That on May 25rd, 1929, MeD. Holderby was duly appointed general cuardain of Frances Maxwell and Sarah Maxwell by M.T,. Holderby, cuardian as aforesaid, and thet saia suardian has duly executed his bond as such anda entered tpon the discharge of the duties of his offices II. Dulin, executor as aforesaid, on or about the 10th day of January 1929 instituted an action in the Superior Court of Iredell County for instructions and interpre- tation of said will and upon the coming on of a hearing of the said cause, upon the prayer by the executor for instructions and interpretations of said will, it was ordered, adjudged and decreed by the court that the executor should set apart an amount he deemed sufficient for the education of Sarah and Prances Maxwell, including their maintainance and support during the period that they were being educatéd, and after setting apart a sufficient amount for such purposes, that the estate should be divided ecually samonm the neices and nephews including Sarah and Brances Maxwell, with the exception of Paul Lentz and Ralph Lentz, two of the nephews of CeA. Dulin, executor as aforesaid, neglected, failed, and refused to make a proper allowance for the education, maintainance, and support of Frances Maxwell and Sarah Maxwell, and neglected, failed and refused to set apart sufficient for the education, maintainance and support or to set apart any amount whatsoever, and the Honorable John M. Oglesby, resident judge of the 15th judicial district of the Superior Court of North Carolina did on June 11, 1950 assume jurisdiction of said matter and issued a citation to the said PeP. Dulin, executor, as aforesaid, requiring the said P.eP. Dulin to appear before the resident judce on June 16th, 1930 at Two O'clock at Charlotte, North Carolina, and show cause why the allowance to Frances Maxwell and Sarah Maxwell should not be made and why reports as such executor should not be filed according to law, and upon the coming of the hearing the said PeP. Dulin was ordered and directed to pay an allowance to the said Frances Maxwell and Sarah Maxwell for their education, maintainance, and supporte ‘V v OD cu l r n g VI. That thereafter on motion of MeDe Holderby, legal guardian of Frances Maxwell and Sarah Maxwell, an order was entered permitting said fsuardian to intervene in said cause then pending before said resident judge and said guardian duly filed his intervening Petition for the said Frances Maxwell and Sarah Maxwell, in which said intervening Petition it was requested that the court exercise its eouitable jurisdiction and declare such sum as it deemed proper as an education and maintainance fund for the said Frances Maxwell and Sarah Maxwell and declare the said amount to be a specific lien against the estate of CeA. Dulin and that said sum be set apart as an ecucation and maintainance fund for the said Frances Maxwell and Sarah Maxwell in that the said P.P. Dulim, executor, as aforesaid, had failed and refused to exercise his discretion in the perfommance of said duties and that said executor be removed from office and a receiver appointed for said estatee Vile That various hearings have been had before the resident judge of the Eleventh Judiciai District, one at Marion, North Carolina, and one at Condord and the said executor at the hearing in Charlotte, North Carolina, was ordored and directed by the resident judge to pay the said Frances Maxwell and Sarah Maxwell toward their education and maintainance a specified sum each month until further order of the court, and that said matter is still pending and subsisting before said resident judge and that said Petition is now pending before said judge in respect thereto and said resident judge has assumed jurisdiction in said proceedings and that the Clerk of the Superior Court of Iredell County does not now have any jurisdiction in the premises and that the issues raised therein be submitted to the court for its determinatione VIII. That the total personal assets of the estate on hand in the account of the Administrator and the total receipts of said Administrator are the sum of $308.78, and that said funds are on deposit at the First National Bank of Mooresville, Moores- ville, North Carolina; that the Administrator has made no disburse- ment from said estate pending sale of interest on real estate owned by said decedent. 2. That the decedent was seized of a one-third (1/3) interest in a parcel of real estate in Mooresville, North Carolina and the Administrator has caused petition in a special proceeding to be filed in the Superior Court for sale of said real estate for division among the several tenants in common and for providing additional assets to apply against debts of the decedent, and also to determine the interest of the several creditors in the estate of Margaret Lou Dulin. 3. That said special proceeding is now pending before the Clerk of the Superior Court and a resale of said property was held of the 13th day of July, 1966. 4.
