C.: The petitioners respectfully show: 1. That John Clodfelter, late of Iredell County, North Carolina, died on or about the 192 aay of January 1927, having first published and declared his last will and testament, which is as follows; "North Carolina Iredell County z; John Clodfelter, of the aforesaid county and state, being of sound mind, but considering the uncertainty of my earthly existence, do make and declare this my last will and testa- ments: First: My executor, hereinafter named, shall give my body a decent burial, suitable to the wishes of my friends and relatives, and pay all funeral expenses, together with all my just debts, out of the first moneys which may come into his hands haat si to my estate. Sennuks I give and bequeath to the Presbyterian Orphan Home of Barium Springs, N. C©., the sum of Five Hundred Dol- lars ($500.00); and all the remainder of the money after the sale of all my real and personal property, (after all necessary expenses are paid), I give and bequeath that to the Thomasville, N. C. Bap- tist Orphan Home. I hereby constitute and appoint E J and Glenn Trout- man my lawful executors to all intents and purposes to execute this my last will and testament, according to the true intent and meaning of the same, and every part and clause thereof--hereby revoking and declaring utterly void all other wills and testaments by me heretofore made. That said will Was duly probated before the Clerk of the Superior Court of Iredell County, N orth Carolina, on the 22nd day of January 1927, and is recorded in Book 9, page 560, of records of Wills for Iredell County, North Carolina. 5. That on the 22nd day of January Aa D 1927, your petitioners were duly appointed executors of said will by the Clerk Superior Court of Iredell County, North Carolina, 4 and at onee e@enter- ed upon their duties 4S such executors. 4. That the defendant, The Regents of the Orphans? Home, is a Corporation duly organized and existing under and by vir- tue of the laws of the State of North Carolina, with its principal office and place of business at Barium Springs, North Carolina, and that it is locally known as "The Presbyterian Orphans Home", at Barium Springs, Iredell County, Nort h Carolina, and is the insti- tution to which the Said testator bequeathed Five Hundred Dollars in the second paragraph of his said Will; and that the defendant, the Thomasville Baptist Orphanage is a corporation duly organized and esisting under and by virtue of the laws of the State of North Carolina, with its principal office and p'ace of business at Tho- masville, North Carolina; and that it, the said Thomasville Baptist Orphanage, is the institution to which the Said testator devised all the remainder of his estate after the payment of all his funeral ex- penses, debts, expenses of administration, and the legacy of $500.00 to the defendant, the Thomasville Baptist Orphanage; And that the Said Regents of the Orphans' Home, and #¢has the said Thomasville Baptist Orphanage are the Sole legatees and devisees of the said John Clodfelter, 5. C, SECOND TRACT; Beginning at a stone in the public road(Statesville-East Monboe road referred to in "First tract" above), and runs thence West 412 poles to a Stone; thence South 13 Degrees West 36 poles to a Stone; thence North 583 Degrees East 584 poles to the Beginning, containing 3 acres, 3 Roods, and 32 perches (or 5-152/160ths acres), more or less, and being the land conveyed to J L Clodfelter by J H Ostwalt & wife Mary Ostwalt by deed dated Feb 18 1lase recorded in book 55 page 381 of records of Deeds for Iredell County, North Carolina. This tract lies about 25 poles northeast of the "First tract" above described. 6. Lot # 5, described as "Second tract" in petition in this proceeding, con- taining 3 acres, 3 roods and 33 perches, to J. B. Clodfelter, for $350.00. Your commissioners respectfully recommend that Said sales and each of them be confirmed unless an increased or bids be filed within the time allowed by law, as the respective bids are fsir and reasonable. Your commissioners further report that in sub- dividing the lands herein above described and in negotiating said sales, so as to get the highest possible prices there- fore, that more time and expense was consumed than is usually consumed in sales of this kind as their personal solicitation for bids were made by your commissioners prior to the date of sale and they therefore respectfully request that they be allowed a total fee of $100.00 in lieu of commissions for said sales. The Regents of the Orphans' Home, and The Thomasville Baptist Orphanage THIS CAUSE coming on to be heard, and being heard, upon the verified ' petition of E J Troutman and Glenn Troutman, Executors of the will of John Clodfelter, deceased, and being heard, and it appearing to the Court that the defendants in this action are the sole devisees of the will of the said John Clodfelter, and that they have all been properky served witth summons, and made oarties hereto, and it appearing to the Court that a sale of the lands of the said testator is necessary in order to comply with the provisions of his will as shown in the petition: It is therefore ordered, adjudged and decreed that the lands des- cribed in the said petition be sold. It is further ordered and decreed that E zy Troutman and Glenn Trout- man be, and they are, hereby appointed commissioners to sell the said land o h ee OD S OOo to the highest bidder on the Lf day of April «a D 1928, after posting a notice of such sale at the courthouse door, and at 3 other public places of Iredell County for 50 days immediately preceeding such sale, and also publish said notice for once a week for 4 consecutive weeks in the °tatesville Daily, a newspaper published in »tatesville, North Carolina. The said commissioners are hereby authorized to sub- divide the lands described in the petition into two or more lots of such sizes and shapes as in their opinion would be to the interest of the parties to this action, and the said cormmissioners are also hereby authorized to rake said sale on the lands in lieu of at the courthouse door of Ire- dell County, if in their opinion the interest oi the parties to this -ro- ceeding would be subserved. It is furtuer ordered by the Yourt that the said sale shall be unon the following terms am to-wit: 1/3 cash upon confir ation of sale, and the remainder within 12 months from date of confirmation of sale with priwilege of the purchaser or purchasers to pay the full purchase price at any time before maturity, the deferred payments to bear interest at 6% per annum from date of confirmation of sale until ax paid, the title to said land to be retained until purchase prices is paid in full. Troutman and Glaen Trout- man, commissioners heretofore appointed by the Court to sell the land descrited in the petition in this cause, and it appear- ing that the said commissioners as heretofore authorized by the Court, divided the said land into five separate lots as shown in said report, and that on “pril 4, 1928, the said commission~ ers sold the said land on the premises at public auction after due advertisement, when and where the said lots were sold to the following persons at the following prices; to-wit, Lot # 1 containing 3 acres to T. S. Loftin $400.00 Lot # 2 " 5.2 ” to J.B.Clodfeiter 435.00 " bi 15.6 " to U.A.Clodfelter 1100.00 ° 1624 " to U.4.Ulodfelter 400.0 " 3 " 3 rods and 33 perches (described in this petition as lot # 2) to J.B.Vlodfelter 350.00 And it avpearing to the Court that no increase bid or bids were filed within the time allowed by law, and tat the said sales vere in all respects duly and properly made, and that the prices bid and each of them were just and reasonable, and the fair value of said lands; It is therefore ordered, adjudged, and decreed by the “ourt that the ssid sales and each of them be and they are hereby in all respects confirmed, and the said 4.J.Troutman and Gleman Troutman, Commissioners as aforesaid, upon payment of the pyrchase money and every wart thereof shall execute and deliver deeds to the said purchasers the respective lots ourchased by them; And it appearing further to the Court that the said Commissioners rendered extra and special services in connection with the sellinz of said land and incurred some extra expense there- in, it is, therefore, ordered and decreed by the Court that the said commissioners be and they are hereby allowed $100.00 for making said sale, in lieu of the commissions proviued by law.
