E, Dulin, decessed, by Annie Dulin, adninistratrix The petition of Annie Dulin, administratrix of W. ©. Dulin, deceased, showeth:— (1) That it would best subserve the interests of the heirs at law and creditors of the estate of said W. ©, Dulin, to sell the personal property belonging to said estate for cash, because said property would sell for about the same in cash as on a credit of six months, and because, moreover, the majority of the bidders proposed at any EpmpMaMR sale will probably be anable to give solvent bonds. (2) That said property consists largely of cotton, wheat, corn and other property, which is at the present stored in the mill building of the Railroad Phour Mills owned by Dr. J. J. Mott and others, which mill the said W, E, Dulin had been operating for some time prior to his death; that your petitioner will have to pay rent for the storage of said property in said building and she has no other place to store the same; that she regards it for the best interest of the estate and creditors to sell said property as early as practicable and convert the same into cash, (3) That your petitioner regards it for the best interests of said estate and the creditors and distributees to sell said cotton at private salo for the reason that to sell same on a day certain pursuant to notice required by law might deprive your petitioner of the benefit of any sudden rise in the market price which she could at private sale avail herself of. L. Dulin was living with your petitioner at the time of his death and where your petitioner has been living since his death, That the other two lots deseribed in paragraph two are not in the city of Statesville, but are situated sone distance out in the Country and sre not nearly as valuable as the said house and lot in States— ville, That, said house and lot in Statesville is worth, upon a air valuation, three-fourths if not four-fifths as uch as the whole of said three several lots, Pourth:— That under the laws of North Carolina your petition “ the said Annie Dulin as the widow of the said W. FE, Dulin, is entitled to an estate for her life in One-third in value of all ths lands deseribed in paragraph two hereof, in which third part shall be included the ssid dwelling house in which her husband resided at the time of his death together with outhouses, buildings and inprovanents thereunto belonging or appertaining, That because of the peculiar situation and cirounstanees in this case, the said aM ‘u l j n g S0 6 l dwelling house and lot in Statesville being the most valuable of any of the several lots and doing worth three-fourths or four-fifths as much as the entire land of said intestate, it is highly imprac— ticable and practically impossible for the Court to assign by metes and bounds and allot to your petitioner her dower in ssid lands in the usual manner in such cases, That an assignment of her dower by motos and bounds and an allotment of the same to her in the corpus of the lands would of necessity result in a division or a cutting in twain of the said dwekling house and lot, which would result in the reckless and unreasonable destruction of the value of said property cic ‘rould rocult in the great damage of your petitioner as well as to the defendants, heirs at law of said intestate. FPifth:— Your petitioner the said widow avers that it would be more advantageous to her and to the defendants for the Court to decree a sale of said land and that out of the proceeds arising from said sale the court shall ascertain the present cash value of one-third of said lands as provided »y law and pay the sam2 to her in this proceeding, as her dower interest in said lands, And she alleges that as a matter of right she is justly entitled to a sale of said land in view of the circumstances herein alleged and to have the relief hersin sought. t there is no other way »by which she can obtain the Just and adequate valuo of her dower estate in said lands as botwveen herself and the defendants. Sixth:- Your petitioner further avers that thers is a mortgages for the sum of $300.00 on the first lot of said land above described, made by ths said W, EF, Dulin and herself to the First Building & Loan Association of Statesville, N. C., dated Oct, if, 1905, which is due and unpaid, as That there is also another mortage on the said lot made to the said First Building & Loan Association by Mrs. Rachael C, Shelton before she sold the said lot to said W, E, Dulin, dated Nov, 2, 1902, for the sum of $300.00, which said mortgagemg is a lion upon the said land, and due and unpaid. That thereis a mortsage for the sum of $200,00 on the 55 acre tract, made by W. F. Dulin and wife to J, C, Sullivan dated April 10, 1905, due and unpaid. P, Dulin and Annie Dalin, heirs at law of W. &, Dulin, FE E SE he eS Hw deceased, This cause coming on to be heard before the undersigned, Clerk of the Superior Court of Iredell County, upon the petition of the Plaintiff and the answers of all the defendants and it appearing to the court that the summons in this cause has been duly issued and served upon all the defendants a8 prescribed by law; that a guardian appointed by the court to represent the said Annie Dulin, infant defendant, and t, ad litem has been duly hat the summons and copy of peti- tion has been duly served upon such guardian ad litem and that said guardian ad litem has filed an answer to said petition for the said infant, and it further appearing to the court that ment of said guardian ad litem, W. M, Dulin, after the appoint— the father of said in- fant defendant had himself duly appointed and qualified by the court &s the general guardian of the said Annie Dulin and that the said W. M. Dulin as general guardian has also filed an answer for said infant defendant in this cause, And it also further appearing to the court from the answers of the defendants filed, that said defend- ants protest against a sale of the lands described in the petition for dower, and that they also object to a sale of said lands by the Plaintiff as administratrix until first said administratrix exhausts the personal estate of said intestate in the payment of his debts, except that part of same which the said Plaintiff is entitled as her year's support, and it further appearing to the court that the plaintiff and the defendants and their counsel of record have agreed upon terms of compromise as follows:~ (1) That the plaintiff, irs. E, Dulin lived at the baick Mucky bua, whpen Csaba nis ne di ass a pac fea (2) That out of the pérscnal estate of said intestate the time of his death and where the said widow now resides, yh Rees said Annie Dulin, widow, shall have and receive to her own use ab— solutely the sum of Three Hundred ($300.00) Dollars in money as her year's support, and that she shall have the same by authority of this decree without any further proceedings to assign the same, (3) That the residue of said personal estate, or so mch thereof as may be necessary, shall be applied by the said plaintiff as administratrix to the payment of all costs and charges of adnin- istration, and then to the payment of all valid and just debts against said estate, first paying all debts not secured by mortgage on the said lands, and then the reside or so mich as may be necessary shall be applied to the payment of the debt secured by mortgage due the First Building & Loan Association of Statesville and to the debt secured by mortgage due J, C, Sullivan, and if there is not sufficient funds arising from the personal estate, after deducting the widow's year's allowance as aforesaid, to pay off and discharge all costs and charges of administration and all valid and outstanding debts against said estate, then the es ee agree upon awe of the said administratri t to advance to her a sufficient amount in money to pay off and discharge the resideu of said indebtedness, and in the event the said defendants fail or refuse to advance to said administratrix sufficient money to pay same upon demand, the defendants hereby agree that the Clerk of this Court upon a motion in this cause, after ten day's notice to the defendants, may grant the said administratrix an order of sale, authorizing her to sell said lots of land described in thespetition in this cause, exclusive of said house and lot given the widow as her dower, or so much thereof as may be necessary to make assets to pay off and discharge the residue of said indebtedness, Now, therefore, it is, by consent of the plaintiff and de- fendants and their counsel, considered and adjudged by the court that this prooeeding for the sale of said lands be Mpoontinued for the present; that the plaintiff Mrs, Annie Dulin, widow of W, E, Dulin, deceased, have and take by authority of this decree and by consent of all the parties hereto, and hold for the term of her natural life as and for her dower in the lands of said W. E. Dulin, deceased, the lot of land described in said petition and described as follows:~ Lying in Iredell County, State of North Carolina, ad- joining the lands of K. L, Gill and others, situated in the city of Statesville on the corner of Sharpe and Mulberry streets, bounded as follows:— Beginning at the junction of Mulberry and Sharpe streets in the city of Statesville, running with Sharpe street 150 feet to a stake Mrs. Gill's corner; thence North 21 degrees West 65 feet to a stake Mrs. Gill's corner; thence North 68 degrees East 150 feet to a stake on Mulberry street; thence South 21 degreos East 65 feet to the beginning, containing one-fourth of an acre more or less, It is further considered and adjudged by the court that the said Mrs, Annie Dulin, widow, have and take and hold to her absolutely out of the personal estate of said intestate the sum of Three Hundred ($300.00) Dollars in money as and for her year’s support as provided by law, and that she have the same by authority of this decree without any further proceedings to assign the same, It is further considered and adjudged by the court that out of the residue of said personal estate the said plaintiff as administratrix shall pag all costs and charges of administration first, then the residue or so much thereof as may be necessary shall be applied by said administratrix to the payment of all valid debts against the estate of said intestate, first paying off and discharging all debts not secured by mortgage on the land, and then the said mort- gage debt due the Pirst Building & Toan Association of Statesville, and the said mortgage debt due J, C, Sullivan shall be paid off and discharged by said administratrix; and in the event the said personal estate is insufficient to pay off and discharge all costs, charges, depts and mortgages, and in the event that said defendants shall fail to advance to said administratrix the amount of such deficiency as aforesaid, it is hereby considered and adjudged that the said plaintiff as administratrix shall,upon motion in this cause, after ten day's notice to the defendants, have an order of sale, authorizing her to sell said land described in said petition, outside of the lot herein allotted to her as her dower, or so mich thereof as may be necessary, to make sufficient assets to pay off and discharge fully said indebtedness, It is further considered and adjudged by the court that all papers in this proceeding be recorded in the minutes of special proceedings in the office of the clerk of the Superior Court of Iredell County, and that said clerk certify this decree to the Register of Deeds of Iredell County to the end that the same be registered in the record of deeds in said county.
