A. Elam have been paid. The Estate of R. 4. Elam was the owner of the note to R. A. Elam and the note to J. M. Stroud secured by the Deed of Trust in Book 69, page 121, Iredell County Registry. This Deed of Trust was foreclosed and title was Dlaced in R. W. Craft, Attorney. After paying the cost of the sale, the balance was not sufficient to pay the notes above held by R. 4. Elam state. The property was then sold to B. B. Kale and wife, and they gave back a Deed of Trust which is recorded in Book 102, page 214. This Deed of Trust was foreclosed, and title was then placed in Mrs. \. W. Craft, Yrs. Lillie Mae Hayes, Bessie Camobell, Clarence 3. Elam, and Mrs. Notra Yame Owens. The proceeds from these sales did not go into the “state, and it was not necessary for it to do so. The parties in whom the title was placed were the heirs of R, A. Elam, who were entitled to the same. This Estate is being held open as the following uncollected items remain: We. A. Elam, deceased, and the Answer to the Objections and Exceptions to the Report of said Administrator filed by Roy W,. Craft, Administrator of R. A. Elam, deceased and the Intervening Petition of Mrs. Bessie Campbell, Mrs. Notra Owings, Mrs. Roy W. Craft and C. B. Elam, the remaining children of R. A. Elam, deceased and the Court after hearing the evidence of all interested parties and the argument of counsel finds the following facts: I That Mrs. Bessie Campbell filed with the Administrator, Roy We. Craft, a claim for personal services rendered the said R. Ae Elam during the last three years of his life in the amount of $544.00; that Mrs. Notra Owings filed a claim with said Adminis- trator for personal services rendered the saic R. A. Elam during the last three years of his life in the amount of $544.00; that Mrs. Roy we Craft filed a claim with said Administrator for personal services rendered the said R. A. Elam during the last three years of his life in the amount of $500.00; That C. B. Elam filed a claim with said Administrator for personal services rendered the said R, A, Elam during the last three years of his life in the amount of $500.00; and that Lillie Mae Elam Hayes filed a claim with said Administrator for personal services rendered the said R. A. Elam during the last three years of his life in the amount of $1360.00; that said Administrator made proper investigations to ascertain the validity of said claims and after making said investigations paid the claims of Mrs. Bessie Campbell, Mrs. Notra Owings, Mrs. Roy W. Craft, and C, B. Elam by deducting the amount due by said claimants 9¢ 6 l to the estate of R. A. Elam from the amount of the claim filed and and allowed,declined to pay the claim of Mrs, Lillie Mae Elam Hayes in that the same was excessive and unreasonable; and the Court further finds as a fact that Mrs. Bessie Campbell, Mrs, Notra Owings, Mrs, Roy W. Craft and C. B. Elam rendered personal services to the said R. A. Elam during the last three years of his life and that same were reasonably worth the amounts paid by said Administrator; that Mrs. Lillie Mae Elam Hayes rendered personal services to the said Re A. Elam during the last three years of his life but that the claim of $1360.00 filed by the said Mrs. Lillie Mae Elam Hayes was excessive and unreasonable and that said Administrator was justified in declining to pay said claim. II That after making further investigation ana discussing the matter with the other children of R, A. Elan, deceased, said Administrator found that a reasonable amount to be paid the said Lillie Mae Elam Hayes for services rendered the said R, A. Elam during the last three that the said Lillie Mae Elam Hayes on the 9th day of July, 1937 accepted the said $700.00 &as settlement in full of all her claims for personal servicesagainst the estate of R, A, Elam and agreed that the said $700.00 be applied as a credit on the indebtedness due by her to saia estate and executed a receipt in full to the saia Roy W. Craft, Administrator; and the Court further finds as a fact that the said Lillie Mae Elam Hayes was indebted to the estate of R, A. Elam in an amount in excess of #700.00 andis now indebted to said estates and the Court further finds as a fact that the sum of $700.00 was a fair and reasonable Sum to be paid the said Lillie Mae Elam Hayes for the services rendered the said R. A. Elam during the last three years of his life. 4a : That Power of Attorney was executed to Roy W. Crart by all of the Children and heirs-at-law of the said R. A. Elam authoriz- ‘V y we l d 9¢ 6 l ing and directing the said Roy W. Craft to sell the lands belonging to the said R. A. Elam subject to the indebtedness due by said estate and distribute the proceeds according to law. IV That at the time of filing said Report, the said Roy W. Craft made no actual exhibition or receipts of evidences of payments of claims to the undersigned Clerk of the Superior Court, but that same were tendered to said Clerk and were filed with and examined by the Clerk of the Superior Court of Iredell County prior to the hearing of this cause. V That Koy W. Craft, Administrator of the Estate of R. A. Elam, is a man of character, honesty, ability and soundbusiness judgment and that he has acted in good faith in the discharge of his trust and that the payments made to the children of R. A. Elam, other than Lillie Mae Elam Hayes were not made, designed, or connived for the purpose of nullifying or partially nullifying the settlement made by the said Administrator with the said Lillie Mae Elam Hayes, but were made in good faith and that the claims were valid claims against the estate and that the handling of same by said Adminis- trator was proper and correct in every respect and to his best judgment. VI That the annual report filed by said Administrator sets forth fully his transactions as Administrator and as Attorney in Fact and that while in this respect same is irregular that said irregulari- ties are harmless and do not effect the validity of said report as to his transactions as Administrator and the Court further finds as a fact from the evidence that said Administrator at the proper time will file separate reports disclosing his transactions as Administrator and as Attorney in Fact. VII And the Court further finds that said Objections and Exceptions to the Report of said Administrator should be dismissed and that the Report of Roy W. VIL That all debts due by the estate of R. A. Elam, decessed, have been paid and Re W. Craft, Administrator of the estate of Re Ae Elam is now ready to file his final accounte VIII That Mrs Bessie E. Campbell died intestate and Mrs. Ralph Gaither duly qualified and was appointed Administratrix of the estate of Bessie E. Campbell on July 20th, 1959 and is now actively engaged in the discharge of her duties. IX That A. Elam, widow of Se Ge Elam, is entitled to dower in said land and tuat she asks that she be paid for ner interest in said land in money out of the proceeds from tie Sale of said land, and for this purpose tue court finds as a fact and so adjudges that sne is entitled toa dower interest in said land and that ner age is 70 years, and tiat her interest in one-third of the proceeds of said sale, after tie payment of all costs and expenses to be 39.06 per cent, which amowt shall be paid to her for her absolute dower interest in said land. And it further appearing to the court that the personal estate Elam is insufficient to pay tne indebtedness of said estate, it is tuerefore considered, ordered and adjudged that the proceeds arising from the sale of said land be, and the same is hereby constituted assets with which to pay tne indebtedness against the estate of S. G. Blam and the costs of administration; and that the amounts going under the decree of this court to said J. H. Slam, Admr. of S. G. Elam, be paid to him by the Commissioners of sale nerebofore appointed, And it furtner appeabing to the court that since tne institution of tnis proceeding ror assets to pay the debts of S. G. Zlam's estate and for partition that J. 2. Slam died intestate, and that Janie ¥. Elam, nis widow, nas qualified as Administratrix of the estate of J. R. Elam and tuat uis neirs-at-law have been duly made parties plaintiffs or defendants to this proceeding: It is tuerefore considered, ordered and adjudged tiat whatever amount may be due the estate of J. R, Elam, after the payment of the debts and costs of administration of the estate of S. G. Elam, be paid to tne said Janie #, Elam, Administratrix of J. Re Elam, and tat the same is hereby constituted assets within ner hands with which to pay the indebtedness of said estate of J. R. Slam and the costs of administration.
