Elliott, Kerley C. Blliott and wife, Lola W. Blliott and Henry Kerley Elliott, Winor. The plaintiff complaining of the defendant alleges: 2t. That Henry F. Elliott, died in Iredell County on the day of » 1922, having first made and published his last will and teatament, his said last will and testament being recorded in record of wills Book #8, pages #550, 551, 552 and 553, end. That at the time of the death of the said Henry F, Hlliott, ne was seized and possessed of the following described real estate, to wit: Beginning at a stake on the South side of the Raliroad in Simm Lola's line and running with Lola's line South two degrees West 55 poles to the Catawba river, said Lola's corner; tnence up the river 85 degrees West 524 poles to the H. F. Elliott's corner; thence with the Elliott line North 10 degrees Hast 34 poles to a stake on the South bank of the railroad; thence with the said railroad South 86 degrees East 24 poles and Hast 244 poles to beginning, containing 103 acres, more or less. It being the same tract of land conveyed to Henry #. Elliott, deceased, by W. A. Moore ani others, by deed recorded in book #50, page #62 of the records of the Register of deeds of Iredell County, North Carolina. ITie That the said Henry F. Elliott by item #4 of his last will and testament, devised unto Louise E. Woltz, one of ihe plaintiffs, a one half undivided interest in the said land; and by item ;74, also of his last will and testament, the saii Henry F. Hlliott devised to Kerley C. Wlliott the other one half undivided interest in the land, with the following conditions attached therewith: "A. ily son, serley C. Elliott has no child at the present time, but in event he should survive me and my said wife, and have any living child or children at the time, then I give this other half-interest in my estate, real and personal to my said son, serley C. slliott, to be his absolutely and without further limifiation or condition." "B. If, however, he should survive us both and still have no living child of his body, then I place this half- interest in the custody and control of tne First Security Trust Company of Hickory, N. ©C., as Trustee to handle, manage and conserve an& pay over the net income therefrom to my said ‘4 Aq u a y ‘y o u d C7 6 son from year to year, and m, said Trustee is authorized in its discretion to lake reasonable allowances to him out of the principal if his situation or needs should make this appear proper and desirable; then in the event he should later have a child or children of his body, upon the happening of this contingency I give and devise this half-interest to my said son fully and in fee,--the said trustee turning over to him whatever remains in its hands," "C. But if my said son Kerley should die before the deatn of my said wife Occurs, leaving any living child, or one born within the period of gestation and any such child or children survives my wife, then I give this Same half interest to such child, or children jointly, to be held and managed in their interest by the said First Security Trust Company as Trustee during their minority but the net income to be expended from year to year as far as necessary for the main- tenance and benefit of such child or children. But if my said son Kerley should never have any child or children born to him, or if for any other reason this half interest does not pass to him or any child of his under the provisions of Sub-sections A, B, and Co, Of this Will then upon the death of my said Son “erley, if he sure vives his mother, or if ne should predecease her and leaves no child gurviving at her death, then this said half interest I hereby give, devise and bequeata unto my daughter, Louise Hlliott absolutely and in fee." 4th. That the said Kerley C. Elliott, one of the esaid defendants in this action since the deatn of Henry F. Elliott, has married and of the said marriage has an issue, born alive, and the said child ig at this time living and is made a party to this proceeding. 5th. That Lula E. Elliott, one of the party defendants, is tue wife of denry F. Hlliott, deceased, and is living at the time of this instrument, and under the provisions of the will of said Henry +. Elliott, deceas 1, is a holder of a life interest in the land hereinabove described. 6th. That the parties Plaintiff are desiruous of Selling to the Statesville Brick Company, all of the clay fit and suit- able for tne manufacture of brick and other clay products, anc all of the minerals of every kind, together with the right and easenent to enter upon said tract of land, Qaving a periof of fifteen years from .ay 1, 1926, and during said period of time to dig ani remove the clay and dig for minerals and remove said minerals found on said land, together with the right and easement to pass and re-pass over said land during said fifteen years, with their teams, steam shovels, tractors or other machinery necessary for the removai of said Clay, and the mining and removal of said minerals; and to build such buildings as may be necessary and convenient, and build and maintain tracks, side or spur tracks and other roads or ways deeme. necessary and convenient for tue removal of said clay Or minerals. And the right to remove any and all buildings or other things of value placed upon tie land, at any time during said period of fifteen years, or within sixty days after the expiration of said term. Ath, 1939, and being heard upon the petition and affidavits filed in this cause by the petitioners and it appearing to the Court that the petitioners are tenants in comuon, seized in fee Simple and in possession of the lands described in the petition and that all of the petitioners are of legal age, except Lucile Elliott, who is represented in this action by her General Guardian, Robert W. Proctor, who was duly appointed as such guardian by the Clerk of the Superior Court of McDowell County, North Carolina, where the said Guardianship is pending; And it appearing to the Court that the lands described in the petition cannot be actually divided among the tenants in common without injury on account of the large number of shares into wiich the land would be divided and the fact that it is without buildings or other facilities to make a complete unit of farm lands, but that a sale thereof would be more advantageous to the petitioners than an actual partition; tm 5 2S 3 ~ o ~”n 9 CC 6 l And it appearing to the Court that James A. Signon and wife, Cora Sigmon, have offered to purchase said land for prompt acceptance at private sale for the sum of $1750.00 cash, upon delivery of the jeed and that the said offer is a fair and reasonable price for said land and as much or more than it wou.d bring if offered for _ at public auction and that the petitioners recomend and desire accept said offer and sell said land at private sale and it appearing to the Court that said sale is not unreasonable or injurious to the minor petitioner, but would be for the best interests of said minor ; It is, therefore, ordered and adjudged that the lands men- tioned and described in the petition be sold at private sale to James A. Signon and wife, Cora Sigmon, for the sua of $1750.00 cash and to that end, that lirs. Carrie Elliott McLelland be, and she is hereby appointed a Commissioner of this Court ind the said Commissioner is authorized and fully empowered to execute a deed conveying the said land in fee simple to the purchasers, upon payment of the purchase money. The widow is entitled to $500 out of the crop, stock and provisions of the deceased, and $150 additional for each member of the family under fifteen years old, as her year’s support. The commissioners shall make and sign three liste of articles assigned, stating the value of each, the number of the family, and deficiency to be paid by the personal represent- ative. One of these lists shall be delivered to the widow, one to the personal representative, and one returned by the Jus- tice, within twenty days after the assignment, to the Clerk of the Superior Court of the county, who shall file and record the same, and enter judgment against the personal representative, to be paid when the assets shall come into his hands, for any residue found in favor of the widow. In case there be no stock, crop or provisions on hand, the year’s support may be allotted by commissioners from the personal property of the deceased and also any debt known to be due him, and said allotment shall vest the said property in the widow and her right to collect said devt. That Yonroe Adams, Commissioner, shall, from the proceeds of the sale of this land, pay the costs of the sale of the land, including its part of the costs of this proceeding, and turn over to C. H. Dearman, Administrator of Lula K. Elliott, the remainder. The Administrator does not have any knowledge of any claims against the Estate other than those shown in this report. The Estate has a claim against the Receiver of Frank W. Elliott, which claim was filed by Mrs. Elliott prior to her death. In November, 1934, the Receiver filed a report with the Court showing that all money on hand had been disbursed to the creditors, and stating that there was no other prop- erty in the Receivership, except that the books of the Crescent Knitting Mill, Statesville, North Carolina, showed ten shares of preferred stock, par value #1,000.00, in the name of Frank W. Elliott. The Receiver further stated in the report that she had been unable to locate the Stock, and that Frank W. Elliott refused to give any information concerning it. Since that time the Receiver has collected around $400.00 in dividends on the stock, and a few weeks ago received information that the stock was assigned to Miss Ophelia Kerley. The Attorney for the Receiver is now making an effort to ascertain whether Miss Kerley has the stock, and whether the Receiver is entitled to the stock and to the dividends. In the event that the Receiver is entitled to the stock and the dividends, the Estate of Luja K. Elliott will receive a dividend on the claim filed in the Receivership, and in order that the same may be disbursed to the creditors of the Estate, the Administrator is not filing this as a Final Settlement, but is holding the Estate open until the “A RI N T “y o r p g q Le o l Receiver can ascertain who is entitled to the stock and dividends. I usually scan the list to see if any of my kith and kin are imong the law violators. Thursday morning I was some- what shocked when the list carried the names of sixteen persons, fifteen of whom had been convicted of driv- ing drunk, the sixteenth on a charge of hit and run. It seemed unusual that every single one of them was from the Same county, and a county which is supposed to be bone dry. The children’s choir, under the direction of Mrs. Simpson, rendered two numbers, “We Are Building,” by Hosmer, and Barearolle from Tales of Hoffman by Offenbach. Mrs. Kate Schell read the scrip- ture lesson which as followed by prayer led by Mrs. Blake Yoder, president of the society, and closed by Mattie Hooper of the cclored church, Mrs. Yoder ecnducted the business session, and after the call to wor- ship Mrs, Clarence Saunders +el- comed the visitors from the colored church.
