This proceeding coming on to be heard on the Petition of P. F. Somers, Administrator of L . B. Cowan, deceased, and being heard, and it appearinz to the geurt that the Defendant had been properly served with summons, and made a party, and that the personal estate of the said L. B. Cowan, deceased, is insufficient to pay his debts and charges of administration; It is therefore ordered, adjudged and declared that the lands referred to and described in the petition be sold, in order to pay so much of said debts and charges as the per- sonal estate may be knsufficient to discharge. It is further ordered end decreed that P. F. Somers be, and he is hereby appointed as Commissioner +o sell said land at the Court House Door of Iredell County, to the highest bidder at public auction for cash, and that he sell the same on the (fer, day of April, 1920, after posting a notice of said sale at the Court House Door and three other public places in Irdell County for 30 days immediately preceding such sale, and also publishing said notice once a week for four weeks in [Hi Loemenbars the. a newspaoer published in Statesville, North Carolina, and the said Comm&ssioner shall report his proceedings in the premises fo this Court within ten days from date of sale. He We Cowan, This proceeding again coming on to be heard, and it appearing that the said PP. FB, Somers, Commissioner appointed by the court to sell the land described in the petition of the Plaintiff on the 19th. day of April, 1920, sold at pub- lic auction to yw. D. MeClelland, the lana described in the petition, at the price of $448.00, cash upon confimation of Sale, and it appearing to the Court that the said sale was in all respects duly and Properly conducted and made, and thet the price offered, as aforesaid, was and is Just and reas onable,; It is therefore ordered, adjudged and decreed that the said sale be, and it igs hereby in all respects confirmed, and the said P. BF, Somers, Commissioner as aforesaid, upon the pay- ment of the purchase money and every part thereof, shall exeoute and deliver to the said purchaser and his heirs and assicns a deed in fee Simple for the said land, and the said Pp, Administrator of L. B. F. Somers, Cowan, upon receipt of the said purchase money shall apply a sufficiency thereof to the payment of said debt and Charges of administration, as the personal estate may have been insufficient to discharge, after first deducting the cost of this proceeding. If any Surplus shall remain after the payment of said debts and charges, the same is to be considered “8 real estate and is to be disposed of by the Administrator of said estate, among such persons as would have been entitled to the land, according to law. Somers, Commissioner, under a Judgment of the Superior Court of the said County in the Special proceeding entitled Pp. FP, Somers, Administrator of L. B. Cowan , deceased, against He W. Cowan, party of the first part, to We D. McLelland, of Iredell County, North Carolina, party of the second part, Witnesseth: That whereas the said P. F. Somers, Commissioner, being thereto licensed by Judgment in said proceeding, did on the 19th. day of April, 1920, after due advertisement, expose the land hereinafter described to public sale at the Court House in Stetesville, Iredell Cowmty, North Carolina, and them and there the said W. D. McLelland became the last and highest bidder for said land, at the sum of $448.00, ana complied with the terms of sale,and whereas, upon report of said sale to said Court, the same was confirmed, and the said Pp. F, Somers, Com- missioner as aforesaid, was ordered by the Judgment of said Court to execute a deed in fee simple to said purchaser upon payment of said purchase money, and whereas the said purchase money has been paid in full, Now in consideration of the premises » the said P. F. Somers, Commissioner as aforesaid, does hereby bargain, sell and convey to the said W. D. McLelland and his heirs and assigns that certain parcel or lot of land situate in shiloh Township, Iredell County North Carolina adjoining the lands of J. F. Moore, Ben McLean and others, and bounded as follows: Beginning at a stone on J. F. Moore's line and runs Rast 22 poles to a stone; thence North 51 pokes to a stone, corner of Lot No. 2; thence West 22 poles to a stone on J. F. Cowan has executed an instrument which is attached hereto, authorizing that Gussie Davidson and Josephine Ramsey be paid the amount they advanced before anything is paid to him on his advancement. Through error, the name Gussie Davis was used for Gussie Davidson in the letters of administration and in the notice to creditors. The correction has been made on the letters of administration. The correct name is Gussie Davidson, but she is sometimes called Gussie Davis, Since there is not suffi- cient funds to pay the funeral bill, and also since the correct address was given in the notice to creditors, this error does not materially effect the Estate, Notice to creditors was published in the Statesville Record once a week for six weeks, the first publication being on January ie, Ge All debts which were filed with the Administratrix, or of which she had any knowledge, are shown in this report.
