Sec, 1399—Every executor, administrator and collector shall, within twelve months from date of his qualification or appointment, and annually, so long as any of the estate remains in his control, file, in the office of the Clerk of the Superior Court, an inventory and account, under oath, of the amount of property received by him, or invested by him, and the manner and nature of such investment, and his receipts and disbursements for the past year in the form of debit and credit. He must produce vouchers for all payments. The Clerk may examine on oath, such accounting party or any other person concerning the receipts, disbursements or any other matter relating to the estate and having carefully revised and audited such accounts, if he approve the same, he must endorse his approval thereon, which shall be deemed prima facie evidence of correctness. This cause coming on to be heard, and being heard upon the duly verified Petition of J. M. Davis, Administrator of the estate of J. Madison Davis, and it appearing to the Court: we That all of the debts of the estate of J. Madison Davis have been paid, except the debts set forth in the Petition, which are owed to relatives of the said J. Madison Davis. iin That J. Madison Davis, deceased, owned a considerable amount of real estate and that in order to pay the debts and settle the estate, it will be necessary to sell a large part, if not all, of this real estate, and that it would be to the advantage of the heirs if an extension was granted for the Administrator to sell this real estate and to complete the administration of the estate. «Ze It further appears to the Court from the Petition and from the statements of J. M. Madison Davis was seized, in fee simple, of the following described lands: Tract No, 1. Situated in Statesville (outside) Township, tredell County, N. C., and lying and being on the Fast side of Lincoln hvenue, and being Lot No. 50, as plotted and mapped on the map of the property of ', N. White filed and recorded in the Office of the Register of Deeds of Iredell County in Book 54, page 601, said lot being 40 feet by 146 feet. For further description see Deed from Sarah J. Charlton to Hinton Jones and wife, Lillie Jones, recorded in Negister of Deeds! Office of Iredell County in Book 79, page 16, This is the identical land conveyed to J. wm, Davis by deed of Hinton Jones and wife, dated January 6, 1925, recorded in Book 79, page 28, Iredell County Registry. This lot with the dwelling on it is worth about $225.00 Tract No, 2, Lying in the City of Statesville, Iredell County, North Carolina, and particularly described as follows: Beginning at an iron stake Overcash's corner on Wilson Street; thence Northward with Wilson Street 94 feet to an iron stake, D. D. Little's corner; thence Westerly and parallel with D. D. Little's North line 150 feet to a stake; thence South 94 feet to Overcash'g corner; * thence Hast with Overcash's line 150 feet to the beginning corner on Wilson Street, being a part of lots 8 and 9 in Block 2 in Bloomfield. See deed from J, A, Pippin and wife to k, L. Phifer, This is the identical land conveyed to J. M. Davis by deed of &. L. Lying and being in Statesville ( outside) Township, Iredell County, North Carolina, in the Poplar Branch section on the Jest side of the Branch, adjoining the lands of Ben Wilhelm, Mershall W. Huggins, and others, and particularly described as follows: Beginning at a stake on the branch, J. A. D. Stephenson's corner and running thence North 87 degrees West 165 feet to & stake in Ben Wilhelm's line, Marshal W, Huggins' corner; thence South 3 degrees Vest 160 feet to a stake; thence North 87 degrees West 55 feet toa Stake, Huggins’ corner; thence North 3 East 160 feet to a stake in Ben Wilhelm's line, said Huggins' corner; thence North 87 degrees West 110 feet toa stone, Nancy Bryant's corner; thence South 8 Rast 16 poles to a stake in Ben Wilhelm's line, Nancy Bryant's corner; thence South 87 East 20 poles to the branch, Wilhelm's corner; thence up the branch with the meanderings of the same North 8 West 16 poles to the beginning, containing 1 3/4 acres, more or less, This is the identical tract of land conveyed to J. Lying and being in Statesville (outside) Town- ship, Iredell County, North Carolina, on the West side of Rickert Street (known as Daniels Avenue), edjoining the lands of P. Dobson, A. Nesbit, Tract No, 5 of J. M. Davis hereafter described, and particu- larly described as follows: Beginning at an iron pin on the West side of Rickert Street (known as Daniels Avenue), and running thence with the North side of an alley North 83 West 100 feet to the southeast corner of the tract described in this proceeding as Tract No. 5; thence with the eastern line of Tract No. 5, North 5 Rast 56 feet toa stake, the northeast corner of Tract No. 5; thence with A. Nesbit's line South 83 Rast 100 feet to an iron pin on the West side of Rickert Street (known as Daniels Avenue), A. Nesbit's corner; thence with the Yest side of Rickert Street (known as Daniels Avenue) South 5 West 56 feet to an iron pin, the beginning point, and being the Eastern part of the lot conveyed to J. M. Davis by deed of A. Nesbit and wife, dated September 20, 1926, and recorded in Book 92, page 50, Iredell County Registry. A Nesbit and wife, by deed dated June 9, 1924, and recorded in Book 77, page 139, conveyed to J. M. Davis, a tract of land, which, according to a survey, contained the tract above described, but it also appears that the deed in Book 92, page 50 conveys a tract which covers the tract in the deed in Book 77, page 139, and also an additional lot to the West of said lot. The above tract is described according to a survey and plat made by R. L. Crawley, C. H., on June 26, 1936, and the ebove tract and Tract No. 5 make up the tract of land described in the deed in Book 92, page 50. The following is contained in the deed to J. M. Davis, recorded in Book 92, page 50, and is made a part hereof, viz.: "It is further agreed and understood that the said J. M. Davis and his heirs and assigns are to have the use of a well dug by the said J. M. Davis and 4, Nesbit. The right to use said well is to run with these lands. The well is on the line between the above lands and the lands now owned by A. Nesbit." The well seems to be on the line of the above lot and the Nesbit lot on the North, but the above deed seems to give the use of said well to all the land in said deed, and, therefore, the owner of the lot on the “est of the above lot, described herein as Tract No. 5, and it is, therefore, made a condition herein that the owner, his heirs and assigns, of Tract No. 5 shall have the right to use said well, and the right to use said well shall also run with the land described in this proceeding as Tract No. 5, as fully as provided by the terms of the deed in Book 92, page 50. A Nesbit and wife, by deed dated June 9, 1924, recorded in Book 77, page 139, conveyed to J. M. Davis a tract of land which, according to the survey by R. L. Crawley, C. E., cowered a part of the above tract of land, but the deed in Book 92, page 50, conveys a tract of land which covers all the land conveyed by the deed in Book 77, page 139, and also additional land. The deed in Book 92, page 50, therefore, conveys a tract of land which contains the above described tract and Tract No, 4. The above description is according to a survey and plat made by R. L. Crawley, Cc. £E., on June 26, 1936. There is a well on the line of Tract No. 4, and the A. Nesbit lot, and the use of the said well shall run with the above lot, and the owner, his heirs and essigns, of the above lot, shall have the right to use said well, as fully as provided by the terms of the deed in Book 92, page 50, which is in the following words, viz.: "It is further agreed and understood that the said J. Y. Long, as security for the payment of the note above set forth, the lands described in this proceeding as Tracts Nos. 2, 6, 7, 8, and 13, and this mortgage is a prior and specific lien on Tracts Nos, 2, 6, 7, 8, and 13. wie. Madison Davis and their respective husbands and wives make themselves parties petitioner to this proceeding for the purpose of agreeing and consenting to the sale of the lands herein described, and barring any right, claim, or interest on their part in the lands herein described. «Lbs That F. Long makes himself a party as mortgagee, and agrees and consents to the sale of Tracts No. 6 and 13 at the price herein set forth, and agrees to faithfully perform the recitals and agreements on his part herein contained; that he also joins with the other petitioners in the prayers hereinafter made YHEREFORE, the petitioners pray: 1. That the Court meke an order that all of the lands herein described be sold at private sale. 2. Theat J. M. Davis be appointed Commissioner to make a sale of said lands at private sale and to execute deeds therefor under the orders of this Court; that the Commissioner be required to report all bids he received upon each and every tract of land herein described, and that the sale of said lands be made subject to the confirmation of the Court; that the Court follow the recommendations of the Commissioner in confirming or rejecting any sale made by the Commissioner. 3. That J. M. Davis be appointed Commissioner to make and execute a deed to James L. VicCoy, his heirs and assigns, upon payment of the sum of three hundred fifty dollars ($350.00), and every pert thereof, conveying to said purchaser or his assigns, in fee simple, the land described herein as Tract No. 6. 4. That J. M. Davis be appointed Commissioner to make and execute a deed to I. &. Johnson and wife, Blanche Johnson, their heirs and assigns, upon payment of the sum of three thousand dollars ($3000.00), and every part thereof, conveying to said purchasers or their assigns, in fee simple, the land described herein as Tract No. 13. 5, That out of the sale price of Tracts Nos. 2, 6, 7, 8, and 13, the Commissioner shall first pay the cost of the sale of said land uo s i p e y ‘f ‘S t a k Ic 6 l and all taxes that are a lien thereon, and then pay the remainder to J. Long, as mortgagee, has joined himself as a party in this proceeding, and prayed for the sale of said land at private sale; that F. Y. Long, as mortgagee, hes also agreed and consented and prayed that Tracts Nos. 6 and 13 be sold at private sale for the amounts set forth in the petition. That the heirs-at-law of J. Madison Davis have made themselves parties to this proceeding, end joined therein for the purpose of asking that the lands described in the petition be sold at private sale to create assets to pay debts and costs of administration, and that Tracts Nos. 6 and 13 be sold at private sale for the amounts set forth in the petition; that the heirs-at-law of J. Madison Davis also prayed that in the event it is not necessary to sell all of the lands to pay the debts and costs of administration that all of the lands be sold, as they desire to hold their interests in said lands in money. ote That the amount due and unpaid on the mortgage of F. Y. Long is twenty-seven hundred seventy-eight dollars and thirty-one cents ($2778.31), with interest on this sum at the rate of six per cent per annum from 17 May, 1950, until paid; that F. Y. Long has agreed, as set forth in the petition, that upon payment to him of the sale price of the tracts upon which his mortgage is a lien, after first deducting the taxes and proportionate costs of this proceeding, he will execute a release fully discharging from the lien and operation of the mortgage the tract or tracts of land for which he has received the purchase money; that upon payment to him of a sufficient amount to pay his mortgage in full, he will cancel it, and deliver the note and mortgage to the Administrator. itu That it is more advantageous for the heirs-at-law and the creditors of the estate of J. M. All of these shares have been transferred to Mrs. Nancy S. Davis by the Executrices. At the death of Dr. Davis, according to the records of the Southern Railway Company, he was the owner of ten shares of stock. The certificate for five shares of this stock has never been located. Since his death, the Southern Railway Company has issued dividend stock of 1-1/2 shares for each share then owned, These 25 shares of stock have been transferred to Mrs. Nancy S. Davis, beneficiary, The estate owned four shares of Preferred Stock in North Carolina Enterprises, Inc. This stock is of doubtful value, but if found to have any value, will be transferred to Mrs. Nancy S. Davis. Davis. In the box were found numerous private papers and documents owned by Dr. Davis and were retained by him as records and appear to be of no particular value. In the box was found $130.00 in gold coins, $37.00 in currency and $1.21 in change. This money was left in the box and the keys to the lock box have been delivered to Mrs. Nancy S. Davis, as the beneficiary, and the Bank has been informed that Mrs. Davis is the sole owner of all of the property located in this box. Miss Lillie Norket and Mrs. Nancy S. Davis make no charge for commissions for any services rendered, Provision has been made for the payment of Miss Elizabeth Hill's fee, in lieu of cdmmissions, in this settlement.
