That she is the Executrix of Elliott J. Everhart, deceased, and that he at the time of his death, was the owner of the goods, wares, and merchandise and fixtures in a store building located on Monroe Street in the City of Statesville, North Carolina, the building being owned by E. A. Secrest. 2. That she is the owner of said personal property and has for the past several months partiaily operated said store, and that she is unable to further operate the same and that it is for the best interests of said estate fhet said personal property be sold. 3. That G has offered to pay her the sum of $9UU.UU in cash for said personal property and that said sum is all that the same is now worth, and more than it would bring if sold at public sale. WHEREFORE, petitioner prays the court to make an order authorizing and directing her to sell said personal property to the said Glenn Mayberry for the sum of $900.00 in cash. One of these lists shall be delivered to the widow, one to the personal representative, and one returned by the Justice, within 20 days after the assignment, to the Clerk of the Superior Court of the county, who shall file and record the same, and enter judgment against the personal representative, to be paid when the assets shall come into his hands, for any residue found in favor of the widow.
