The widow is entitled to ¥30K out of the crop, stock and provisions of the de€eased, and $$6M additional for each member of the family under fifteen years old, as her year’s support. The commissioners shall make and sign three lists of articles assigned, stating the value of each, the number of the family, and deficiency to be paid by the personal represent- ative. One of these lists shall be delivered to the widow, one to the personal representative, and one returned by the Jus- tice, within twenty days after the assignment, to the Clerk of the Superior Court of the county, who shall file and record the same, and enter judgment against the personal representative, to be paid when the assets shall come into his hands, for any residue found in favor of the widow. In case there be no stock, crop or provisions on hand, the year’s support may be allotted by commissioners from the personal property of the deceased and also any debt known to be due him, and said allotment shall vest the said property in the widow and her right to collect said debt. Downum, which covered the balance due On the purchase price of land sold by G. F. Downum to Mr. Tharpe; that these notes have not all matured and have not yet been collected and, due to the existing economic conditions generally which have prevailed throughout this state for the past few years, the collections on these notes have been slow; that, in the opinion of your petitioner, it Will take at least two years, or more, yet to effect final collection of these notes. The notes are the value of which is far in excess of the amount of the notes. The final settlement of the estate, therefore, cannot be made until all of these notes are collected, Iv. F. Downum, and it appearing to the Court that all the assets of the estate heve been con- verted into cash, with the exception of the claim against the Receiver of the First Nationeal Bank of Statesville, North Carolina, in the amount of seven hundred fifty dollars and sixty-four cents ($750.64); it further appearing to the Court that it would be to the interest of the heirs at law of the estate to sell the aforesaid claim, so as to permit the Admin- istrator to file ea Final Settlement, and make a final distribution; it further appearing to the Court that the Administrator had already received twenty-three and one-half per cent dividend on this claim, and that he has received a bone fide offer from C. Downum Estate, to me as Administrator c.t.a. of the Susan §. Downum Estate. It was necessary to pay the funeral expenses, and other costs in that estate, and there was not sufficient funds with which to do it. It will also be noted that Mrs. Susan S. Downum, prior to her death, received some money on her share out of the receipts collected. The sum of $2312.45 was collected from J. A. Tharpe. These notes represented the belance of the purchase price of real estate, which was held by G. fF, Downum and wife, at the time the sale was made, as an estate by the entirety. Hence, Susan §. Downum, when these notes were collected, would have been en- titled to one-half of the proceeds of the collection from J. A. Tharpe. See Turlington vs. Lucas 186 N. C. 283. Since, however, the heirs are the same in both estates, no further vortion of the collection on the Tharpe notes was divided, and the distribution is being made through settlement in the G. F. Downum had an account in the insolvent First National Bank of Statesville, North Carolina, in the a- mount of Sixty-one Dollars and Forty Cents ($61.40), which account has been designated by the Receiver of the First National Bank of Statesville, North Carolina, as Claim No. 362; that all dividends which have been paid on this claim have been paid to E. W. Downum, Administrator of Susan S.
