In return for which the said Essie Estes-~-now Essie Bennett-- and husband Lee Bennett attempted to release all their right title and interest in and to lots nos. 1 and. 2. a8 above mentione and described, and executed and delivered unto the said Oscur and Ernest Estes quit claim deed to the above mentioned and heretofore described tracts of land. Your petitioner now respectfully shows to the court that at the time of the above agreemtnts, and at the time of the executing und deliver of the above and heretofore mentioned quit claim deeds, that the said Essie Estes-~-novw Essie Bennett was and still is an infant under the age of twenty one years, and by reason of this inability to make a binding contwact, the title which she attempted to give to the said Ernest and Oscar Estes was defective, and not a good and lawful deed to the said aand and for the purposes for which it was intended. R. W. Estes comes into open court and releases all his right title and interest in and to the above described tract of land which was conveyed to his wife, Margarest Estes, by ceed of D. L. McHargue, which deed is recor’ed ti deed book No. 29 at page 25 in the office of the register of deeds of Iredell county North Carolina, and asks the court to sive his interest in the lands above descrived to his three children, Ernest Estes, Oscur Estes, and Essie Bstes--Now Essie Bennett-- that they andieach of them may have the present use and en- joyment of same. The amended petition of the Plaintiff, filed by leave of Court, saith: lst. That Louisa M, Eudy, the widow of J. M. Eudy the intestate of plaintiffs, during the lifetime of her husband J, M. Eudy, separated herself and lived apart from her husband; and Plaintiffs are informed that the grounds of the said separation were that said Louisa became unlawfully intimate with another man than her husband. That shortly before the death of her husband and during his last illness as they are informed, she came to the home of her husband and was there at his death, but these plaintiffs verily believe that this conduct on her part was not for the bona fide purpose of resiming her marital relations and home with her husband, but was intended only as a cover, to remain there, and in the event of the ceath of her husband, obtain a years Support, and share in the distribution of the estate, and obtain dower; and they aver upon information and belief that she never did resume her relations and become restored to hir as a true and faithful wife Prior to his death, nor live with him as & wife at the time of his death. This cause coming on to be heard upon the petition and the amended petition of the plaintiffs above named, and it appearing to the Court that the summons has been duly sérved upon all of the defendants, and that they have failed to answer the petition and amended petition, It is therefore considered and adjudged that the facts set forth in the said petition and amended petition are true as therein stated, and the Court therefore finds that it is necessary for the plaintiffs administrators to sell the lands described in the said petition for assets, and that the proceeds arising from the said sale shall be applied by them to the payments of debts and in due course of adminis- tration. It is further considered and adjudged that the defendant Louisa M. Eudy, the widow of the intestate of the Plaintiff is barred of her right of dower in the lands of the said deceased and as set forth in this action for and on account of her separation and infidelity to her husband prior to his death.
