This Special Proceeding, coming on to be heard before me, upon the Report No.l of Hugene E.Gray,Commissioner ,dated April 4tn.1927,filed in this Court,and it appearing from Said Report that the three tracts of land ,described in the Petition herein,and in the former Order of this Court, gated December 6th.1926, were offered for sale on the theday of April 1927, first separately,and then as a whole,according to he said former Order of this Court, and that the whole of said land,containing 217 acres,more or less, were bid off by C.G.White at the price of Sixteen hundred and twenty five dollars ($1625.00) and it further appearing ,from said Report No.l of said Commissioner, that said price was in his opinion totally inadequate,and that the said Commissione@ recommended that the said sale be not confirmed,and that the said Commissionet recommended that he ,the said Commissioner be authorized,by an Or_ ter of this Court, to resell the said land,described in said Petition, in the manner set forth in the original Order of Sale,dated december 6th.1926,and for the purposes set forth in said Petition, and it appearing to the sat_ isfaction of this Court that said land should be re_ _sold,It is,therefore, CONSIDERED,ORDBRED,AND ADJUDGED that the Said Eugene £.Gray, Commissioner,be and he is hereby authorized and ordered to resell the said land ,describ_ _in said Petition,after due advertisement,at public auction, at the Court House Door of Iredell County,in Statesville,N. B, Rickert, and N, S, Gaither, guardian of Flossie Ellis and John Ellis, infants, and * * * + * %* + Flossia Ellis and John Ellis, ae Defendants, The plaintiffs, complaining of the defendants, allege:- Pirst, That Milton Ellis, late of Iredell County, died intestate in said County, prior to the institution of this action, and R, F, Gaither and F, B, Gaither have been duly qualified and appointed by the Superior Court court of said County as administrators of said intestate, and as such have entered upon the discharge of their trust. Second, That the defendant J, M, Rickert is indebted to the Dlaintiffs es administrators of said Milton Ellis, deceased, in the sum of Nineteen Hundred ($1900.00) Dollars, with interest at the rate of six per cent. per annum, payable annually from January lst. 1907, subject to credit hereinafter alleged, which is evidenced by note in words and figures, viz:- "$1900 At or before the first day of January 1908 we promise to pay Milton Ellis or order the sum of Nineteen Hundred Dollars for value recvived the same being the purchase money one tract of land known as the Milton Ellis tract lying in Iredell and Davie County, North Carolina, with interest from January the first 1907 at six per cent interest due and payable annually and the payment of this is secured by real estates mortgage deed of even date herewith, uO ! B, Rickert, executed and de— livered to plaintiffs’ intestate a mortgage deed bearing date the 28th day of August 1906, conveying the following lands, viz:- Lying and being in Iredell County and Davie County, beginning at stone near the barn running S. 67 E, 100 1/4 poles to a stone; thence North 130 to a stone on the Dank of the creek; thence across the creek to a stone; thence with the North bank of the creek 30 Po. to a stone; thence with the North bank of the creek to the Mt. branch, Varner's line; thence S, 50 1/3 W. 100 to Dan Stroud's corner; thence S, 107 1/2 Po.; thence N, 86 E, to the beginning, containing 160 acres more or less. Also another tract as follows:-Besinning at a stone R. 7., Hodgson's line near the North side of the road and running South 86 W. 11 ch. and 50 L. to 6 stones; thence North 7 ch, 12 L. to Black Gum in Milton Ellis line; thence North 83 East 11 ch, 57 L, to dogwood in Milton Ellis line; thance South 7 oh, 10 L. to the beginning, containing 8 1/8 acras more or less, That said mortgage was conditioned that in default of the payment of ssid note and interest, that said mortgage should become absolute and be foreclosed, Fourth, That said mortgage was duly probated and registered, as ap- pears in Book No, 24, pago 565, and the samo is hereby made a part of this complaint, m a = 80 6 1 Fifth, That plaintiffs are now the owners of said note and mort— gage as administrators of Milton Ellis, deceased; that said note is due and said mortgage has become absolute, and there still re- mains due and unpaid on sdid indebtedness the sum of $1900, with interest on same from the lst day of January 1907, until paid, and also interest on the interest which became due on the first day of January 1908, subject to said credit of $31.53, paid on the llth day of Nov, 1906, Wherefore, the plaintiffs demand judgment against the de- fendant J, M.
