The commissioners shall make and sign three lists of articles assigned, stating the value of each, the number of the family, and deficiency to be paid by the personal representative. One of these lists shall be delivered to the widow, one to the personal repre- sentative, and one returned by the Justice, within twenty days after the assignment, to the Clerk of the Superior Court of the county, who shall file and record the same, and enter judgment against the personal representative, to be paid when the assets shall come into his hands, for any residue found in favor of the widow. In case there be no stock, crop or provisions on hand, the year’s support may be allotted by commissioners from the personal property of the deceased and also any debt known to be due him, and said allotment shall vest the said property in the widow and her right to collect said debt. C22 See ee Southern Power Company and the Dixie Cotton Mill, Defendants, The plaintiff, complaining of the defendant, alleges: i: hat Samuel Ferrell, late of the County and State aforesaid, died therein on or about the leth day of March,1910, intestate, and the plaintiff has been duly appointed and qualified as Administrator of his estate, 2. That the Southern Power Company is, and was at the times hereinafter mentioned, a corporation, duly creating and existing according to law, and engaged in the business of transe mitting and selling to cotton mills, and its other patrons, electricity for power and lighting purposes, 3. That the Dixie Cotton Mill is and was at the times herein after mentioned, a corporation duly created and existing under and by virtue of the laws of the State of North Carolina, and en-gaged in the business of manufacturing cotton into yarns,etc,, in or near the town of Mooresville, County and State aforesaid, | and is and was the owner of a mill building, machinery, tenement houses and other structures used in connection with the said manufacturing business, as well as the land upon which said "TI @ = — o N 2 a cS os Ol 6 I (2) lding and houses are locatéd, 4. That for more than six months prior to the said 12th day of March, 1910, the defendant, the Southern Power Company, had been and was then, furnishing to its coedefendant, the Dixie Cotton Mill, electritity, to be used, and which was used by said mill, for the purpose of providing the motive power to operate its machinery, and also to light its mill building, as well as its tenant houses, etc ., located in and upon its said premises, which said electricity was carried and transmitted into $aid mill building, tenant houses, etc., by means of heavily charged electric wires which were strung upon cross beams, fase tened near the top of a number of poles planted in and upont said premises of said cotton mill. dD: That for a long time prior to the injuries hereinafter complained of, the defendants negligently, carelessly and recklessly permitted a guy wire, which had originally been attached near the top of one of the poles used for the purpose aforesaid, and fastened to the ground for the purpose of holding said pole in proper position upon the premises, aforesaid, to become loose and detached from the ground, so that it hung sus- pended from the top of said pole in such position that it was liable at any time to come in contact with, and in fact, did frequently come in contact with, the heavily charged electric wires strung upon said poles, and so near the ground that it could be easily caught hold of by small children who were and had been in the habit of passing along and playing around the place where said wire was suspended, with full knowledge and consent of said defendant, who knew, or by the exercise of ordinary care should have known, that the said guy wires so suspended, was liable to become, and did frequently become, heavily charged with a deadly electric current, by means of 12} oa = = a N r=) 3 = Q O1 6 ! coming in contact with the live electric wires aforesaid, and when so charged with said electric current was liable to kill, or seriously injure, any person taking hold of the same, in ignorance of the danger aforesaid, 6. That on the said 12th day of March, 1910, the plaintiff's intestate , Samuel Ferrell, a child of but six years of age, who lived with the plaintiff, his father, in a house upon the pre-e mises aforesaid, located a short distance from said suspended guy wire,- while playing around and near said suspended wire, as he and other children in said mill village were in the habit of doing,= following the innocent impulse of a child of his age, took hold of said guy wire, which was either already heavily charged with an electric current from the live electric wires above, or became charged with the said current by means of said child swinging upon said guy wire, or otherwise causing the same to come in contact with said live electric wires, by rea- son whereof the said Samuel Ferrell received into his body such a deadly electric shock from said heavily charged guy wires as to cause his instant death, to the plaintiff's great [wer damage, toewit, in the sum of Thousand Dollars, WHEREFORE the plaintiff demands judgment for the said sum of $25,000.00 ,and the costs of this action , to be taxed ES? I give, bequeath and devise unto my wife, Rhoda P. Fesperman, all of my property of all kinds whether real, personal, or mixed and wherever situated to be hers during the term of her natural life but I further direct that in the event it shall be necessary for her to sell any of the farm for her comfortable support, then she shall hereby be authorized to sell any of the personal property or real estate and convey good title to the same; and at her death all of my property as shall remain I give and devise to my two sons, Troy Fesperman and Wyatt Fesperman, in equal portions; however, I place this charge upon my property, that Troy Fesperman and Wyatt Fesperman shall pay to Reba Fesperman Hoke the sum of $7,000.00 and to my daughter, Lena Fesperman Morris, the sum of $7,000.00 and to Bobby Mitchell Fesperman, my grandson, $1,000.00 when he reaches the age of twenty-one. Third. I hereby constitute and appoint my wife, Rhoda P. Fesperman, the executrix of this my last will and testament, to carry out the same and every part and clause thereof according to its true intent and meaning - hereby revoking and declaring utterly void all other wills heretofore made by me.
