Ao. ge ee NOTE: The widow is entitled to $500 out of the crop, stock and provisions of the deceased, and $150 addi- tional for each member of the family under fifteen years old as her year’s support. The commissioners shall make and sign three lists of articles assigned, stating the value of each, the number of the family, and deficiency to be paid by the personal representative. One of these lists shall be delivered to the widow, one to the personal representative, and one returned by the Justice, within twenty days after the assignment, to the Clerk of the Superior Court of the county, who shall file and record the same, and enter judgment against the personal representative, to be paid when the assets shall come into his hands, for any residue found in favor of the widow. In case there be no stock, crop or provisions on hand, the year’s support may be allotted by commissioners from the personal property of the de- ceased and also any debt known to be due him, and said allotment shall vest the said property in the widow and her right to collect said debt. To the Clerk of the Superior Court of Iredell County: -l~ The petitioners complain and allege that the petitioner Sarah Ce Cook and Mary A. Wagner, together with the defendant, Margar- et L. Freeze, are tenants in common for the folioving described tract of land, lying and being in the County ot Iredell and State of North aroiina, and more particularly described as follows, to-wit: Boundary of Thomas Cook's Land. Lot #7, being a part of the old place. Peginning on a white oak, corner of #8 and on Original line, thence South with said line 40 poles to a pine Richey's corner,thence West 140 poles to a white oak thence North 45 West 24 poles to the creek, thence with the branch about North 20 West 50 poles to a Spring, thence North 48 West 24 poles a post oak in a field, thence West 123 poles to a pine, thence North 135 poles to a pine, thence East 70 poles to a white oak, thence South 47 Fast to near the head of a small branch, and with the meanders o° said branch to its mouth pursueing first course 218 poles to a white Oak on hill-side, thence South 18 poles to a black oak, thence South 53 poles to a hickory, thence 24 poles tothe beginning, con- taining 198 acres, excepting 5 acres thereof sold to De L. L. respectfully showeth to the court:- First: That on the 3rd day of Aurust 1901, a paper-writing purporting to be the last will and testament of Regina Cook, deceased, was filed for probate in the office of the Clerk of the Superior court of Iredell County, was provec in common form, and ordered to be recorded in the office of said Clerk; and that letters of administration with the will annexed have been issued to G. W. Clegg, the public administra- tor of said county. Second: That neither the said paper-writing nor any part. thereof is the last wil] and testament of the said Regina Cook, and your petitioners desiring to enter a caveat thereto, upon information and belief, allege the following facts: x, That the said alleged testatrix left her surviving as her heirs at law three daughters, viz: the petitioner Margaret L. freeze, and in addition thereto, her other daughters, Sarah C.
