Stella Cowan who was a daughter of Richard Cowan disappeared about 25 years ego and has not been heard of since, but she has one daughter, Rena Bailey whoee husband is Bill Bailey, over 21, both residing in Iredell County, and Stella Cowan, or her daughter Rena Bailey is entitled to a 1/10 interest in said land. 8,Mary McDowell, who was a daughter of Richard Cowan is dead, her husband dead also, but she left one child who is entitled to an interest in said land, to-wit: &e Flossie Cowan McDowell, single, over 21, Iredell County, 1/10 interest. 9. George Cowan, son of Richard Cowan, dead, his wife also dead, but left children somewhere in the West, whose names are unknown are entitled to a 1/10 interest in said land. That the wife of Richard Cowan is also dead. That Richard Cowan had a child by the name of Elda, who married Vest Phifer, but both are dead and left no children. That Richard Cowan also had another child Martha who married Fred Tomlin, but she is dead and left not children. That Mildred Gaither is a minor, without any general or testementary guardian, and is a noneresident of the State of North Carolina, and that she is a necessary party to this action, and it is necessary to have a Suardian appointed to represent her, 7. That George Cowan, who was a son of Richard Cowan, went out West several years ago, and this plaintiff is informed in the State of Oklahoma, and that both he and his wife are now dead.This plaintiff is informed that the said George Cowan left surviving him several children, but this plaintiff can not after due diligence ascertain the names of said children who have an interest in said land, and can not ascertain the place of their residence. That said children have an interest in said land and are necessary parties to this action. 8. That the petitioner desires to hold his interest in thereof, seid land, or the proceeds/in severalty. 3ePhat an actual partition of the lands themselves can not be made without injury to the parties interested, owing to the small number of acres to which each would be entitled by a division thereof, there being only about 17 acres of land to be Givided among the petitioners and defendants, 10. That a sale of said lands would be more advatageous to all the parties interested than an actual partition thereof. WHERERORE, YOUR PETITIONER PRAYS: 1. That the Court order that the lands described herein be sold for partition among the Plaintiff and the defendants, and that the Court will appoint some competent person as Commissioner to sell said land, after due advertisement, to the highest bidder for Cash, and report his proceedings in regard to said sale within ten days after sale into the office of the Court. 2. III That the allegations contained in paragraph three of the Petition are substantially true and admitted except that it is specifically denied that the Petitioner, Mitchell Cowan, is an heir at Law of Richard Cowan, deceased, and it is specifically denied that the said Mitchell Cowan, the Petitioner has any interest in said lands as tennant in common with the Defendants, or otherwise. Iv That the defendants answering the fourth paragraph of the complaint admit that Richard Cowan was the father of the petitioner and that the petitioner is over 21 years of age and resides in Iredell County but it is specifically denied that the Petitioner is an heir at law of the said Richard Cowan and it is further denied that he owns a 1/10 interest as set out in the petition or any other interest. VI That these defendants do not have sufficient knowledge and information fo form a belief as to the allegations of paragraph six of the petition except it is specifically denied that Mildred Gaither has any interest in the lands described in the petition. VII That these defendants do not have sufficient knowledge or information to form a belief as to the truth of the allegation contained in paragraph seven and they therefore deny the same and it is specifically denied that Geerge Cowan ever had any children and these defendants further allege that the said George Cowan was a bastard son of Richard Cowan and that Richard Cowan, deceased, was never married to the mother of said Geerge Cowan and therefore neither George Cowan nor his children, if any, have any interest in the land described in this petition. VIII Answering the eighth paragraph of the petition it is specifically denied that the said petitioner, Mitchell Cowan, has any interest in the land described in the petition and there- fore has no right to ask for a sale of the same or to have any interest in the money derrived from the sale of the same or has any right to request the sale of the same. Ix That the allegations contained in paragraph nine of the petition are untrue and are therefore denied. x That the allegations contained in paragraph ten of the complaint are untrue and are therefore denied. THAT THESE DEFENDAENTS, BY WAY OF FURTHER ANSWER AND DEFENSE TO THE PETITIONERS ALLEGED CAUSE OF ACTION, ALLEGE AND SAY: le That Richard Cowan died intestate in Iredell County about the year 1904 seized and possessed in fee simple of the lands described in the petition. 2. That about 15 years ago, Estelle Cowan left this community and has not been heard of since and it is therefore presumed that she is dead and she leaves as her only heir at law, Rena @owan Bailey. 4. That Mary Cowan is dead leaving surviving her as her only heir at law, Flossie Cowan. 5. That about the year 1920, Kate McKee, Martha Tomlin and Ethel Cowan sold and conveyed their interest in the lands aforesaid to Wesley Cowan, one of these defendants and that the said Kate McKee, Martha Tomlin, who later married a Gaither, and Ethel Cowan nor their heirs have any interest in the lands described in the petition. 6. That the interests of the defendants as individuals in this petition in said lands are as follows: Wesley Cowan a 1/2 undivided interest Dock Cowan a 1/8 undivided interest Mitchell Cowan a 1/8 imd@vdded interest Rena Bailey Cowan a 1/8 undivided interest Flossie Cowan a 1/8 undivided interest. 7. These defendants further allege that the petitioner Mitchell Cowan has no interest in the lands whatever described in this petition for the reason that he is the bastard child of Richard Cowan, deceased, and that Richard COwan was never Married to the mother of the said Mitchell Cowan. 8. These defendants allege and say that the lands described in the petition consists of about 17 acres of land situated some 12 miles from Statesville and is in a very poor state of cultivation with no improvements on the same and if the said land is offered for sale at this time it would bring less than $100.00 in their Opinion and not enough to pay for the costs of this proveeding and that if the sale of the property is ordered at this time that it would amount toa confiscation of said property and that the defendants filing this answer would receive nothing whatever from the sale of said property. WHEREFORE, these defendants respectfully pray the court: 1.
