Poston for the sum of $100.00 provided he desires to purchase said shop for said amouht, but if he does not so desire then the barber shop is to be solc by my executors either publicly or privately, Fourth. I will, devise, and bequeath to my wife, Beulah Coley, the house and lot on Llexander Street, bought from Arthur Wilson, to be hers absolutely and forever. Fifth, I will, devise and bequeath all the residue of my estate to my wife, Beulah Coley to belong to her during her natural life or wicowhood, but at her death or marriage saic property to belong to my seven children, James E. Coley, Thelma Shomaker, Leroy Coley, Fred Coley, Virginia Coley Adkins, Louise Coley Reid, and David E, Coley. My wife, Beuleh Coley is to pay all taxes each and every year as long as she is in possession of any real estate owned by me and in her possession, Seventh. Winberry Statesville Re: Albert -&i, Collins Estate Dear Judge: Edgar L. Compton and wife purchased lots from Mr. Kimberland and wife, a portion of the Albert L. Collins real estate and 4 plication has been made to the Moores- "ville Federal Savings & Loan Association for a loan to be secured by deed of trust on this real estate. At this time, I am unable to pass the title ~ other “ee for the following reasons: (1) The will of Albert L. Co iins was proven and recorded in the office of the Clerk Superior court for Iredell County, and the executors were granted letters testamentary, but so far as the record shows, they have only filed an inventory, but have never made any accounting to the court. (2) There is nothing in the record to show whether the inheritance tax report was made. (3) There is nothing in the record to show that funeral ex- penses have been paid. (4) There is nothing in the record to show that all debts have been paid. (5) The special proceeding shows that no final decree has been entered by . the court. If I am wrong in these inquiries and these things have been done, please advise me. herwise,,1 think. it is very necessary that an accounting be made 30 that I may be able | to see that all obligations of the estate have been met. I am enclosing a copy of the letter from Mr. Turlington. I am also enclosing a copy of the letter which I have written to Mr. Turlington. ‘Two different firms of lawyers in Statesville have already pessed title te other lots in the development; however, that does not mean that Mr. Turlington would have to pass them; however, I do not think that there is any question with reference to the title. A. Le Collins died May 1, 1955 and that is more than two years agoe A straight deed from the heirs would now be good against all creditors, except possibly inheritance taxes; and if you w notice fran the letter which i am writing to Mr. Turlington, you have the money in the bank, there is still land and there is stock, and we will do anything to help hin along until you can get ready to file the settlenent. On June 1, 1955, Hoyle N. Collins and Ee 0. Winecoff were appointed Executors, and this estate is being completed by the surviving Executor, Hoyle Ne Collins. 3. Notice to creditors was duly published in the Statesville Record & Landmark once a week for six consecutive weeks, commencing in April, 19566 he Some of the household and kitchen furniture was divided by agree- ment between the heirse 5. There was a life insurance policy in the Pilot Life Insurance Company in the sum of One Thousand Dollars ($1,000.00), and the insurance company sent equal checks to each of the heirs. 6~ All debts and claims have been paid. A report was made to the North Carolina Department of Revenue and the inheritance tax paide 7. The land owned by Ae L. Collins was sold in a Special Proceeding, and the Commissioners duly filed a report showing receipts and disbursementse 8. Mrse Ae Le Collins died in 1952, and there was no administrator. She had sane United States Bonds, and these were converted into cash in the sum of Two Hundred Forty-Six Dollars Ninety Cents ($246.90), and added to the dis- tribution herein, as the same parties would receive it. 9, The kitchen cabinet, cook stove and linoleum rug were offered for sale, but no bids were received. None of the heirs wanted the property and it was left in the house. 10. There were shares of stock in the Merchants and Farmers Bank of Statesville, Ince, as follows: A. The Merchants and Farmers Bank of Statesville, Inc. issued some stock rights, and these were divided among the legatees. B. After the above division and after the sale of two (2) shares of stock to Carrie C. York and one (1) share to Hoyle N.
