Total distribution IV The personal property of the deceased, consisting of household and kitchen furniture, was distributed to the heirs of Annie Pulliam Chambers and is now being used by them; the remaining personal property, consisting of 1960 Dodge automobile, was turned over to the Administratrix and used by her for the benefit of the children of the deceased until it was exchanged for a newer automobile which is now being used by the undersigned for the use and benefit of the five children of Annie Pulliam Chambers and the Administratrix, the Administratrix havine taking her commissions in the said automobile instead of in cash, That before making the distributions hereinabove set forth, the undersigned Administratrix paid all debts of the deceased presented to her wi n i n g st u u y ‘s i o q u i e v y y 99 6 1 Raymer, RaYMER & Lewis ATTORNEYS AT LAW STATESVILLE, N. Chambers, deceased, to make assets to pay debts and the costs of administra- tion, was instituted before the Clerk of the Superior Court of Iredell County, entitled, "Monroe Adams, Administrator of the estate of Fred F. Chambers, (colored) vs. J. Irvin Chambers, Sr., et als", fhe two heirs, J. Irvin Cham bers, Sr., and Lois Houston were trying to raise the money, and on the sale day, October 17, 1942, arrangements had almost been completed. In view of this, the land was bid off by C. B. Winberry, in his name, with the under- standing that if they raised sufficient money to pay the debts and costs of administration, not including the taxes, the sale would be set aside and a non-suit taken. Sufficient money having been advanced to pay the debts and costs of administration, as shown in this report, the sale has been set aside and a non-suit taken in the Special Proceeding. It was the understanding and | p o r ‘s i o q u u e y ) 1 v 6 l | po l ‘s 1 o q u i e y , ) Iv 6 l agreement that the heirs pay the taxes and assessments on the real estate, All debts which have been filed with the Administrator, and of which he had any knowledge, have been paid in full. Notice to creditors was duly published in the Statesville Daily once a week for six successive weeks, the first publication being on July 10, 1941. There was no inheritance tax in this estate, but an inheritance tax report has been filed. Lois Houston and Irvin Chambers, the two heirs of Fred F. Chambers, deceased, entered into an agreement in regard to the division of the land and the personal property, which agreement is hereto attached and made a part of. Under and by virtue of the aforesaid agreement, the Administrator 1. Turned over to Lois Houston the sum of $35.19, which was in his hands after paying the debts and costs of administration. 2. Transferred and assigned the one share of stock in the Iredell Development Company to Lois Houston. 3. Transferred and assigned unto Lois Houston all rent now owed by tenants and former tenants of Fred F. Chambers and the Fred F. Chambers estate. Under the aforesaid agreement, Lois Houston agreed that Irvin Chambers was not to pay any rent on the house that he had been living in. Lois Houston does not have a claim against the estate for the money shown advanced by her in this report, as that was part of the agreement be- tween her and Irvin Chambers, to-wit: that she was to advance the money to pay the debts and costs of administration, and in return she received certain real estate. WHEREFORE, having fully administered on the estate of Fred F. Chambers, deceased, Monroe Adams, Administrator, prays that the court accept this report as his final settlement, and that the same be audited, approved and recorded, and that the Administrator and the sureties on his bond be discharged, as by law provided. nd Respectfully submitted, this the 2 day of November, 1942. The real estate has been divided between the undersigned, and deeds have been made. 2. Umder the agreement between the undersigned, Lois Houston was to advance and pay to you a sufficient sum of money to pay the debts and costs of administration, not including the taxes and assessments. 3. It has been agreed that Lois Houston shall have all rents and monies in your hands over and above payment of the debts and costs of admin- istration, and Irvin Chambers does herepy assign his interest in the same to Lois Houston, and does authorize and direct you to turn the same over to her. 4. Irwin Chambers has been living in one of the houses in the es- tate, and it has been agreed that he is not to pay rent for the period of time that he has lived in the house. (This house was deeded to Irvin Chambers in the division.) 5. Irvin Chambers does hereby transfer and assign all his interest in one share of stock in the Iredell Development Company to Lois Houston, and does hereby authorize and direct Monroe Adams, Administrator, to transfer, assign and deliver the same to Lois Houston. 6. Some of the tenants that have been living in the house are in arrears, and Irwin Chambers does hereby transfer and assign unto Lois Houston all his right, title and interest in all rent now owed by tenants and former tenants of Fred F. Chambers and the Fred F. Chambers estate, and he does here- by authorize and direct Monroe Adams, Administrator of Fred F.
