Collins and Ernest Collins, who has since died leaving the following children, George Collins age sixteen years, Paul 6l 6 l Collins age fourteen years and Howard Collins age twelve years, upon whom the following real estate descended which real estate was allotted to Mrs, WeAeCollins, widow of P.H. Collins, as her dower, by special proceedings recorded in Book 12, Page 199 which said land is described as follows: TRACT NO 1 A = (DOWER) - Lot No 4 = BEGINNING at a stake, corner of Lot 1; thence N 85 W 47 1/2 poles to a Pine Stump; thence N 22 1/2 E 71 poles to s stone on the Old line, corner of Lot No 1; thence East 23 poles to a stone, corner of Lot No 1; thence S 4 W 70 poles to beginning, containing 15 acres more or less. That the actual amount due on the said several funds at this time,to-wit, April 6th, 1901 is $1384.59 dollars. Fourth:- That besides the amount due as aforesaid the said Anna J. Colson is justly due the plaintif® for work and labor done by him for her from the time that he arrived of July 1889 up to the time of her deatn, November 1900 = 4131 days » sum Of 25 Bents per day, amountin: $1032.75, which said charge 2 reasonable one for the care, attention, labor and rao hwy . work done hy plaintiff for the testatrix durin» the said time, and for /f & care and attention to her during her last illness. That about the 28th of March 1885 John Colson the Administrator of plaintiff's father, Thomas Colson made a settlement with Anna, the testatrix for all claims, charges and Gemands by her up to that time against plaintiff for and on account of all accounts and charges against iim =- the plaintiff at that time being of the age of 16 years, 8 montns and 15 days - but his said guardian never made any settlement with the ward at any time to show the status of her accounts Creer vt i oa with her said ward. That after the said settlement made with the Administrator as aforesaid for such claims and demands as she made against the plaintiff and in full @sx discharge of such claims up to that time--the plaintiff continued to live with the testatrix and was able to do valuable service to her and did render services for her continuously, to-wit, for the period of 51 1/2 months, that is, from March 28th 1885 when the $120 Dollars was paid, to the arrival at age of plaintiff, to-wit, on the 13th of Jvly 1889; that the services rendered for tne 51 1/2 months aforesaid over and above board and clothing was reasonably worth the sum of $6.00 per month, which claim amounts to $309 Dollars; that the testatrix is entitled to a credit on her account of $184.80. Sixth:- That the estate of the said testatrix is therefore justly eo owing the plainti on the three several accounts as aforesaid the sum of $2541.54. Wherefore the plaintiff demands judgment against the defendant Executors First: That they be required to account to the plaintiff for the said several sums as aforesaid, and for such other surs as the said testatrix might have realized on account of the use of his funds as aforescic. Second: That plaintiff have judgment for $2541.54 and much of the said d as shall be found to have been applied purchase of the farm whereon testatrix resided at her death, shall be declared a lien upon the said land, or the proceeds arisin; from the same and shall have that priority which the law allows, and that plaintiff recover his costs and have such other and further relief as law and equity he may be entitled to.
