The commissioners shall make and sign three lists of articles assigned, stating the value of each, the number of the family, and deficiency to be paid by the personal representative. One of these lists shall be delivered to the widow, one to the personal repre- sentative, and one returned by the Justice, within twenty days after the assignment, to the Clerk of the Superior Court of the county, who shall file and record the same, and enter judgment against the personal representative, to be paid when the assets shall come into his hands, for any residue found in favor of the widow. In case there be no stock, crop or provisions on hand, the year’s support may be allotted by commissioners from the personal property of the deceased and also any debt known to be due him, and said allotment shall vest the said property in the widow and her right to collect said debt. Ayers be given some token from the estate as an appreciation on our part for their kindness to Mr, C. D. Crouch, and we, therefore, request that you pay out of the estate of C. D. One of these lists shall be delivered to the widow, one to the personal representative, and one returned by the Jus- tice, within twenty days after the assignment, to the Clerk of the Superior Court of the county, who shall file and record the same, and enter judgment against the personal representative, to be paid when the assets shall come into his hands, for any residue found in favor of the widow. In case there be no stock, crop or provisions on hand, the year’s support may be allotted by commissioners from the personal property of the deceased and also any debt known to be due him, and said allotment shall vest the said property in the widow and her right to collect said debt. Culbreth, of Statesville, North Carolina, do make and declare this to be my last will and testament, hereby re- voking any and all wills at any time heretofore made by me, FIRST. I will and direct that my executor hereinafter named, shall, out of the general funds of my estate, pay all of my just debts, including funeral expenses, cost of a modest monument or tombstone, to be selected by my near relativesy and including all inheritance taxes and other charges of administration. SECOND. I give and bequeath unto my beloved sister, Mrs John A. Walker, all of my tangible personal effects, including wearing ap- parel, jewelry and other intimate personal effects, to be used and disposed of as my said sister shall elect. THIRD. I give, bequeath and devise the residue and remainder of my property and estate, both real and personal and wheresoever situate, unto Wachovia Bank and Trust Company, of Winston-Salem, North Carolina, IN TRUST, however, for the following uses and purposes and none other, to-wib: (a). To receive, hold, collect the corpus or principal there- of, and to invest and reinvest the same in such stocks, bonds and other securities and properties as shall be selected and approved, from time to time, by the said trustee's investment committee. (ob). To pay over to my said sister, Mrs John A Walker, or in the event of her incapacity, then pay over to other individuals or institutions whom or which the said trustee shall deem to be proper and responsible, first out of the income and then out of the principal of this trust estate and in monthly or quarterly installments, such sums as the said trustee shall deem necessary for the support, mainten- ance and reasonable comfort of my said sister for the term of her life, even to the consumption of the entire amount of this trust estate, (c). After the death of my said sister, then the residue of this trust estate shall continue in trust for the benefit of Johnsie Virginia Flanigan and Walter Lee Flahigan, children of my niece, Mrs Robert L Flanigan, and the said trustee shall disburse therefrom, first from income and then from principal, such sums as the said trustee shall deem necessary to supplement funds available to or for the said child- ren from other sources in order to provide for the proper and necessary support and education of the said children, and shall distribute the residue to and among the said children as and when they shall serverally have attained the age of twenty-five (25) years. I appoint Wachovia Bank and Trust Company, of Winston-Salem, and Salisbury, North Carolina, executor of this my last will and testa- ment, with full power and authority to sell and convey both real and personal property at either public or private sale and without order of Court. As compensation for its services as executor, the said Wachovia Bank and Trust Company shall receive the usual commissions allowed by the statutes of the State of North Carolina. And ascomp- ensation for its services as trustee, the said Trust Company shall receive 5% of the gross annual income. No commissions shall be allow- ed to the trustee on funds or securities received from the executor; nor shall commissions be allowed upon distribution to or for benefi- ciaries. QO Ee.
