taxes for 1926 on the said land.
