That it would best Suoserve the interest of the heirs at law ana creditors of the estate of A.¥.Cathey ,to sell the personal property belonging to said estate for cash because said Property would sell for about the same in cash as on credit Of aix montys ,and because, moreover, the majority of the bidders at any proposed sale will probably be unable to Sive solvent notes. Second . That said A.F.Cathey left a lot of cotton and corn, rents from his land , which will bring @ better price ata private Sale for cash than at a public auction as your petitioner is informed and believes ,for the reason that at private sale your petitioner can take advantage of a rise in the market . if any ,whichn could not be done if he were required to sell ona day certain . Wherefore your petitioner prays for an order allowing him to sell the corn and cotton belonging to the estate of A.F.Cathey at private sale for cash at such time as ne may & think best and in such lots as in his judgment ma: be for the best interest of the said estate. It appearing that A.L.Hobbs administrator of A.F.Catheyv deceased , has filed in this office a petition showing reasons sat- isfactory to the Court for selling the corn and cotton belonging to the estate of A.F.Cathey at private sale for cash anda for selling the remaining persoanl property belonging to said estate for cash in stead of on a credit of six months. It is therefore ordered and adjudged by the Court that the said A.L.Hobbs administrator of said A.F.Cathey deceased shall have license to sell the corn and cotton at private sale for cash at fa 1k, CRE ot such time and in such lots ,as,se@ said administrator will wmax bring the highest price . It is also ordered and adjudged that said admin- istrator have license to sell the remaining personal property belongings to said estate for cash , after giving twenty days notice of said sake_ oy posting a notice at the Court house door and four other public places in Iredell County , subject however(as to the remaining property scld for cash after the twenty days notice at public sale ) to the confirmation of this Court in case any creditor or legatee of said estate shall on the day of sale object to the completion of the sale of any article cf personal property "on account of the insuffi- ciency of the amount bia". To the Clerk of the Superior Court of Iredell County: The petition of Mrs Lettie L.Cathey , widow of A.F.Cathey,deceased, respectfuliy showeth that her late hus- band died intestate in Iredell County ,during the month of November 1905,leaving him surviving the following child ,to wit: Oneta Cathey who is his only heir at law ,that the said Oneta Cathey is now about 18 years of age and that A.L.Hobbs is her “Guardian having been duly appointed by the Clerk of the Superior Court of Iredell Count, on the 2lst day of November 1905. Your petitioner further showeth ,that her said husband during his coverture with the petitioner was seized in fee-simple and possessed of the following described real estate ,to wit: First tract. A, Hartness, Clerk of the Superior Court of Iredell County:= Your petitioners respectfully show to the Court:- Firet:— That the said J, A, Cathey isa dead and that the said Lou Cathey was appointed administratrix of the said J, A, Cathey, by the Clerk of the Superior Court of said County, on the lst day of January 1906, and at once entered upon the adminis tration of said estate, Second:— That from the best information and knowledge which your petitioner, the said Lou Cathey, administratrix has been able to obtain, the outstanding debts of the said estate amount to abvat $1500.00.
