One of these lists shall be delivered to the widow, one to the personal representative, and one returned by the Jus- tice, within twenty days after the assignment, to the Clerk of the Superior Court of the county, who shall file and record the same, and enter judgment against the personal representative, to be paid when the assets shall come into his hands, for any residue found in favor of the widow. In case there be no stock, crop or provisions on hand, the year’s support may be allotted by commissioners from the personal property of the deceased and also any debt known to be due him, and said allotment shall vest the said property in the widow and her right to collect said debt. My Executor, hereinafter named, shall give my body a decent burial, suitable to the wishes of my family, and pay the expenses of the same, together with a reasonable monument, and all my other just debts, as soon as practical after:my death. Subject to the payment of my debts, I give, devise and bequeath all of my personal property, consisting of livestock, farming tools and all other personal belongings and property, unto my brother, Paul F. Feimster, to be his absolutely. Item 3. I give, devise and bequeath unto my nephew and niece, William J. Feimster and Nancy Feimster, equally, share and share alike, in fee simple, the tract of land I own, known as the Siceloff land in Olin Towm- ship, containing 8 acres, more or less, and described in a deed from W. P. Siceloff. Item 4. I own 8/10 undivided interest in the Quince Feimster home place in Olin Township, containing 207 acres, more or less. My brother, Paul, owns a 1/10 undivided interest and my deceased brother, Ike's children, William J. and Nancy, own a 1/10 undivided interest. It is my will and desire and I suggest that Ike's share be laid off across the West end of the place so that it will adjoin, with the road separating it, the Sice- loff place which I have devised to his children. If this is done, then I give, devise and bequeath unto my sister, Ava Boggs, wife of Andrew Boggs, 30 acres off the Feimster home place, to be laid off immediately to the East of Ike*s share and I give, devise and bequeath to my sister, Nellie Harris, 30 acres to be laid off immediately East of Ava Boggs* share, all to run across the West end of the home place from North to South in as near straight lines as possible. Feimster, for and during the balance of his natural life, and at his death in fee simple to his surviving child- ren, provided and on condition that the said Paul F. Feimster shall pay the sum of $500.00 to my sister, Lorena Tatum, if she be living at my death. The said $500.00 to be a lien and charge against the said land and he may pay the same, if he desires terms, at the rate of $100.00 and accrued interest, each year for five years, the first payment to be made twelve months after my death. If my sister should not be living at the date of my death, he shall not pay the $500.00, but if she dies before completion of the payments, any unpaid balance shall be due her estate. It is my will and desire and I direct that my Executor shall employ a competent surveyor who shall lay off the lands as I have suggested and establish the calls and boundaries of the same and my Executor shall execute deeds to the respective devisees. It is my thought that If Ikets share is laid off the West end of the place, his children would have the Siceloff place adjoining and after Avats and Nellie's share is laid off in between, that Paul's share would be laid off along with his own undivided interest, on the East end of the place. If for any reason, this division cannot be made in the manner that I have suggested, then and in that event, I direct that my share in the Feimster home place be laid off and separated from the other interests and that 30 acres off the same be deeded to Ava Boggs, 30 acres to Nellie Harris and the balance to Paul, for life, and at his death, to his children, subject to the charge of $500.00 as herein set out. The Executor and surveyor to lay the same off in such a way as they think will do less damage to the shares and give each a road front. Item 5. All the rest and remainder of my property, if any, I give, devise and bequeath unto my brother, Paul F. Feimster, to be his absolutely. Item 6. I hereby constitute and appoint my brother, Paul F. Feimster, Executor of this my last Will and Testament, to execute the same and every part thereof, according to its true intent and meaning, hereby revoking all other wills and testaments by me heretofore made. Feimster, $100.00 to Nancy Lou Feimster, and $300.00 to the children of Mrs. Ava Boggs. Se Lorene Tatum died about 14 years prior to the death of Percy Sharpe Feimster, and, therefore, Paul F. Te All of the money and funds remaining,after the payment of debts, and cost of administration, were devised to Paul F. Feimster. All other property, which consisted of household and kitchen furniture, farming tools and utensils, was devised to Paul F. Feimster under the will and has been turned over to hime 8. Percy Sharpe Feimster did not have any life insurance on his life. WHEREFORE, having fully administered on the Estate of Percy Sharpe Feimster, the undersigned Executor prays that this report be accepted as his final settlement, that the same be audited and approved, and ordered recorded, and that he be discharged as by law provided.
