Davidson, deceased, Mrs. Fannie Davidson, Robert Lee Davidson Jr., by and through Decree Vonfirming Sale his next friend, John R.McLaughlin, and D.L.Raymer, trustee for Robert Lee Davidson Jr., ex perte This proceeding again coming on to be heard, and it appearing that the said D.L.Raymer, Commissioner heretofore appointed by the Court to sell the lands described in the petition in thés ceuse, sold said lands to Mrs. Grace Devidson, at private sale, on the l6éth dey of August, 1938, for the sum of Nine Hundred Fifty ($950.00) Dollars, cash, less the present cash value of her life estate in one-third thereof as calculated under the mortuary tables of North Carolina, and it apperring to the Court that said sale was in all respects duly and properly conducted and made, and that the price offered was and is just and reasonable, and the fair value of said land. It is therefore ordered, adjudged, and decreed that the said sale be,end it is hereby, in all respects confirmed, and that said D.L.Raymer, Commissioner, upon the vayment of the purchase money and every part thereof, shall execute and deliver to the said purcheser and her heirs end assigns, ea deed in fee simple for said lands, and efter first paying the cost of this proceeding ,to-wit, $35.93, shall pay to Mrs. Grace Davidson the present cash value of her life estate in one third of the net proceeds of the sale of said lands as calculated under the mortuary tables of North Carolina, which the Court finds to be $186.15 and shell pay the remainder of the proceeds of said sale to D.L.Raymer, Executor of the Will of K,.L.Davidson, who shall apply such emount thereof to the payment of the debts of the said R,L.Davidson end charges of administration es the per- sonel estate shall be insufficient to pay, and shall hold the surplus, if any there be, as guardian and trustee for Robert Lee Davidson Jr. in accordance with the terms of the will of the said R.L.Davidson, deceased. That at the time of her death the said Minnie Josey owned an undivided One Forty-second interest in the land above described subject to the dower right of Mrs. F.E.Davidson as is hereinafter set forth; that she left no personel property and that the outstanding indebtedness against her estate is about $100.00 as far as can be ascertained at this date; and that a sale of her interest in said real estate will be necessary to pay said indebtedness and the cost of administering her estate. 5. That the petitioner, R.J.Plott, surviving husband of Mrs. M. J. Plott, makes no claims to curtesy in the One Sixth undivided interest in said land owned by his said wife at the time of her death for the reason that she died during the lifetime of H.C.Davidson, he held said land as tenant by the curtesy from the death of his wife, Sallie R. Davidson, in 1880 until his death in 1920 and therefore theg said M.J.Plott was never in actual possession of her said interest in said land during her lifetime; and that the said R. J. Plott voluntarily makes himself a party to this vro- ceeding, for the purpose of disclaiming any interest in the land above described, 8. That the husband and wives of the above named tenants in common have all joined in this proceeding for the purpose of releasing ang interest they may have in the above described land growing out of their marital relations and hereby release all claims to dower or curtesy whatever in said land. 11. Re: DAVIDSON, Estate of Sylvesta Dear Mr. Smith: I wish you would be kind enough to advise me concerning the name of the surety on the bond of R. G. Watts, Administrator in the above estate. I have examined the final account filed in this case and find that it cost 21.2287 per cent to administer same. I think it was the duty of the Administrator under the statute to determine who the heirs were and pay the surplus of the estate to said heirs before filins his final account. I think it was your duty to require him to do this. I think further that the petition filed by Wr. Benbow should be sufficient to satisfy you or the Administrator that Henry Davidson was and is the ouly heir at law of Sylvesta Davidson. If after the estete has cost 21.2287 per cent it is to be subjected to further cost and expense in order to have it paid to the only heir at law, it will be my purpose to meke the Administrator the surety on his bond and you as Clerk, parties defendant, and in doing so lI purpose to attack the reasonbleness of the expendities of the Administrator and the good faith of your office in authorizing them in order that the whole matter may be reviewed in the Superior Court. You allowed an Attorney's fee of $125.00 and allowed the Administrator to charge commissions on the Attorney's fees. I believe that the court will hold that this fee was unreasonable in the lizht of the value of the estate and the amount of work involved by the Attorney as reflected in the final report and certainly it was irregular to permit the Administrator to charge commissions on the Attorney's fees. If however, we can satisfy your office by petition, affidavit or otherwise that Henry Davidson is the only heir at law and next of kin of Sylvesta Davidson to the end that you will pay to him the asount of $451.32 without further court cost and expense, we are willing to let the final report stand. L. Davidson, who under the terms of the will of the late T. L. Davidson was to have for her own all of the personal property belonging to the estate and the house and lot on North Center Street, Statesville, Ne C., kmowm as the Rockvrell place, and she was empowered by the said will to operate the farm belonging to the estate until the youngest child should reach 21 years of age, when at that time she is to sell the farm and divide the proceeds equally among the children. She is appointed by the said will as guardian without bond for the minor children. It is under and by virtue of the said will, therefore, that lrs. Sallie Davidson takes the assets of the said estate and continues to operate the said farm as guardian, trustee, and executor until the youngest child is 21 years of age.
