Cooper, Commissioner, appointed to sell the lands describ- ed in this case as "lying in the County of Buncombe, said State", and it appearing to the Court that the saia C. S. Cooper, Com- missioner as aforesaid, sold at public auction in the City of Asheville, N, Ce, on the 7 day of December, 1908, the tract of five and eighty-six one-hundredths (5.86) acres lying in the mountains near the City of Asheville, when ana where J, H, Mc- Connell became the last and highest bidder for said land at the price of $2,000.00, and offers to comply with the terms of sale; and it appearing that said sale is just and reasonable, and no exceptions having been filed to the report within the time allowed by law: It is, therefore, ordered and decreed that the said Sale be, and it is hereby in all respects confirmed, and that the said C, s, Cooper, Commissioner &s aforesaid, upon the pay- ment of the purchase money and a.compliance in full with the terms of Sale, make, execute and deliver to the said J. Cooper late of the County of Iredell, died intestate, and that your petitioner was duly appointed his administrator. Second: That there are surviving the said /. M. Cooper as his heirs at law eleven living children, of whom eight are of full age, and three, to-wit: Marius, Bertha and Helen Cooper are minors, and the said Re A. Cooper is their general guardian. Cooper is a brick storehouse on certain real estate in the town of Miarion, Ne G.; that said storehouse is and has been for come years past occupied by The A. Blanton zrocery Company; that in order to hol@ the said tenant, and to better utilize said property and increase the rents of the Sane, it is necessary that said storehouse he equipped with an elevator, Fourth: That your petitioner has a proposition from the Piedmont Electric Company of Asheville, N. GC. to furnish an elevator and the equipment for operating the same hy an electric motor in said building, all complete, at a price not to exceed $405.00. That your petitioner has had es- timates submitted by other contractors, who were hidding upon said work, and that he deems the proposition of the Asheville Company much the best proposition that has been offered, Fifth: That it is the desire of the children, who are of age, to incur the expense necessary to install satd elevator in the said building, which is held by them in common with the infants, and in the opinion of your petitioner it is greatly to the interest of the said infants that the property be thus improved for the purpose not only of enhancing its value, but in order that a greater income may accrue to the estate thus held in common, and in which said infants are co-owners. Fourth: That the buildings upon said land are old, antiquated and in need of repairs and not in keepine with the value of the ground, nor of the spirit and progress of the community in which they are located- That it is impossible to get fair or commensurate returns from property of its value in its present condition. Fifth: That the said R.A.Coover has not the money available with which to ereet the type and character of buildings and improvements thereon that are necessary in order to get full end adequate returns from the property, nor would he be Justified in making such expenditures owing to his qualified ownership. Sixth: That the said R.A. Cooper has an offer from (.A. Raysor to purchase said property at private sale at the sum of $27, OOC »900-00 cashe That in the opinion of the said ReA.Cooper and the heirs expectant who are of full age, it woulda materially enhance the interests of all those coneerned to sell Said property and reinvest the proceeds in other real estate subject to the orders or the Court, to be hela upon the same conditions and contingencies as the property to be conveyed, where it will not impose such a burden on the life tenant to keep up the property, and where it can be made to yield a greater fixed income, and the improvements be made of more permanent nature, and where the property can receive the WM ‘J e d o o 9 L0 6 1 personal care and attention of the owners. seventh: That none of the Owners are residents of the County of Buncombe but that the life tenant and a majority of the prospective owners areresidents of Statesville, N.c. Kighth: That on the 6th day of August, 1906, the said W.lieCooper sold and conveyed to Wiley B.Brown and his heirs one-half of the western wall of the brick storehouse on said property, same being the wall between Lots Mos. 10 and 12, that is to say the right to use one-half of said Western wall from the West to the center thereof, from the bottom to the top and from the front to the rear, for such purposes as may be necessary to the full enjoyment and occupation of said adjoining storehouse Io. 10, so long as said Storehouse shall stand, but the ground upon which the said wall Stands is expressly reserved and exempted from said conveyance. It is further stinulated in said asreement that either party thereto may at any time extend the said wall upward as many stories additional as may be desired at his own expense, and the other may, at any time, become a co-owner in said wall by paying one-half the cost to the builder, but this provision shall cease and become void if the said party wall be destroyed. Ninth: That after a salé of said property has been made and confirmed, the convenience of parties and the ends of justice can be promoted by a removal of this cause to the Superior Court of Iredell County. Wherefore, the plaintiffs pray judgment: 1st: That a decree he made ordering and confirming a private sale of said property to the said C.A.Raysor and his heirs at the sun of $27,000.00 cash, and directing deed to be executed and delivered to him, upon payment of the purchase money in full. 2nd: That a commissioner be appointed to make such sale and to reinvest the proceeds in other rea] estate, subject to the orders and approval of the Court- 3rd: ‘hat a Special guardian ad litem be appointed to appear and defend on behalf of ssid infants- 4th: That the costs of this action be paid from the proceeds of sale- 5th: That after said sale has been consummated, this action be removed to the Superior Court of Iredell County and there retained for further orders- 6th: For such other and further relief in law and enuity, as plaintiffs may be entitled.to. Cooper, who died in 1907, leaving him surviving twelve children and a widow; that the said W. li. Cooper in his life time had made liberal advancements to six of his children, some of whom were advanced in real estate and some in personal estate, but made no advancements to his other heirs at law; that in an ection for partition brought by some of the heirs at law in 1908, much real estate in the counties of Iredell, ilicDowell and Buncombe was ordered to be sold for division, but because of insufficiency of the Stlev amounts bid, the court refused to confirma cOnsiderable por- tion of said properties lying in the counties of licDowell and 3uncombe and entered a decree providing that said cause should be continued upon the docket until all of said lands should receive bids that would justify the court in contirm- ing a sale thereof; that because of the fact that some of Said advancements were made in realty and some in personalty, and the further fact that purchasers could not be procured for some of said properties, at prices which the court con- sidered adequate and by which their values could be ascer- tained and a basis of settlement arrived at between the heirs at law who had been advanced, and those who had not been so advanced, it has not been practicable to make a final settle- ment of the trust committed to him; that your petitioner has paid all debts of his intestate and has made partial settlements with the heirs at law from time to time, and W 'M ‘J a d o o since filing an account with the court, has made disburse- ments to heirs that reduced the amount now in his hands as LO 6 I administrator to approximately $15,000.00, now deposited with the First National Bank of Statesville, and because of which your petitioner's bond should be reduced. Cooper, after said time continued the administration of said estate and collected the rents on the real estate belonging to ij. M. Cooper, and made disbursement of the funds coming into his hands. 2nd: That on the lst day of April, 1909, the said Re. Ae Cooper and W. W. Cooper, as Administrators of the estate of W. M. Cooper, filed a partial settlement showing that on said date there remained in their hands from the personal estate of W. M. Cooper, the sum of $23,507.92. ord; That charging the said R. A. Cooper with said ‘amount of $23,507.92, and adding thereunto all ammnts received by him since safid date, in interest and rent on the real estate from the date of the death of We M. Cooper, Administrator, is entitled to credit for five per cent commissions on the sum of $69,415.51, same being the amounts collected by him, in addition to the said sum of - $23,507.92, or the sum of $3,470.77. That the said R. A, Cooper, Admin- istrator, is entitled to credit for five per cent commissions on $36,663.42, same being disbursements made in the course of administration, or the sum of $1,833.17. That adding these amounts to the disbursements actually made, makes the total credits to which the said R. 44 Cooper is entitled, the sum of $41,967.36. This leaves the amount due the heirs and dis- tributees of the said \i. M. Cooper, from the administration of the estate of W. M. Cooper, the sum of $50,956.07. 4th; That in the life-time of the said W. M. Cooper, he advanced to the children of his first wife, viz: Re. Ae Cooper, Josephine Cooper DeVane, Roweaa Cooper Orr, Etta Cooper Setzer and Mae Cooper Cook, the sum of $14,000.00 each, with the understanding that said amounts @hould be accounted for in the final settlement of the estate of the said W. M. Cooper. That after the death of W. W. Cooper, one of tie heirs-at-law of W. M. Cooper, the interest in tne estate which went to his widow, was purchased by the other heirs of W. M. Cooper. That We M. Cooper left surviving, in addition to the heirs and distributees named above, his wife, Bertha Cooper, and the following children, viz: Albert M. Cooper, Bertha Cooper Anderson, Helen Cooper Murdock, J. B. Coopen Marius Cooper and Frank Cooper. 5th; That all the real estate neretofore sold belonging to the estate of W. ll. Cooper, has been equally divided amoyg the six children of the second wife of W. M. Cooper. That each one of said ciildren has received from the sale of real estate heretofore .made, the sum of $4,079.31. That prior to the making of said partial settlement on the lst day of @ril, 1909, each one of the heirs and distributees of W. M. Cooper, who were advanced said $14,000.00 advancement, received $4000.00 of said advancement in personal property and two of said heirs-at-law received $1500.00 each in personal property, or a total of $19000.00. That the amount in the hands of the Administrators of W. M, Cooper at the date of said settlement, made on the lst day of April, 1909, as hereinbefore set out, was $25,507.92; that prior to said settlement, the sum of $3000.00 had been paid te each distributee by the Administrators, or a to’ . of $39,000.00. That the total amowmt of said estate, including said advancements in personal property, the amount paid distributees, and the amowit in the hands of the Administrators at the time of said settlement, is $81,507.92. That, therefore, Bertha Cooper, widow of W. M. Cooper, is entitled to received from said Administrator the sum of $6,269.84, as her share of the personal estate. That said Adminis- trator has paid to the said Bertha Cooper the sum of $6,150.00 of said sum, #1000.00 being on ier year's allowance. That there is due the said Bertha Cooper, as a balance on her distributive Share, the sum of $1,119.85. That said amowmt of $1,119.85 being deducted from the sum of $50,956.07, shown by tne settlement of the Administrator, leaves the sum of $49,856.22 due the said neirs and distributees of the said W. M. Cooper, other than Bertha Cooper. 7th; That from time to time, during the administration of the estate of the said WW. M. Cooper, the said R. A. M. Cooper, the sum of $45,854.51, leaving in his hands the swum of $5,981.72. All of this is fully set out in the petition filed by R. A. Cooper, Admr., and individually, ask- ing for a sale of real estate in order to equalize advancements made by We M. Cooper and by the Administrator.
