Cornelius, deceased, respectfully showeth that her said late husbend died testated in the County of Mecklenburg during the month @f----~------ 1914, leaving ea last will and testament which was duly admitted to probate in Mecklenburg County, Nortn Carolina, propounded by Frank C, Sherrill, the Executor therein named, who qualified as such and took upon himself the burden of administering said estate. To the Superior Courtof said County: The above petitioners complain and allere: 1.That they are tenants in common and seized in fee simple of the foliowing described lands lying and being in the county of Tredell and Navideon tawnehip and bourded as followe:- Rerinning upoh a walnut on the river bank, formerly Lewis Alley's corner:thence N.85 E.92@ poles to a stone in said Alley's line;thence S.8 W.to the south east corner of the old dower;thence “e dower line to the river;thence up the river to tne beginning, ning 170 acres more or less. ©. That the interest of the petitioners in the said lands as individuals is as follows: Henry Cornelius,Chas.Cornelius,”.T.Cornelius,Miss Varrie Corneliue,Will Cornelius,Mrs.Aurustsa Walker,Nrs.Reulah Mayhew,and Jim By Cornelius are each entitled to a one nineth interest in and to the said lands,Cal.Walker and James Mayhew have no interest except as the husbands of the nersons above mentioned,Jas.5.Johnston has no interest except as hhe husband of Carry Johnston,deceased,who left eight children to inherit her one nineth interest,hose names are as follows,viz.:Vinnie,Fenry,Nancy,Anne, Roy,Susan and Carry Johnston,minors.these aaid minors are each entitled to a one seventy second interest in and to the said lands. 3. That Kinnie,Henry,Nancy,Hattie,Anne,Roy ,Susan and Carry Johnston are minors without any guardian. 4.
