Crawford,May Crawford, Nora Leonard and Zeb Leonard, answering the petition in the above entitled cause,say: 1- That the allegations of the first paragraph of the petition are admitted. ©- That the allegations of the second paragraph of the petition are admitted. 3- That the allegations of the third paragraph of the petition are admitted. Further answering said paragraph, these defendants say that the defendant, 4. lM. Crawford, was named as the executor of the said last will and testament of J. i. Crawford,deceased,and that Thomas J. Crawford was appointed administrator,C.T.A. of said estate with- out giving the said A. ki. Crawford an opportunity to see whether or not he was going to qualify. 4- That the allegations of the fourth paragraph of the petition are denied,upon information and belief. 5- That the allegations of the fifth paragraph of the petition are admitted. 6- That these defendants do not have sufficient knowledge or information to form a belief as to the truth or falsity of the allegations of the sixth paragraph of the petition,- they not having examined the records referred to therein. 7- These defendants answering the allegations of the seventh paragraph of the petition, admit same as stated,provided the Court finds that the allegations of the sixth paragraph of the petition are true,and ask that the Court,before a final order is made,shall ascertain the facts of the sixth and seventh paragraphs of said petition. 8- That these defendants neither admit nor deny the allegations of the eighth paragraph of the petition. These defendants further answering the petition respectfully show to the Court and allege and say: (a) That they are informed and believe that at the death of lirs, Elizabeth Crawford,the wife and widow of J. E. Crawford referred to,that there was personal property on hands belonging to the estate of J. &. Crawford,reagonably worth $ ° (b) That these defendants are informed and believe,and allese upon such information and belief,that at the death of ud. &. Crawford, that he was not indebted in the sum of $500.00,or anything like that amount,if anything,- and if there was indebtedness incurred after his death and prior to the death of Mrs. Elizabeth Crawford,his widow, the same would not be a charge against the estate of uJ. RE. Crawford, deceased. A, Crawford, late of Iredell] County, died intestate in said County, and soon thereafter the Plaintiff, W. HH, Crawford, was duly appointed and qualified as the administrator upon his estate by the Clerk of the Superior Court of Iredel) County. end. That on the 20th of April 1888 the defendant A. P. Murdock made his note to plaintiff's intestate J. A. Crawford in the following words ane figures to-wit ;: "$400.00 One day after date I promise to pay J. A. Crawford Four Hundred Dollars for value received at 8 = - be rowed money. This the 20th of April 18868. <A. P, Murdock, seal", ord. That there has heen paid on the said note the following sums, to-wit: On the Slst of October 1892 $74.00 on the 26th of January 1893 $15.00 On the 2nd of August 1895 $50.00 4th. That the balance of the said debt still re- mains due ana unpaid, and the aefendant, after repeated de- mands made upon him, fails to pay the same. Crawford, late of Iredell County, died intestate in Iredell County in the month of January 1898, and subsequent- ly thereto and soon thereafter the Clerk of the Superior Court of Ire- dell County appointed your petitioner administrator upon the estate of the said James A. Crawford, and the petitioner qualified and assumed the burden of the said trust. 2nd. That the personal property of the intestate of petit- loner is entirely insufficient to pay the indebtedness of his estate. The amount of indebtedness now outstanding against the estate of the said James A. Crawford is between $2,500.00 and $3,000.00, and petition- er has no assets with which to pay the said indebtedness. The said in- debtedness consists of notes executed by James A. Crawford and made pay- able to Mary A. Crawford. ms x Q 5 ~ : ° 4 a. 5 ® an > (2) Srd. That up to the present time the petitioner has been able to realize something over $600.00, and the same has been applied to the payment of the indebtedness and expenses of the estate, with the exception of ahout $26.00. There are a few small accounts yet due the estate, upon certain ones of which the petitioner hopes to realize a few dollars, but nothing of much consequence. It may be that the petition- er will be able to realize something on account of a judgement recently Obtained against A. P. Murdock, but this no doubt will be dependent upon litigation. There is no prospect of realizing anything sufficient from the personal estate to pay off all of the ahove incdehtedness, and it is necessary that the real estate of the intestate be sold in order to make assets to pay the outstanding indebtedness. & Ath. That the intestate died seized and possessed of a tract of about 220 acres of land situate in Bethany Township, Iredell County, on the waters of Fifth Creek, and adjoining the lands of Dr. Hall, J. A. Haynes, G. T. Ingram and others, and known as the home place of the late James A. Crawford. 5th. That the heirs at law of James A. Crawford are the pet- itioner, a brother, Wm. Dunlap, J. C#¥ Dunlap, FP. A. Dunlap of Iredell County, and Bettie Steele and her husband Henry Steele of the State of Arkansas - these four the children of Catherine Crawford who married W. A. Dunlap; (2) Elizabeth Montgomery, a sister, of Iredell) County; (3) Mary Ann Crawford, a sister, of Iredell County; (4) Lettia Crawford and her husband Oliver Connelly, Walter Murdock, Julia McLaughlin and her husband Dr. Eugene McLaughlin - the three children of Jerusha A. Craw- ford; (5) A. P. Murdock and his children James Murdock, Nettie Mills and her husband W, R. Mills, Ozelle Houpe, Jno. T. Murdock and the heirs at law of Thos, C. Murdock, dec'd. viz: Albertus Murdock and McKinzie Mur- dock - the five children above named representing their mother Margaret M. Murdock, dec'd - (6)Alexander Crawford, James Crawford, Lettia Bailey and her husband Augustus Bailey, Wm. Crawford, Emma Crawford, Alpheus Crawford, Robert Crawford, Geo. That of the said defendants Bettie Steele and her hus- band Henry Steele are non-residents living in the State of Arkansas, and all of the above named children of Thaddeus Crawford, dec'd. are suppos- ed to be resi ents of Chatooga County, Georgia, and James Murdock who lives in the State of Texas - all the rest of the said heirs at law are residents of North Carolina, and in Iredell County. 7th. That petitioner is informed that all of the said de- fendants are of age except the two children of Thos. C. Murdock, dec'd. who are minors under 21 years of age, and have no general or testamen- tary guardian. Wherefore petitioner prays the Court - lst.
