NOTE. The widow is entitled to $500 out of the crop, stock and provisions of al deceased, and $150 additional for each member of the family under fifteen years old, as her year’s support. The commissioners shall make and sign three liste of articles assigned, stating the value of each, the number of the family, and deficiency to be paid by the personal represent- ative. One of these lists shall be delivered to the widow, one to the personal representative, and one returned by the Jus- tice, within twenty days after the assignment, to the Clerk of the Superior Court of the county, who shall file and record the same, and enter judgment against the personal representative, to be paid when the assets shall come into his hands, for any residue found in favor of the widow. In case there be no stock, crop or provisions on hand, the year’s support may be allotted by commissioners from the personal property of the deceased and also any debt known to be due him, and said allotment shall vest the said property in the widow and her right to collect said debt. Feburary Term, 1899, U.T. Bowden, admr, of Geo. F. Chase, VSe Southern Railway Company. The defendant answering the complaint in this cause says Ist. That the allegations corained in the first paragra~ ph are true. 2nd. That the allegations contained in the second para- graph are not true, and are therefore denied, 3rd. That the allegations contained in the third para~ erp h are not true, and are therefose denied. 4th, That the allegations cont«ined in the fourth para- graph are not true, and are therefore denied. 5th, That the allegations contained in the fifth para- graph are not true, and are therefore denied, 6th. That the allegations conta ned in the sixth para- graph are not true and are denied, 7th That defendant has no knowledge nor information suf- ficient to enable it to form a bélief as to whether the alle- gations contained in the seventh paragraph are true or no} and therefore denies the sa me. 8th. And for further answer and defence to said action defendant says: That it is a matter of common information thqt the town of Statesville is built almost entirely on the North side of the railroad tracks and that its passen ger de- pot is on that side, and that all passengers from or to Sta- tesville embarked or disembarked on that, side. It was further a matter of common information that when intestate was killa defendant's East bound passenger train, on the Western North Carolina Railroad , or the "main line*, as it is conmonmly called, on which said Rast bound twainzkhxisxentdxthak train intestate was a passenger, made close comnection at States- ville with the South bound train on the Atlantic Tennesee & Ohio Railroad. That the traek of the said A,r, & 0. R.R. is South of he said main line, md runs parallel with, and within a few feet of the main line, That said East bound train on the main line, usually stopped at Statesville only long enough +0 allow passengers to embark and disembark, ob to transfer to the A.T. & 0, train: and that just as soon as\ this was affected, the said Rast bound train pulled out for Salisbury, leaving a train standin on the A.T, & 0. track which pulled out for Charlotte in a very short time, not sng exceeding one minute thereafter, That there was no plaifornm nor light, nor other conveniences on the South side of said AT. & 0, track for the convenience of passengers , and th:t passengers were neither invited tmz nor allowed to embark upon or disembark from said A,T. & 0. trains on the South side. That intestate well knew all these facts, or could have known them by the exercise of common careand prudence. Defendant further says that on the night when intestate was killed, he was invited by an employe to all » amd he did alight from the train with perfect safetyon tag esdd North sid next to the passenger station, snd that he could have remain- ed with perfect safety on said platform, or in the passenger station, until the train left the station which Oceurred in a minute or two, but wishing to go to a house on the South side of the railroad, and becomming impatient on account of the tr train’s not leaving the station as soon as he thought it ought, he attempted to croes over the plafiform of one of the cars of the A.T, & 0. train, just as said train was starting; that he had succoeded in petting over the phatform, and was gettiz down on the South side, when the -tarting of the train caused him to Xmagm lose his balance md fall beneath the wheels of Te Cine the car, That by waiting a moment for the train, or by going around it, either to the Bast or to the West, intestate would have incurred no danger whatever, Defendmt th-refore says that intestate's death was caused by his own negligent and reckleas attempt to pass over the plaiform of the train, while an engine, already steamed up , was attached thereto, md ready to start on its journey, anis wos momentarily expected to start, Com whi tee home ~ 9th.
